Executive Summary
Recommendation to approve the release of two code enforcement liens with an accrued value of $654,250, for a reduced
payment of $5,760.90, in the code enforcement actions titled Board of County Commissioners v. Kirill Guminskiy, Case
Nos. CESD20190002150 and CENA20190002191 relating to property located at 3315 16th Ave SE, Folio No.
40992120100, Collier County, Florida.
OBJECTIVE: To have the Board of County Commissioners accept an offer to release two code enforcement liens
encumbering property located at 3315 16th Ave SE for payment of $5,760.90 in relation to Code Enforcement Board
Case Nos. CESD20190002150 and CENA20190002191.
CONSIDERATIONS: In Case No. CESD20190002150, the Code Enforcement Board ordered the imposition of a lien
against Kirill Guminskiy for a violation consisting of expired new construction permits: PRWL20180102898,
PRBD20160621813, and PRROW20160621820. The lien was recorded in the Official Records on November 19, 2019,
at O.R. Book 5696, Pages 3394-3395, in the amount of $8,118.77. Fines continued to accrue for 2,041 days ($250 per
day from September 24, 2019, through April 25, 2025), totaling $510,250. The owner brought the property into
compliance on April 25, 2025.
In Case No. CENA20190002191, the Code Enforcement Board ordered the imposition of a lien against Kirill
Guminskiy for a violation consisting of uncontained construction debris and materials, including wood, plastic scraps,
buckets, metal drums, and household trash. The lien was recorded in the Official Records on November 19, 2019, at
O.R. Book 5696, Pages 3396-3397, in the amount of $7,818.84. Fines continued to accrue for 1,440 days ($100 per day
from August 10, 2019, through July 19, 2023), totaling $144,000. The owner brought the property into compliance on
July 19, 2023.
Pursuant to Resolution No. 2023-90, a request for a reduction of fines may be considered when payment of the lien
would impose a severe financial hardship on the owner. In 2015, 16th Ave. Acres, LLC, purchased the property and
obtained the required permits to begin construction of a home. Oleg Dyatkevich, investor and representative for
Advanced Titan Inc., and 16th Ave. Acres, LLC, purchased the property in 2015 with his business partners and began
constructing a home. It was later discovered that Sergey Makhotkin, the business partner, had transferred the property to
Kirill Guminskiy without authorization.
After expending approximately $600,000 in legal expenses, permit fees, inspections, and demolition of the structure
following its destruction by fire, Mr. Dyatkevich obtained a default judgment to regain title, which was recorded in the
Official Records on November 22, 2021, at O.R. Book 6045, Page 1598. The liens were discovered while attempting to
obtain a title insurance policy.
The property is being actively maintained, and the owner has offered to pay $5,760.90 to settle the liens. The
recommended payment of $5,760.90 is based on ten percent of the Collier County Property Appraiser’s Assessed Value
of $57,609 and meets the criteria outlined in Resolution 2023-90.
This item is consistent with the Collier County strategic plan objective to preserve and enhance the character of our
community.
FISCAL IMPACT: Acceptance of payment of $5,760.90 to settle the liens will correlate to what is outlined in Collier
County Resolution 2023-90.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action.
LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it as to form and
legality. Majority support is required for approval. This item conforms to the Board’s policy contained in Resolution
2012-46. RTT

Good afternoon, Ms Burgos,
Ms Lynch will be reporting back to you later today, I hope.
Speaking of the amount I can pay, let me be completely open with you. I lost around $600k of my savings on this house due to a bad
partner. Then I spent money for 3 years of litigation. In the meantime the house got burnt by the Everglades fires. Now I am trying to get a
mortgage on this property. My fault is that I haven’t closed the demolition permit earlier - the inspector was pushing me to get rid of the
burnt down structure due to contamination. I did that but we haven’t finished installing the silt fence back then because I didn’t have clear
plans of rebuilding the house. I’ve found out that there are fines from Jason Gordon about 2 weeks ago.
If $5,761 is the minimal amount the county can accept, let it be so. If there is a slight possibility to reduce it without a lengthy process,
please, advise on the amount. I did not have prior violations. can only pay as a payoff from the mortgage (this week). The fee of $150k and
other amount of up to $1,000 I can pay by my credit card now.

Please review the application, page 2, “State the amount you are requesting to pay for each lien”. This space is for you to indicate how
much you can pay, 1 amount for both liens. Recommendations are 10% of the assessed value of the property for non-repeat violations;
20% if repeat violations. As of today, the property appraiser’s website shows the assessed value as $57,609.00.
I will add the application fee and forward the link.

This cause has come on to be heard before Magistrate Pamela Barger on
September 28, 2021, pursuant to the Plaintiffs' Motion for Default and Default
Judgment. The Magistrate has jurisdiction pursuant to the Florida Rules of Civil
Procedure, 1.490, et seq. The Court finds that an Order of Referral for the matters heard
by the Magistrate was served upon the parties and that no party made a timely objection
to the referral. This Court being otherwise advised, the following Findings of Fact and
Conclusions of Law are made:

FINDINGS OF FACT AND CONCLUSIONS OF LAW
Plaintiff filed this Complaint on November 6, 2020 seeking to quiet title to
real property located at 3315 16th Ave., Naples, FL 34117 ("Property").
2. In a Final Judgment entered in Case No. 2018-CA-1799, Collier County
Circuit Court, it was found the Defendant in that case, Sergey Makhotkin, was not

authorized to transfer the Property to the Defendant in this case, Kirill Guminskiy
("Guminskiy").
3. Guminskiy was served with this lawsuit on January 14, 2021.
4. As of the date of the hearing on the Motion, Guminskiy had not filed a
Response to the Complaint and had not filed any papers in this matter.
RECOMMENDED ORDER OF THE MAGISTRATE
Based upon the above-stated Findings of Fact and Conclusions of Law,
Magistrate submits the following Recommended Order for the approval of the Court:

I did not observe any “No Trespassing Signs”
went by and walked the lot. I witnessed weed
and grass vegetation over 18” (see Photo) I
also witnessed metal frames and other debris
(tire) throughout the property. Walked back
and it appears nothing has been done on this
property for a very long time. The concrete
pad is there in place. (See photo). There is a
dumpster on the lot. I called Angie at Yahl
Mulching and Recycling Inc 239-352-7888
and she informed me that no one has called
since November 2022 when the dumpster
was set. She gave me a contact name of Olig,
at 239-298-9738 from Advanced Titan Inc. I
will move to after 5-5-23 hearing on Musse

to leave a message. I called and talked to
Jason Gordon Esq.. 954-241-4207 and I
explained that his client needs to take care of
the following to stop the fines. Jason will call
Olig 239-298-9738 and get back with me.
1) They need to pick up the Demo permit as
its in ready for issuance and no one has come
to get it. Even though building is gone, they
need to pickup the permit and get inspections.
This will satisfy our case CESD20190002150
permit ending in 21813.
2) Irrigation (Well) Permit ending in 2898 – If
they have not done anything, then they need
to cancel it.
3) ROW permit ending in 21820 –
a. If they do not want to proceed- They
need new permit to restore to what it was
before. Dig out the drive and re-slope and sod
it.
b. If they want to keep it – they need new
permit to finish it out per code.
4) Building permit ending 2183 was
cancelled.

introduced himself as Eric (786-328-7059)
who is with the title company looking to
resolve the issues with the property. Eric
explained that the demo permit had been
finaled as of 4/25/25 and was asking what the
next steps were. I explained that the property
had a few other permits with issues that
needed to be resolved before the case could
be closed. I advised Eric to get in contact with
the permitting department to get further
assitance with the expired permits and
conditions or fees.
