JM Tile and Marlowe Inc. • As a part of the application process for the issuance of a registered building contractor license, Mr. Rodriguez was required to submit documentation showing his experience. No dates of employment were furnished. • Scope of work is interior masonry block, exterior brick masonry backup walls, and concrete forming and placing. • Based on the information received, it is staffs opinion that Mr. Rodriguez does not meet the minimum requirements as set forth in the Collier county code of laws and Ordinances, Section 22 183A1 and 22 183B 1 as it relates to experience and time required in the trade under section 22162. Jorge Diaz, Gonzales Painting — Credit Review Michael Bogert • Jorge Lionel Diaz Gonzalez has submitted an application for the issuance of a license as a painting contractor which requires 24 months of experience. As part of the application process for the issuance of a painting contractor license, Mr. Gonzalez was required to submit documentation shown his experience. As part of the review process by staff, Mr. Gonzalez has submitted the following verification of experience documents. A review of these documents shows the verification and construction experience submitted by Federico Morales, owner and qualifier for AM Prestige Painting, Inc. Terry Jerulle I'm doing a luxury home downtown Naples, and I call you up and say, I just finished the stucco today. I want you to go there tomorrow and put elastomeric paint on there. Tell me what your process is. Mr. Gonzalez was unable to describe the process. Stephen Jaron It sounds like you've got some experience painting, maybe mostly interior painting experience, but to get a painting license, you need to have the full range of painting experience. I think a good idea would probably be to get some more experience. Chairman Allen Do you want to withdraw your application? Mr. Gonzalez Yes, I withdraw. D. License LA00001152. • Dates of employment are listed as periodically from 2018 through 2024. • Mr. Randolph's listed duties are excavation, landscape and irrigation. • There's a notarized letter of construction experience submitted by Chad Davis, owner of Davis, Bobcat and Septic, an unlicensed dissolved entity. • Dates of employment are listed from 2003 through 2006. • Scope of work was that he installed septic systems using an excavator, and he also graded land. • Another notarized letter of construction experience submitted by Zachary Radford of Robert Wilson Landscape and Hauling in North Carolina entity with under unknown licensure. • Date of employments are listed as 2012 through 2015. • Scope of work was clearing land, trenching irrigation, and installing culverts for water mitigation. And finally, a notarized letter of construction experience submitted By Daniel Brooks, Jr. • Panther Run Golf Club superintendent. • Dates of employment are listed as February 26, 2024 to present. • Scope of work is operating heavy machinery, site preparation, excavation, land clearing, grading and drainage work. Based on the information received, it is staffs opinion that Mr. • Randolph does not meet the minimum requirements as set forth in the Collier County code of laws and Ordinances, Section 22183 and 22183, as it relates to experience and time required in the trade under section 22162, excavation contractor. Because Mr. Randolph does not meet the requirements for experience, Mr. Randolph is being referred to the Board under section 22 184B for decision. Mr. Randolph I'm in pursuit of an excavation contractor's license for grubbing clearing land, you know, legally. So that's kind of why I'm here today, is to, you know, progress my business and into that market. I did the excavation test, but I have that book and I refer to that as. 5 Page 7 of 182 Terry Jerulle I don't know that you have the experience for the whole license. Michael Bogert We can restrict the license for no canals, lakes, levees, things of that nature. Suzette Carolina Valesquez Martinez, All Naples Renovations LLC — Review of Experience Michael Bogert • Ms. Valesquez has submitted an application for the issuance of a license as a registered residential contractor, which requires 48 months of experience. • As part of the application process for the issuance of a registered residential contractor license, Ms. Velazquez was required to submit documentation showing her experience. • As part of the review process by staff, Ms. Velazquez has submitted the following verification of experience documents. • A review of these documents shows the verification of construction experience. • Submitted by Felix Guerra, president and qualifier for AA Masters Construction Development and Engineering Group Corp. License CGC 1525211. • Dates of employment are listed as 2021 to present. • Scope of work is remodels, flooring, painting and managing new construction or remodels. • There are a couple other letters of recommendation as well that do not indicate any trade experience. • Based on the information received, it is staffs opinion that Ms. Velasquez does not meet the minimum requirements as set forth in the Collier County Code of Laws and Ordinances, Section22183A1 and 22, 183 as it relates to experience and time required in the trade under section 22162. Registered residential contractor. • Because Ms. Velasquez does not meet the requirements under the Collier County Code of Laws and ordinances for experience, Ms. Velasquez is being referred to the Board under section 22184 referral of application to the Contractor's Licensing Board for decision. Kyle Lantz How would you know if a wall is a structural wall versus a non-structural wall? Now you don't have to give me a foolproof answer but 80% of the time structural walls have certain characteristics that non-structural walls don't. Christian Escobar, Just Like New Services Inc. — Probation Review — Credit Ryan Cathay • In that agenda we have the passport order along with an email that he had sent with some updates addressing his credit. I also have an additional email that I received the other day from him that He's out of town up north and not able to attend. • But he did provide an update which is in your packet along with an additional email today. If you want to read what he had sent, I can put that up for you. Kyle Lantz • So this is a complaint that I think I've brought up multiple times whenever we have these credit review issues is we have an order of the Board, which is great, and it says your credit has to come up and you have to give us a pay plan or whatever. And then a year later we were showing this order to the B • Board, but I don't know what the hell this means. I don't know what the guy's credit was a year ago. We Used to get their credit reports a year ago. If they came in after 90 days and they give a plan that says this is what we're going to do to pay it off and we're not seeing what these plans are. • So it's very difficult for me to say, hey, I think this guy is doing what he said he's going to do. I think this guy's not doing better, you better than he said he's going to do. I think his credit is better than it was or it's worse than it was. If they, I mean, just about every one of these have had. You have to give us a plan in 90 days and now we're a year later. • Well, how do we know if they're following the plan if we can't see the claim? So I think it's a. We're getting screwed out of the deal by staff on this, on all of these. And I hate to sell anybody out, but for us to make an informed decision, we got to have some information. Michael Bogert I think the way that these are getting tiered out, I think we're putting follow up some a year later when we're looking for the updated credit reports. But I don't think we're 7 Page 9 of 182 finding the, you know, the 90 day payment plans per se. I know conversations happen along those timeframes, but we have to hold them a little bit a lot more accountable for those 90 days. Patrick Neale • I would suggest the Board suspend his license because he's in violation of probation. • He hasn't provided the 90 day report, hasn't done anything in six months, hasn't provided a credit report showing he's over 660. I believe it is in the packet. He has shown some indication of payment plans and some payments possibly even being made or going out at least June 1 st. The Respondent is currently licensed as a LANDSCAPING RESTRICTED CONTRACTOR by Collier County Contractors' Licensing. 2. The Respondent, GLENN ALAN MONTGOMERY JR, is the Collier County license holder of record for PREMIER LANDSCAPE AND POOL DESIGN, LLC, (Q20190001602). 3. Under the provisions of Chapter 489 Florida Statutes [§489.105(12) F.S.] and the Code of Laws and Ordinances of Collier County, Florida [Sec. 22-2021, the Collier County Contractors' Licensing Board (Board), is authorized to impose penalties against Collier County Certificate of Competency holders who violate the Code of Laws and Ordinances of Collier County, Florida. 4. Under the provisions of the Code of Laws and Ordinances of Collier County, Florida Sec 22-202, the following actions of the Respondent, constitute misconduct and grounds for discipline. 5. On March 5, 2025, the Collier County Contractor Licensing Department received a complaint from the City of Naples Building Department for an unpermitted driveway paver replacement at 338 4T" Ave N, Naples, Florida 34102. 6. Upon investigation, it was discovered on February 11, 2025, PREMIER LANDSCAPE AND POOL DESIGN, LLC contracted with the property owner to Page 100 of 182 remove existing driveway pavers and replace with new shell stone pavers, rebuilt the front stoop to include a step down and footer, remove existing pavers in the rear of the yard and replace with sod, install a paver pad area for garbage cans and install a swale at 338 4T" Ave N, Naples, Florida 34102. The contracted amount for this work was $34,000.00. Four (4) payments have been made by the property owner to PREMIER PANDSCAPE AND POOL DESIGN, LLC all with a personal check. February 11,2025 for $9,000,00, February 14,2025 for $8,000.00, February 26,2025 for $10,000.00 and March 5,2025 for $4,000.00; totaling $31,000.00. 7. On March 5, 2025, Collier County Contractors Licensing Investigator Michael Governale, observed driveway pavers being replaced at 338 4T" Ave N., Naples, FL 34102. 8. On March 5, 2025, a review of the City of Naples permitting database revealed that no building permit was issued for the above scope of work and a stop work order was issued. 9. On March 5, 2025, City of Naples Deputy Building Official, Thomas Tucker, reviewed Collier County Contractors Licensing Investigator Michael Governale's site visit photos and determined a "driveway/right-of-way" permit was required. 10.On May 19, 2025, a Notice of Hearing to appear before the Collier County Contractors' Licensing Board on June 18, 2025, at 9:00 a.m. was served in person to the Respondent, GLENN ALAN MONTGOMERY JR. The Notice of Hearing was signed for by the Respondent and he was provided with a signed copy. 11. Page 125 of 182 Section 105 Permits [A] 105.1 Required Any owner or owner's authorized agent who intends to construct, enlarge, alter, repair, move, demolish or change the occupancy of a building or structure, or to erect, install, enlarge, alter, repair, remove, convert or replace any Impact -resistant coverings, electrical, gas, mechanical or plumbing system, the installation of which is regulated by this code, or to cause any such work to be performed, shall first make application to the building o>Ycia/and obtain the required permit [A] 105.1.1 Annual facility permit In lieu of an individual permit for each alteration to an existing electrical, gas, mechanical, plumbing or interior nonstructural office system(s), the building official is authorized to issue an annual permitfor any occupancy to facilitate routine or emergency service, repair, refurbishing, minor renovations of service systems or manufacturing equipment installations/relocations. The building official shall be notified of major changes and shall retain the right to make inspections at the facility site as deemed necessary. Ana nnualfacility permit shall be assessed with an annual fee and shall be valid for one year from date of issuance. A separate permit shall be obtained for each facility and for each construction trade, as applicable. The permit application shall contain a general description of the parameters of work intended to be performed during the year. [A] 105.1.2 Annual permit records The person to whom an annual permitis issued shall keep a detailed record of alterations made under such annual permit The buildingofFcial shall have access to such records at all times or such records shall be filed with the building official as designated. 105.1.3 Food permit In accordance with Section 500.12, Florida Statutes, a food permit from the Department of Agriculture and Consumer Services is required of any person who operates a food establishment or retail store. 105.1.4 Public swimming pool The local enforcing agency may not issue a building permit to construct, develop, or modify a publicswimming pool without proof of application, whether complete or incomplete, for an operating permit pursuant to Section 514.031, Florida Statutes. A certificate of completion or occupancy may not be issued until such operating permit is issued. The local enforcing agency shall conduct their review of the building permit application upon filing and in accordance with Chapter 553, Florida Statutes The local enforcing agency may confer with the Department of Health, if necessary, but may not delay the building permit application review while awaiting comment from the Department of Health. Self-contained refrigeration system containing 10 pounds (4.54 kg) or less of refrigerant and actuated by motors of 1 horsepower (0.75 kW) or less. The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning: Business organization means any partnership, corporation, business trust, joint venture, or other legal entity which engages or offers to engage in the business of contracting or acts as a contractor as defined in this section. Contracting means, except as exempted in this part, engaging in business as a contractor and includes, but is not limited to, performance of any of the acts as set forth in subsection (3) which define types of contractors. The attempted sale of contracting services and the negotiation or bid for a contract on these services also constitutes contracting. If the services offered require licensure or agent qualification, the offering, negotiation for a bid, or attempted sale of these services requires the corresponding licensure. However, the term "contracting' shall not extend to an individual, partnership, corporation, trust, or other legal entity that offers to sell or sells completed residences on property on which the individual or business entity has any legal or equitable interest, if the services of a qualified contractor certified or registered pursuant to the requirements of this chapter have been or will be retained for the purpose of constructing such residences. Contractor means the person who is qualified for and responsible for the entire project contracted for and, except for those herein exempted, the person who, for compensation, undertakes to, or submits a bid to, or does himself or by others, any or all of the following: construct, repair, alter, remodel, add to, demolish, subtract from, or improve any building or structure, including related improvements to real estate, for others, or for resale to others, as hereinafter defined in this section. (1) General contractor requires 48 months experience with a passing grade on an approved test and a business and law test and means a contractor whose services are unlimited as to the type of work which he/she may do, except as provided in this article or in the Florida Statutes. (See also the definition of subcontractors.) (2) Building contractor requires 48 months experience with a passing grade on an approved test and a business and law test and means a contractor whose services are limited to construction of commercial buildings and single -dwelling or multiple -dwelling residential buildings, which commercial or residential buildings do not exceed three stories in height, and accessory use structures in connection therewith or a contractor whose services are limited to remodeling, repair, or improvement of any size building if the services do not affect the structural members of the building. (See also the definition of subcontractor.) Placement of fire safing and fire stopping materials shall be permitted on wall, ceiling and floor penetrations created within the scope of the work allowed by this section. (27) Marine, seawall, and dock construction contractor requires 36 months experience, a passing grade on an approved test and a passing grade on a business and law test, and means those who are qualified to build and install bulkheads, revetments, docks, piers, wharves, groins, boathouses, lifts and davits, and to do pile driving. Electrical service and wiring must be provided by a licensed electrical contractor. (28) Masonry contractor requires 36 months experience, a passing grade on an approved test and a passing grade on a business and law test and means those who are qualified to select, cut, and lay brick and concrete block or any other unit masonry products, lay other baked clay products, rough cut and dress stone, artificial stone and precast blocks, glass brick or block, but who shall not pour or finish concrete. (29) Paving blocks contractor requires 24 months experience in the respective construction plus a passing grade on an approved test and a passing grade on a business and law test, and means those persons who are qualified to construct driveways, sidewalks, patios and decks, using concrete paving units. (30) Painting contractor requires 24 months experience, a passing grade on an approved test and a passing grade on a business and law test and means those who are qualified to use spraying equipment as well as hand tools to finish both exterior and interior work. A painting contractor may do paperhanging, sandblasting, waterproofing, and may clean and paint roofs. (31) Paving contractor (commercial or unlimited) requires 36 months experience, a passing grade on an approved test and a passing grade on a business and law test, and means those who are qualified with the experience and skill to construct roads, airport runways and aprons, parking lots, sidewalks, curbs and gutters, storm drainage facilities, and to perform the excavating, clearing, and grading incidental thereto. (32) Plastering and stucco contractor requires 36 months experience, a passing grade on an approved test and a passing grade on a business and law test, and means those who are qualified to coat surfaces, including lathing and drywall, with a mixture of sand or other aggregate gypsum plaster, Portland cement or quicklime and water, or any combination of such materials such as to create a permanent surface coating. This category does not include the plastering of the interior of a pool. (33) Pollutant storage contractor means a contractor who installs a pollutant storage tank. Said contractor must have a state pollutant storage license. A county certificate of competency is not available for this category. The following actions by a holder of a Collier County/City Certificate of Competency shall constitute misconduct and grounds for discipline pursuant to section 22-202: (1) Knowingly combining or conspiring with an unlicensed contractor by allowing one's Certificate of Competency to be used by an unlicensed contractor with intent to evade the provisions of this Ordinance. When a licensed contractor acts as the qualifying agent for any firm without first making application under this Ordinance to represent said firm, such act shall constitute prima facie evidence of intent to evade the provisions of this Ordinance. When a certificate holder allows his certificate to be used by one or more companies without having any active participation in the operations, management, and control of such companies, such act constitutes prima facie evidence of an intent to evade the provisions of this Ordinance. Active participation requires job site supervision, knowledge of and participation in the business operations of the company(s), including all contractual matters. a. If any individual qualifying any business organization ceases to be affiliated with such business organization, he shall so inform the Board. In addition if such individual is the only certified individual affiliated with the business organization, the business organization shall notify the Board of the individual's termination and shall have no more than sixty (60) days from the date of termination of the individual's affiliation with the business organization in which to affiliate with another person certified under the provisions of this article. In any event, the business organization shall not enter into any new contracts and may not engage in any new contracting until such time as a qualifying agent is employed. (2) Contracting to do any work outside of the scope of his/her competency as listed on his/her competency card and as defined in this Ordinance or as restricted by the Contractors' Licensing Board. (3) Abandoning a construction project in which he/she is engaged or under contract as a contractor. A project may be presumed abandoned if the contractor terminates the project withoutjust cause, or fails to notify the owner in writing of termination of the contract and basis for same, or fails to perform work for ninety (90) consecutive days without just cause and no said notice to the owner. (4) Diverting funds or property received for the execution of a specific contract project or operation or diverting funds earmarked for a specified purpose to any other use whatsoever. (5) Departing from or disregarding in any material respect the plans or specifications of a construction job without the consent of the owner or his duly authorized representative. 6/3/25, 11:10 AM Collier County, Fl- Code of Ordinances Failing to promptly correct faulty workmanship or promptly replace faulty materials installed contrary to the provisions of the construction contract. Faulty workmanship means work that is not commenced, not continued, or not completed in accordance with all specifications of the applicable written agreement. Faulty workmanship includes any material flaw(s) in the quality and/or quantity of the unfinished or finished work product, including any item that does not function properly as a part of the entire project. If there is no written agreement provision regarding the specific faulty workmanship issue, faulty workmanship exists if the work, process, product or part thereof does not meet generally accepted standards in Collier County in relation to the entire project. Faulty workmanship does not include matters of esthetics unless the esthetically related item clearly violates a written contract specification directly related thereto. (11) Failure to maintain at all times, with an insurance company authorized to do business in the State of Florida, the limits of liability and other categories of insurance as required by this Ordinance. (12) Failing to claim or refusing to accept certified mail directed to the contractor by the Contractors' Licensing Board, or its designee. (13) Failing to maintain a current mailing address. (14) Failing to appear in person or through a duly authorized representative at any scheduled hearing on a complaint filed against the contractor. (15) Being convicted or found guilty, regardless of adjudication, of a crime in Collier County which directly relates to the practice of contracting or the ability to practice contracting. (16) Allowing another to take a qualifying examination on the applicant's behalf. (17) Engaging in contracting business in Collier County or the City when prohibited from doing so by the Contractors' Licensing Board of Collier County. (18) Proceeding on any job without obtaining applicable permits or inspections from the City building and zoning division or the county building review and permitting department. (19) Failing in any material respect to comply with the provisions of this Ordinance as a contractor or as a qualifying agent for a business entity engaging in contracting. (20) Signing a statement with respect to a project or contract falsely indicating that the work is bonded; falsely indicating that payment has been made for subcontracted work, labor, or materials which results in a financial loss to the owner, purchaser, or contractor; or falsely indicating that Workers' Compensation and public liability insurance are provided. (21) Failure of a qualifying agent for a firm/legal business entity to comply with the requirements set forth in F.S. §§ 489.119 and 489.1195. Cost was $6895.00 (per Estimate 3202). 7. Pearl Hernandez paid PREMIER LANDSCAPE AND POOL DESIGN LLC ! AFFORDABLE HANDYMAN SERVICES via Zelle for Estimate 3202 above. 8, PREMIER LANDSCAPE AND POOL DESIGN, LLC then contracted with Collier Builders Group Inc (CBC1267(344) to complete the work. Payments were made from PREMIER LANDSCAPE AND POOL DESIGN, LLC and AFFORDABLE HANDYMAN SERVICES to Coflier Builders Group as follows: Check 1184, $1995.00, dated October 1, 2024; Check 1790, $1000.00 dated September 9, 2024: Check 1789, $1500.00 dated September6, 2024. 9. On April 29, 2025, a review of the Cityview permitting database revealed no building permit was issued for one of the two bathroom renovations and a stop work order was posted. A permit for renovations was issued to Collier Builders Group for one of the two bathroom renovations. 10.On May 8, 2025, Collier County Plans Reviewer Robert Moore confirmed a permit was required for the bathroom renovations. 11.On May 19, 2025, a Notice of Hearing to appear before the Collier County Contractors' Licensing Board on June 113, 2025, at 9:00 a.m. was served in person to the Respondent, GLENN ALAN MONTGOMERY JR. The Notice of Hearing was signed for by the Respondent and he was provided with a signed copy. 12. Based on the investigation, and pursuant to the Code of Laws and Ordinances of Collier County, Florida Section 22-202(a)(2) and (b), the Contractors' Licensing Supervisor determined sufficient cause exists to warrant the filing of formal charges. 13.
