WHEREAS, on May 14, 2009, Board of County Commissioners (Board) upon declaring that a local emergency existed within Collier County, Florida, requiring immediate measures to protect the public health, safety and welfare, and to protect real and personal property, adopted Ordinance No. 2009-23, known as the "Regulation of Outdoor Burning and Incendiary Devices during Drought Conditions Ordinance," which has been amended from time to time; and WHEREAS, on February 11, 2025, the Board in response to current wildfire conditions approved the County Manager to implement an immediate ban on all outdoor open burning, and outdoor ignition sources including fireworks, sparklers, incendiary devices (including but not limited to campfires, bonfires, trash burning, disposal of lit cigarettes or cigarette butts) until further notice in accordance with Ordinance No. 2009-23, as amended; and WHEREAS, Ordinance No. 2009-23, as amended, provides that the Ban shall remain in effect until the County Manager makes a determination that a drought emergency no longer exists and sends written notification of such condition to the Chairman of the Board, who may sign a Resolution repealing the burn ban and upon repeal, the restrictions on open burning or discharge of fireworks shall be immediately lifted; and WHEREAS, local fire chiefs, the Division of Forestry, and the Director of the Bureau of Emergency Services concur that the extreme drought conditions warranting the ban on outdoor burning and incendiary devices no longer exist and the Burn Ban may be repealed. NOW, THEREFORE, BE IT RESOLVED, BY THE CHAIRMAN OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: [24-EMG-00522/1875636/1] 15C 1. The Chairman of the Collier County Board of County Commissioners, upon written notification from the County Manager and based on information provided by local fire chiefs, the Division of Forestry, and the Director of the Bureau of Emergency Services, hereby affirms that the local emergency related to extreme drought conditions as declared/ratified on February 11, 2025, no longer exists. 2. The Burn Ban is hereby repealed in its entirety pursuant to Ordinance No. 2009-13, as subsequently amended. THIS RESOLUTION ADOPTED this 10A day of June, 2025.
