Agenda 05/13/2025 Item #16D10 (Two releases of lien for Casa Amigo EHT, LLC related to 24 Multi-Family Affordable Housing Rental Housing Units)5/13/2025 Item # 16.D.10 ID# 2025-1466 Executive Summary Recommendation to approve and authorize the Chairman to sign two (2) Releases of Lien totaling $563,178.24 for Casa Amigo EHT, LLC related to 24 Multi-Family Affordable Housing Rental Housing Units due to the Sponsor’s payment of impact fees and a duplicate recording in the public records from the Sponsor. OBJECTIVE: To support comprehensive affordable housing opportunities and further, the County’s strategic plan focus area on Community Development for very low-, low-, and moderate-income persons through the State Housing Initiatives Partnership Program (SHIP). CONSIDERATIONS: On May 23, 2023(Agenda Item16.D1), Casa Amigo EHT, LLC (“Sponsor”) entered into a Sponsor Agreement with the County to utilize State Housing Initiatives Partnership (SHIP) funds for the development of a 24-unit multifamily rental project in Immokalee. Under this agreement, $250,000 in SHIP funds were allocated for the reimbursement of eligible project fees. Subsequently, the Sponsor opted not to seek reimbursement of the Collier County Impact Fees under the SHIP Sponsor Agreement. Instead, the Sponsor requested a deferral of these fees. As a result, a Lien Agreement with Owner for 100% Deferral of Collier County Impact Fees for Multi-Family Affordable Housing Rental Units (“Lien Agreement”) was executed on March 12, 2024 (Agenda Item #16F1), in the amount of $281,589.12, and was recorded in the public records on April 2, 2024. The agreement indicated that the deferral would be secured by a ten-year U.S. Treasury Bill (T-Bill) as collateral. The Sponsor subsequently paid the full Impact Fee amount of $281,589.12 on November 20, 2023, and no longer intends to use the T-Bill as collateral. The Lien Agreement was properly recorded on April 2, 2024, in Official Records Book 6345, Page 38, in the amount of $281,589.12. However, due to an administrative error, a duplicate copy of the agreement (intended as the Sponsor’s copy) was inadvertently recorded on the same date in Official Records Book 6345, Page 49. As a result, two (2) lien releases, totaling $563,178.24, are required to clear the public record. D. 1). The County shall secure a Mortgage, Note, and LURA upon reimbursement to the Sponsor under this agreement. Approval of this item will authorize the Chairman to sign the aforementioned Release of Liens, and the executed documents shall be recorded in the Public Records of Collier County, Florida at the cost of the County SHIP program.
