Executive Summary
Recommendation to approve and authorize the Chairman to sign three (3) Releases of Lien for full payment in the
amount of $61,612.03 pursuant to the Agreement for Deferral of 100% of Collier County Impact Fees for Owner
Occupied Affordable Housing Dwellings.
OBJECTIVE: To support comprehensive affordable housing opportunities.
CONSIDERATIONS: Pursuant to Article IV of Chapter 74 the Collier County Code of Ordinances, the County may
defer the payment of the impact fees for any new owner-occupied unit which qualifies as affordable housing.
Section 74-401(a)(3) of the Code of Laws authorizes the County Manager to enter into an impact fee deferral agreement
with the developer, homeowner or applicant. The deferred impact fees shall be a lien on the property and the agreement
shall be accepted by the County in lieu of prompt payment of the impact fee that would otherwise be due and payable
but for the agreement.
The following table provides details regarding the associated deferral agreement that has been repaid in full. As such,
satisfaction of lien is required.

This item is consistent with the Collier County strategic plan objective to support comprehensive affordable housing
opportunities.
FISCAL IMPACT: A total of $61,612.03 was paid to Collier County into the appropriate impact fee trust funds. The
total amount of $49,289.62 in impact fees paid and $12,322.41 in accumulated interest income. A recording fee of $10
per Release of Lien has been paid by the parties and deposited in the general fund (0001) Cost Center (155930).
GROWTH MANAGEMENT IMPACT: The Impact Fee Deferral program assists the County in meeting some of the
Housing Goals and Objectives in the Growth Management plan.
LEGAL CONSIDERATIONS: This item is approved for form and legality and requires a majority vote for Board
