Agenda 05/13/2025 Item #16D 9 (First Amendment to the subrecipient agreement between Collier County and Immokalee Water and Sewer District)5/13/2025 Item # 16.D.9 ID# 2025-1440 Executive Summary Recommendation to approve and authorize the Chairman to sign the First Amendment to the subrecipient agreement between Collier County and Immokalee Water and Sewer District to amend Community Development Block Grant Agreement #CD24-01 to increase the project budget, remove items per new federal executive orders, add language pertaining to pay requests and update County contacts. (Housing Grant Fund 1835) OBJECTIVE: To improve the health and safety of Immokalee residents while furthering the County’s Strategic Plan of optimizing the useful life of public infrastructure and resources through preventative maintenance to effectively, efficiently and sustainably meet the needs of our community. CONSIDERATIONS: The U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant (CDBG) program funds locally defined requests for program specific needs in the community and infrastructure improvements. Every five years the County is required to submit a Consolidated Plan to HUD outlining the goals and activities to be undertaken with HUD entitlement funds over the five-year period as well as Annual Action Plans. On June 22, 2021, the Board of County Commissioners (Board) approved the County’s Five-Year Consolidated Plan for the use of entitlement funds for Program Years (PY’s) 2021-2025 (Agenda Item #16.D.7). As part of the County’s 5- year Consolidated Plan, the Community and Human Services (CHS) Division is required to adopt and submit an Annual Action Plan each year. This is the fourth (4th) year of the Five-Year Consolidated Plan. The 2024 Annual Action Plan was developed in accordance with the County’s Citizen Participation Plan (CPP) and identified this project as one that would help the community development needs in the County. The 2024 Annual Action Plan was approved by the Board on July 23, 2024 (Agenda Item #16.D.4). On September 10, 2024 (Agenda Item #16. D.3), the Board approved the CDBG Subrecipient Agreement with Immokalee Water and Sewer District. The agreement established $1,263,008.00 in funding for infrastructure improvements to clay sewer pipe in the Farm Worker Village development in Immokalee, Florida. Upon reviewing the bids for completion of this project on March 6, 2025, it was evident that additional funds would be required to meet the rising costs of construction, materials and labor. As a companion item, Agenda Item #16.D.5, is a Resolution authorizing approval of a Substantial Amendment to Collier County’s U.S. Department of Housing and Urban Development (HUD) Annual Action Plans for Program Years 2022-2023 and 2024-2025 to reallocate unencumbered Community Development Block Grant (CDBG) funds from various projects to Immokalee Water and Sewer District (CD24-01). The proposed First Amendment will include the following: 1. Increase the project budget from $1,263,008.00 to $2,066,506.01. 2.Remove Executive Order 11246 and DEI programs from Grant and Special Conditions and add two certification requirements pertaining to No Enemy Contracts and Whistleblower Protections per new federal executive orders. 3.Add Build America, Buy America requirements to Program Deliverables. 4.Update language to allow an increased frequency of pay request submissions. 5.Update the Grants Coordinator contact. 6. Update Public Records Custodian contact. This item is consistent with the Collier County strategic plan objective by optimizing the useful life of public infrastructure through proper maintenance for low- to moderate-income households of Collier County. FISCAL IMPACT: This action has no fiscal impact. The funding source for the award is the CDBG grant and is budgeted in Housing Grant Fund (1835) Projects 33915 (PY 2024), 33855 (PY 2023), and 33823 (PY 2022). GROWTH MANAGEMENT IMPACT: Acceptance and implementation of this will further the Goals, Objectives and Policies within the Housing Element of the Growth Management Plan of Collier County.
