Agenda 05/13/2025 Item #16D 5 (Resolution authorizing approval of a substantial amendment to Collier County's U.S Department of Housing and Urban Development (HUD) Annual Action Plans for Program Years 2022-2023, 2023-2024, and 2024-2025)5/13/2025 Item # 16.D.5 ID# 2025-1370 Executive Summary Recommendation to adopt a resolution authorizing approval of a substantial amendment to Collier County's U.S Department of Housing and Urban Development (HUD) Annual Action Plans for Program Years 2022-2023, 2023-2024, and 2024-2025; to reallocate unencumbered Community Development Block Grant (CDBG) funds from various projects to Immokalee Water & Sewer District (CD24-01) and authorize submission of the substantial amendment to HUD. OBJECTIVE: To maintain compliance with federal regulations that allow for the acceptance and use of federal U.S. Department of Housing and Urban Development entitlement funds to advance the County’s strategic plan by optimizing the useful life of public infrastructure through proper maintenance for low- to moderate-income households of Collier County. CONSIDERATIONS: The U.S. Department of Housing and Urban Development (HUD) provides entitlement funds to local governments to meet program-specific community needs. Entitlement programs include Community Development Block Grant (CDBG), HOME Investment Partnerships (HOME), and Emergency Solutions Grant (ESG). Community and Human Services (CHS) staff have recently identified changes to various activities to better address community needs. HUD regulations at 24 CFR Part 91.505 require amendments to Annual Action Plans whenever there is a change in the allocation priorities or method of distributing funds presented in the plan; a change in the use of funds to an activity not described in the Annual Action Plan; or a change in the purpose, scope, location, or beneficiaries of an activity. Collier County is proposing to amend Program Years (PY): 2022-2023, 2023-2024 and 2024-2025 U.S. Department of Housing and Urban Development (HUD) Annual Action Plans. The Board of County Commissioners approved the PY 2022-2023 Annual Action Plan on June 28, 2022 (Agenda Item #16.D.4), PY 2023-2024 Annual Action Plan on July 11, 2023 (Agenda Item #16.D.3) and PY 2024-2025 Annual Action Plan on July 23, 2024 (Agenda Item #16.D.4). The Board of County Commissioners approved substantial amendments for PY 2022-2023 and PY 2023-2024 on May 28, 2024 (Agenda Item #16.D.4), PY 2023-2024 and 2024-2025 on January 14, 2025 (Agenda Item #16.D.5), PY 2022- 2023 and 2024-2025 on February 11, 2025 (Agenda Item #16.D.6), PY 2022-2023 and PY 2024-2025 on April 8, 2025 (Agenda Item #16.D.5) . A substantial amendment to an Action Plan or Consolidated Plan requires advertising and a 30-day public comment period. The required notice was published in the Naples Daily News on March 28, 2025. The advertisement identified a 30-day public comment period from March 31, 2025 to May 1, 2025. On April 21, 2025, a public hearing was held to address the proposed actions and as of the agenda publication, no comments regarding the substantial amendment were received. The following substantial amendment changes are proposed to the PY2022-2023 and PY2024-2025 Annual Action Plans (in all areas where the activity description is referenced). Project Name: CDBG: Public Facilities & Infrastructure Modify activities as follows to reallocate funding: Reallocate $62,421 in unspent CDBG funds from the Immokalee CRA-Sidewalks Design Phase activity (CD22-03) to the Immokalee Water & Sewer District (CD24-01). These funds will be used to upgrade the clay sewer pipes in Farm Worker Village in Immokalee. The following substantial amendment changes are proposed to the PY2023-2024 Annual Action Plan (in all areas where the activity description is referenced). Modify Project: Project Name: CDBG: Rental Rehab to CDBG: Public Facilities & Infrastructure Modify activities as follows to reallocate funding: Remove the Collier County Housing Authority (CD23-01) HVAC Installation activity and reallocate the $500,000 of CDBG funds to the Immokalee Water & Sewer District (CD24-01) to upgrade clay sewer pipes in Farm Worker Village in Immokalee. The following substantial amendment changes are proposed to the PY2024-2025 Annual Action Plan (in all areas where Page 1901 of 5243 5/13/2025 Item # 16.D.5 ID# 2025-1370 the activity description is referenced). Modify Project: Project Name: CDBG: Public Services to CDBG: Public Facilities & Infrastructure Modify activities as follows to reallocate funding: Remove the Valerie’s House counseling and staff support activity for those impacted by disasters and reallocate the $41,077.01 of CDBG funds to the Immokalee Water & Sewer District (CD24-01) to upgrade clay sewer pipes in Farm Worker Village in Immokalee. Project Name: CDBG: Public Facilities & Infrastructure Modify activities as follows to reallocate funding: Reallocate $200,000 in CDBG funds from Collier County Community Redevelopment Agency in the Bayshore Gateway Triangle Community Redevelopment Area (BGTCRA) acquisition activity to the Immokalee Water & Sewer District (CD24-01) to upgrade clay sewer pipes in Farm Worker Village in Immokalee. An amended subrecipient agreement (CD24-01) between the County and Immokalee Water & Sewer District will be presented to the Board for approval. This item is consistent with the Collier County strategic plan objective by optimizing the useful life of public infrastructure through proper maintenance for low- to moderate-income households of Collier County. FISCAL IMPACT: There is no new fiscal impact to reallocate CDBG funds between activities. The reallocated funds in this substantial amendment for Immokalee Water & Sewer District are budgeted in Housing Grant Fund (1835) Projects 33823 ($62,421.00), 33855 ($500,000) and 33915 ($241,077.01.) GROWTH MANAGEMENT IMPACT: Acceptance and implementation of this HUD substantial amendment furthers the Goals, Objectives, and Policies of the Housing Element and the Growth Management Plan.
