Agenda 06/10/2025 Item #16D 3 (1st Amendment for revisions to the CDBG Subrecipient Agreement #CD23-03 w/Renaissance Hall Senior Libing, LLLP)6/10/2025 Item # 16.D.3 ID# 2025-1692 Executive Summary Recommendation to approve and authorize the Chairman to sign the First Amendment for revisions to Community Development Block Grant Subrecipient Agreement #CD23-03 between Collier County and Renaissance Hall Senior Living, LLLP, in the amount of $329,706.00 for preconstruction costs associated with Phase II senior rental housing. (Housing Grants Fund 1835) OBJECTIVE: To fund the pre development cost associated with the development of affordable senior rental housing in Collier County. CONSIDERATIONS: Annually, the County receives U.S. Department of Housing and Urban Development (HUD) entitlement funds to allow local governments to meet program-specific community needs. Entitlement programs include Community Development Block Grant (CDBG), which can be used to fund a wide variety of projects such as public services, public infrastructure, and public facilities. On June 22, 2021, Agenda Item #16.D.7, the Board of County Commissioners (“Board”) approved the County’s U.S. Department of Housing and Urban Development (HUD) Five-Year Consolidated Plan for the use of entitlement funds for the program year period of PY 2021-2025 through Resolution 2021-131. On July 11, 2023, Agenda Item #16.D.3, the Board approved the Collier County One-year Action Plan for Federal Program Year 2023-2024 for the CDBG Program through Resolution 2023-131A. On October 24, 2023, Agenda Item #11.C, the Board approved funding allocations to support the Golden Gate Golf Course senior housing project in the amount of $329,706. The Board, in accordance with the County’s Citizen Participant Plan 2021-2025, waived the requirement to submit an application for funding following an “Open Door” process in which applications for funding can be conserved and accepted at any time during the program year until funds are no longer available for activities approved by the Board. On May 28, 2024, Agenda Item #16.D.4, the Board approved the substantial amendment to the PY23 Annual Action Plan to recognize the Golden Gate Senior Living project along with Resolution 2024-96. On September 25, 2024, the HUD Field Office completed its review of the Collier County, FL Annual Action Plan for 2023 version 1A. On April 8, 2025, Agenda Item #16.D.9, the Board approved Subrecipient Agreement #CD23-03, in the amount of $329,706.00, to utilize PY23 CDBG entitlement funds to support the pre-development costs associated with affordable housing to benefit seniors who are low- and moderate-income. The proposed First Amendment will revise the agreement through the following changes: 1. Section 1.1 Grant and Special Conditions to include language addressing Conflict of Interest 2. Section 1.2. C Performance Deliverables to include Conflict of Interest form and Whistleblower Protections Affidavit 3. Section 2.2 Records and Documentation to include Cybersecurity and measures to safeguard protected personally identifiable information 4. Part III Terms and Conditions to include Affirmative Action language 5. Part IV General Provisions to include compliance requirements of Build America, Buy America (BABA) 6. Add Exhibit H Whistleblower Protections Affidavit This item is consistent with the Collier County strategic plan objective to support comprehensive affordable housing opportunities.
