Code Case Number CELU20250000492 BEFORE ME, kJ° CCO , Judge of the Circuit Court in and for Collier County, Florida, personally appeared Code Enforcement Department ("CED") Supervisor Adam Collier, who being duly sworn, deposes and says that he has cause to believe and does believe that a condition of non-conformity exists on the property more particularly described as: [11750 Riggs Rd,Naples FL 34114 Collier County Florida. ("the Property")] Curtilage and exterior areas of the property. On December 13th, 2024, CED received a complaint forwarded from Collier County Commissioner's Office, Rick Locastro, alleging that the property located at 11750 Riggs Rd, Naples FL 34114, had prohibited land use violations including but not limited to seawall construction activity and/or dumping of seawall debris. During research we determined the property has a business tax receipt for a wholesale nursery. On 01.21.2025, 01.22.2025, 01.24.2025, 01.29.2025, 02.03.2025, 02.04.2025, 02.05.2025, 02.06.2025, 02.07.2025, 02.08.2025, 03.24.2025, 04.21.2025, 04.22.2025, 04.23.2025, 04.25.2025, 04.26.2025 04.30.2025, and 05.13.2025 surveillance/inspections were conducted by investigators with Collier County Code Enforcement and no activity related to a wholesale nursery business had been observed. Notes by investigator Stephanie Guttum for her 01.21.2025 observation state "Witnessed a white commercial truck with no cargo/freight leaving and entering the property located at 11750 Riggs Rd. The commercial vehicle had lettering on the door of vehicle stating Thomas Marine Construction. Observed two non-commercial extended cab trucks enter the property. The weather condition was misting. Therefore, the photograph resolution was compromised." On 05.19.2025, I, Adam Collier, attempted contact with tenant Duane Thomas Jr., by way of phone, leaving a message that requested permission to access the property with the receptionist. That call was not returned. There is no reason to believe that further requests for access will be successful without the issuance of an Inspection Warrant or similar court order. Research revealed that the Property is owned by 11750 Riggs Rd LLC, according to the records of the Collier County Property Appraiser for Folio No.761000006 (property record attached as Exhibit A & B). In addition, review of aerial imagery on Collier County Property Appraiser for the years 2021 —2025 appear to show an increase in accumulation of outside storage and/or litter (Aerial Imagery Attached as Exhibits C —G). Also, there is a pattern of similar cases reported to the CED within the past five years (Previous Code Case Detail Reports Attached as Exhibits H— K) Photos taken from Riggs Rd as part of current case CELU20250000492 (Images Attached Exhibits L — Q) Email correspondence from the respondent representative stating that the tenant is out of town through the month of June (Exhibit R). I am satisfied that there is reason to believe that conditions of non-conformity exist with respect to the above-referenced property, which conditions would constitute violations of local law with respect to building, fire, safety, environmental, animal control, land use, plumbing, electrical, health, minimum housing, and/or zoning regulations. This Inspection Warrant shall be effective for a period of fourteen(14) days from the date of its issuance unless extended or renewed by me upon being satisfied that such an extension or renewal is in the public interest. This Inspection Warrant must be executed and returned within the time specified or within the extended or renewal time period. After the expiration of such time, the Inspection Warrant, unless executed, is void. An inspection pursuant to this Inspection Warrant shall not be made between 6 p.m. of any day and 8 a.m. of the succeeding day; on Saturday, Sunday, or any legal holiday. An inspection pursuant to this inspection Warrant may be made in the absence of an owner or occupant over the age of 18 years of age specifically authorized upon a showing that such authority is reasonably necessary to effectuate the purpose of the rule being enforced. This Inspection Warrant shall not be made by means of forced entry. Notice that this Inspection Warrant has been issued shall be given to the property owner at least 24 hours before the Inspection Warrant is executed. Immediate execution of this Inspection Warrant shall be prohibited.
