Executive Summary
Recommendation that the Board of County Commissioners, as the ex officio Governing Board of the Collier County
Water-Sewer District, ratify administratively approved Change Order No. 4 to Agreement No. 23-8116, with Poole &
Kent Company of Florida, for the NCWRF Pretreatment Facility project, adding seventeen days to the contract time,
approving the use of $302,321.39 of the Owner’s Allowance, and authorize the Chairman to sign the attached Change
Order. (Project No. 70149)
OBJECTIVE: The public purpose is to provide wastewater treatment to meet demand at the North County Water
Reclamation Facility (NCWRF) and stay in compliance with regulatory requirements. This action is to eliminate three
parking spaces, raise the height of the fine screens, add two adjustable weir gates, remove two existing abandoned
concrete encased ductbanks, relocate an existing potable water main, revise the plant recycle piping alignment to allow
for connection to existing piping while avoiding an existing electrical ductbank, enhance odor functionality, and add
seventeen days to the NCWRF Pretreatment Facility project under Agreement No. 23-8116.
CONSIDERATIONS: On July 11, 2023 (Agenda item 11.A), the Board awarded Construction Agreement No. 23-8116
(the Agreement) to Poole & Kent Company of Florida in the amount of $55,660,000, which included a $5,000,000
Owner’s Allowance.
The attached Change Order No. 4 aligns with the original scope, terms, and conditions of the contract, which includes the
construction of a new Pretreatment Facility (Headworks) at the NCWRF. The attached change order authorizes a 17-day
time extension to the substantial and final completion dates due to rain events, and Hurricanes Milton and Helene. The
change order also authorizes $302,321.39 to be utilized from the Board-approved allowance funds for seven changes
summarized below.
During the investigation and planning for the demolition of the existing septage receiving area, the County discovered a
previously unknown buried electrical duct bank. A change was made to modify the demolition plan, which eliminates the
proposed additional parking, allows the existing odor control unit to remain, and provides for crushed stone restoration.
While eliminating the proposed additional parking, it saves the cost and the risk associated with relocating the existing
duct bank. It also saves the cost of relocating the existing odor control, which was to be self-performed by plant staff.
The additional cost associated with this change is $2,844.19.
Staff issued a second change under Work Directive #12 to address proposed water levels for the fine screens. This
change ensures that the water levels at the fine screens will meet the requirements of the fine screening equipment and
the overall pretreatment system. The changes include raising the elevation of the fine screen, replacing the passive
overflow with an adjustable weir gate, and modifying the control logic. The addition of the weir gate is a benefit to the
project as it increases operational flexibility by controlling the overflow elevation and flow rate of the existing flow
equalization system. The additional cost associated with this change is $68,194.00.
Work Directive #14 removes two existing concrete-encased duct banks at a cost of $25,362.00 that were uncovered
during construction and deemed abandoned. This change improves access for future operation and maintenance at the
plant, and improves construction safety on this project by eliminating the need to install pipelines beneath the duct banks.
Three work directives were issued due to unforeseen underground conditions encountered during construction at a total
cost of $127,944.61. Work Directive #15 was issued to relocate an unknown 4” potable water main that was discovered
during construction. Work Directives #16 and #17 were issued to provide for additional exploratory excavation to locate
existing forcemain pipes and the modifications required to connect the piping system. It is not unusual to encounter
variances in underground projects from the original as-built plans, which may have been prepared decades earlier, to
what is actually discovered in the field when a new project commences years later.
Staff issued Work Directive #19 to change the piping and electrical connections to the pretreatment facilities' odor
control equipment as betterments to the project. These include the addition of backup power for the control panel, extra
spray headers on the bio towers, enhanced control system functions, additional tank drains, increased water and drainpipe
sizes, and extended ductwork lengths on the inlet to the odor control fans. The changes enhance the odor control system's

features, improve operational flexibility, and reduce operation and maintenance costs. The additional cost of this change
is $77,976.59.
The Procurement Services Division administratively approved Change Order No. 4 on April 9, 2025, as authorized by
the Board in accordance with Section Nineteen, Contract Administration, subsection 3.b of the County’s Procurement
Ordinance, as amended.
The County’s Construction Engineer of Record, AECOM Technical Services, confirmed the unforeseen conditions,
proposed betterments, reviewed the proposed change order, and confirmed that the costs associated with the work are
reasonable.
The bid amount incorporated an allowance of $5,000,000 for owner-directed additional work. The costs associated with
the changes detailed in Change Order No. 4 will utilize the allowance. The allowance usage to date on the project is as
follows:

This item is consistent with the Collier County strategic plan objective to plan and build public infrastructure and
facilities to effectively, efficiently, and sustainably meet the needs of our community. It is further in support of the
Infrastructure and Asset Management Strategic Focus Area’s objectives to optimize the useful life of all public
infrastructure resources through proper planning and preventative maintenance as well as use the Annual Update and
Inventory Report, CCWSD Capital Improvement Program (CIP), FY25 Budget and other planning tools to establish and
implement plans that concurrently provide public infrastructure.
FISCAL IMPACT: Total funding needed for this change is $302,321.39. The source of the fund is Wastewater User
Fee, Capital Fund (4014), Project 70149, under Agreement No. 23-8116, Pay Item 4 – Owner’s Allowance.
GROWTH MANAGEMENT IMPACT: There is no Growth Management impact associated with this item.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote for Board
