OBJECTIVE: To meet the medical and fire safety needs of the community through the replacement and expansion of Station 21 in East Naples. CONSIDERATIONS: Station 21's design and age of the building is nearing the end of its useful life. Additionally, the Greater Naples District has grown since the inception of Station 21, including but not limited to Treviso Bay and Isles of Collier. As a result, the existing station is inadequate by today's standards. The purchase of this property next to Station 21 will make it possible to commence construction on the new site without interrupting the station's operations. The terms of the agreement include the purchase of a (0.53) acre property currently zoned C-4 at a price of $1.25 million, closing within 60 days. The aggressive closing timeline is a requirement of the seller. In that period of time of due diligence, the County will complete a formal appraisal, title search, and an environmental study. Since the structure is an old motel property, staff does not expect to conduct more than a phase I environmental inspection; however, it is expected that the building contains asbestos, which will be mitigated as part of future construction. The agreement includes a provision that allows the County flexibility by authorizing the County Manager or designee to extend the inspection or closing period, provided the total extension time does not exceed 60 days and each extension is documented in writing. This item seeks Board approval for the purchase of this property at a price of $1.25 million. Typically, a supermajority vote would be required if the purchase price exceeds the appraised value. Although the County has initiated the procurement of a formal, independent appraisal, the County Attorney believes that such an appraisal is pointless and not necessary if the Board approves the $1.25 million purchase price without seeing an appraisal. The long-term savings of utilizing an existing location that has signalization (a traffic light), which is required of a public safety building, will more than offset the difference and will result in long-term savings. The latest pricing on a traffic signal was close to $2,000,000, making this site not only practical but financially responsible. This strategic purchase saves the cost of signalization, is appropriately zoned for the intended use, and does not further disrupt another neighborhood because the use already exists next to the adjacent property. The neighborhood is used to the activity of a fire / EMS station. Finally, to ensure grant eligibility for the acquisition, prior to the execution of the Agreement for Sale, staff will include a provision that closing is subject to the availability of appropriations in the fiscal year of the Closing as well as subject to all United States Department of Housing and Urban Development (“HUD”) requirements for Federal grant funding to include fair market value pricing, the Uniform Relocation Act found in 42 U.S. Code Chapter 61, and HUD environmental clearance. This is a strategic land acquisition in support of the public infrastructure and quality of life for the Collier citizenry. FISCAL IMPACT: Funding for the acquisition of the property is currently available within County-Wide Capital Fund (3001), Project # 50294 -Strategic Land Acquisitions. There is potential for reimbursement from Surtax, pending validation, as well as the opportunity to utilize CBDG grants. GROWTH MANAGEMENT IMPACT: The expansion and replacement of EMS / Fire stations ensures the County is concurrent with its AUIR for health safety. Page 885 of 7924 5/27/2025 Item # 11.D ID# 2025-1828 LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney. In essence, staff is requesting that the Board approve the proposed agreement, with a purchase price which may exceed an independent appraisal. In keeping with Florida Statutes and Board policy, this has always been a two-step process, with the Board first authorizing the purchase, contingent on an appraisal, and then in a later meeting approving or rejecting the proposed purchase, based on the appraisal, which would require a supermajority vote if the sales price is greater than the appraisal. Here, staff has combined these two actions into one, presumably based on exigent circumstances. Approving a purchase without an appraisal is highly unusual and not recommended. With that noted, if the Board elects to purchase this parcel without an appraisal, I see no point in getting an appraisal, which would never go to the Board.
