5/13/2025 Item # 16.D.7 ID# 2025-799 Executive Summary Recommendation to award Invitation to Bid No. 24-8295, “Immokalee Pioneer Museum at Roberts Ranch,” to Miniopolis LLC, in the amount of $546,699.99, approve an Owner's Allowance of $37,830, authorize the Chairman to sign the attached Agreement, and approve a budget amendment in the amount of $87,725.80 to reflect a Memorandum of Understanding between the Collier County Museum Division and Collier County Community and Human Services for the project, increasing the total project award to $649,215.80. (Funding for this project is provided by the American Rescue Plan Act State and Local Fiscal Recovery Fund)(Public Services Grant Fund 1839) OBJECTIVE: To further the ability for the Collier County Museum to serve the Immokalee community through educational programs and food distribution of fruit and vegetables grown onsite. This project meets Collier County’s Quality of Place strategic goal by offering expanded access to health, wellness, and human services. CONSIDERATIONS: Congress passed the American Rescue Plan Act of 2021 (the "ARP"), which was signed into law on March 11, 2021. Included in the ARP was a $350 billion State and Local Fiscal Recovery Fund from which the County will receive a $74,762,701 allocation. On September 21, 2021, the Collier County Museum Division was awarded $561,490 of ARP funding for the Immokalee Pioneer Museum project. On May 9, 2022, the Collier County Museum Division entered into a Memorandum of Understanding ("MOU") with the Human Services Division related to the ARP funding award, which addressed, in part, the necessary budget amendments to recognize the grant revenue supporting the Immokalee Pioneer Museum project. On April 11, 2024, the parties to the MOU entered into a First Amendment to that agreement to extend the period of performance until September 30, 2026, and update the project’s Key Performance Indicators. On December 10, 2024, the County Manager executed the Coronavirus State and Local Recovery Plan Amendment #12, which reallocated a total of $49,300.00 from E.C. Project CC 1.1 “Affordable Housing – Mortgage and Rent” to E.C. 2.1 Project CC 4.3 “Collier County Museums: Immokalee Pioneer Museum”. On December 20, 2024, the Second Amendment to the MOU between Collier County Museums and Collier County Community and Human Services was executed to add this supplemental funding to the award, bringing the award balance to $610,790. On January 30, 2025, an additional $38,425.80 was reallocated from EC 7.1 “Administrative”, EC 2.24 Project CC4.1 “Collier County Libraries – COLE Program”; and EC 2.2 Project CC 1.1 “Affordable Housing – Mortgage and Rent” to E.C. Project 4.3 “Collier County Museums: Immokalee Pioneer Museum” to make up for the remaining shortfall in funding to complete the construction phase of the project. On May 6, 2025, the Third Amendment to the MOU between Collier County Museums and Collier County Community and Human Services was executed to add this supplemental funding to the award. Staff recommends Page 1976 of 5243 5/13/2025 Item # 16.D.7 ID# 2025-799 the attached contract be awarded to Miniopolis LLC, based on the award of the total bid amount of $546,699.99. In addition to the total bid amount, staff has allocated $37,830.00 as an Owner’s Allowance, which is only to be used for unanticipated circumstances that might arise during the project and only as directed by the County. If approved, the Purchase Order opening the project will include the base bid amount and the Owner's Allowance. The County’s engineering and landscape architect consultant, LJA Engineering, Inc., evaluated the bid and determined that Miniopolis LLC met all the qualifications required for this project and submitted the lowest, responsive, and responsible bid. Therefore, the staff is recommending that the attached Agreement be awarded to Miniopolis LLC for the total contract amount of $546,699.99, plus the Owner's Allowance of $37,830. The proposed budget amendment for this project will recognize both allocations of supplemental award to the Collier County Museums: Immokalee Pioneer Museum project. This project meets Collier County’s Quality of Place strategic objective by offering expanded access to health, wellness, and human services. FISCAL IMPACT: The funding for this project is available in Public Services Grant Fund (1839) Project 33809. The attached Budget Amendment is necessary to recognize the $87,725.80 increase in funding for the Immokalee Pioneer Museum project. The budget amendment will recognize the additional funds in Public Services Grant Fund (1839) Project 33809. GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this action. Nine hundred and three (903) viewed the bid package, and the County received three (3) bids by November 14th, 2024, the submission deadline. Staff reviewed the bids received, and two (2) bidders were deemed responsive and responsible as shown above. Miniopolis LLC had minor irregularities and minor calculation errors. Heatherwood Construction Company was deemed non‐responsive for not completing all line items on the bid schedule in conformance with the bid requirements. Staff determined that Miniopolis LLC, is the lowest responsive and responsible bidder. Staff recommends the contract be awarded to Miniopolis LLC, the lowest responsive and responsible bidder, based on the award of the total bid amount of $546,699.99. In addition to the total bid amount, staff has allocated $37,830.00 in Owner’s Allowance, for Owner’s use as directed. LJA Engineering, Inc. (Engineer of Record) (“LJA”) has completed our review of the bid submitted by the lowest bidder for this project, and we are pleased to provide the following award recommendation. The scope of the Immokalee Pioneer Museum at Roberts Ranch project includes completion of a pre-existing on-site storm water treatment system and construction of accessible pathways, two native chickee shade structures, a citrus grove, raised planters, a kitchen garden, and an automatic irrigation system. The following three contractors submitted bids for consideration: Miniopolis, LLC Capitol Contractors, LLC Heatherwood Construction Company Collier County Procurement’s review of the bid tabulations determined that the apparent low bidder is Miniopolis, LLC with a bid of $546,699.99. Heatherwood Construction Company was determined to be non-responsive. LJA was provided with the bid Schedule for Miniopolis, LLC, their bid is approximately 31% higher than the Engineer’s Opinion of Probable Construction Cost (OPC) of $416,095.90. References were provided, and the completed Vendor Reference Check Logs for each reference are attached hereto. The project references provided by Miniopolis, LLC were all contacted. LJA determined the references contain sufficient relevant experience with similar projects to demonstrate the required successful experience to complete the project. Miniopolis, LLC is a corporation formed in 2020 and is authorized to transact business in the State of Florida. Additionally, per U.S Treasury FAQ 17.19, "the subrecipient may reclassifl the SLFRI funds from the original activity to another project that would be eligible under SLFRF rules".
