Should a hearing be held on this item, all participants are required to be sworn in. Recommendation to approve for recording the minor plat of Abraham Acres, Application Number PL2025000393. OBJECTIVE: To approve for recording the minor plat of Abraham Acres, a subdivision of lands located in Section 31, Township 47 South, Range 28 East, Collier County, Florida. CONSIDERATIONS: The Development Review Division of the Growth Management Department has completed the review of the minor plat of Abraham Acres, and these documents are in compliance with the County Land Development Code (LDC) and Chapter 177, Florida Statutes. Under LDC Section 10.02.04 D, a minor plat approval may be requested as an alternative to the standard construction plans and plat approval where the plat does not require improvements, a construction and maintenance agreement, a security performance bond, or phasing. All fees have been paid. The Development Review Division recommends that the minor plat of Abraham Acres be approved for recording. This item is consistent with the Collier County strategic plan objective to operate an efficient and customer-focused permitting process. FISCAL IMPACT: The County will realize revenues as follows: Fund: Growth Management Fund 1014 Agency: County Manager Cost Center: 138327 - Land Development Services Total Revenue generated by this project: $1,025 plat review fee GROWTH MANAGEMENT IMPACT: The developer must receive a Certificate of Adequate Public Facilities (COA) prior to the issuance of the construction plan final approval letter and plat recordation, except when the applicant elects to delay obtaining a COA for non-residential developments that are required to obtain approval of a site development plan prior to the issuance of a building permit. LEGAL CONSIDERATIONS: The applicant is requesting approval of the minor subdivision plat. The Board shall consider the County Manager or designee’s recommendation and shall take evidence and testimony in regard to the minor subdivision plat requirements identified in LDC sections 10.02.04.D, 10.02.04 B, 10.02.04 C, and other provisions of the LDC, as well as Chapter 177, Florida Statutes. If the Board denies or places conditions on the minor subdivision plat, it shall state reasons for such denial or conditions. In accordance with the LDC, the applicant is required to submit the minor final subdivision plat to the County Manager or designee for recording within 18 months of the date of approval of the minor subdivision plat by the Board. However, following approval by the Board, but prior to recordation, the County Manager or designee may approve minor insubstantial changes to the minor subdivision plat, and the Board may approve any changes that are not minor and insubstantial.
