Agenda 05/13/2025 Item #16A14 (The release of four CE liens in relation to CESM and CE Board Case # CEV20200007340, CENA20220008308, CEPM20230002425, AND CENA20230008527)5/13/2025 Item # 16.A.14 ID# 2025-1426 Executive Summary Recommendation to approve the release of four code enforcement liens with an accrued value of $82,250, for a reduced payment of $15,641.70, in the code enforcement actions titled Board of County Commissioners v. Robert P. Yardley and Louise L. Yardley and Board of County Commissioners v. Bernhardt Family Trust, relating to the property located at 5340 Myrtle Ln, Collier County, Florida. OBJECTIVE: To have the Board of County Commissioners approve an offer to release four code enforcement liens with an accrued value of $82,250 for payment of $15,641.70 in relation to Code Enforcement Special Magistrate and Code Enforcement Board Case Nos. CEV20200007340, CENA20220008308, CEPM20230002425, and CENA20230008527. CONSIDERATIONS: As a result of various code violations at 5340 Myrtle Ln., both the Collier County Special Magistrate and Collier County Code Enforcement Board imposed various liens on the property as follows: In Case No. CEV20200007340, the violations consisted of an inoperable, unlicensed recreational vehicle and a vehicle with an expired license tag on residential property. The lien was recorded on February 25, 2021, at O.R. Book 5898, Page 927, in the amount of $4,073.45. Fines continued to accrue, and the lien amount of $58,750 is based on 1,175 days at $50 per day, from November 21, 2020, through February 8, 2024. The property was brought into compliance on February 8, 2024. In Case No. CENA20220008308, the violation consisted of weeds and grass in excess of 18” throughout the property, including the right-of-way and swale. The lien was recorded on June 23, 2023, in O.R. Book 6261, Page 1635, for the amount of $6,068.55. Fines continued to accrue, and the amount of $5,400 is based on 54 days of accrued fines, at $100 per day from March 11, 2023, through May 3, 2023. The property was brought into compliance by a county vendor on May 3, 2023. In Case No. CEPM20230002425, the violation consisted of damaged soffits, a missing section of the downspout, and microbial growth on the exterior walls. The lien was recorded on November 22, 2023, at O.R. Book 6307, Page 3362, in the amount of $2,968.56. Fines continued to accrue, and the amount of $8,100 is based on 162 days of accrued fines, at $50 per day from August 31, 2023, through February 8, 2024. The property was brought into compliance on February 8, 2024. Mariano Bernhardt, trustee of the Bernhardt Family Trust, purchased the property from the Yardleys pursuant to the Warranty Deed recorded on February 2, 2024, in OR Book 6326, PG. 2771 with the understanding that the violations would be abated prior to the closing date. When Mr. Bernhardt discovered the elderly homeowners had not achieved compliance. The Bernhardt family decided to move forward with the purchase and abate the violations themselves. The Code Enforcement Board ordered the imposition of a lien against the new owners, Bernhardt Family Trust, in Case No. CENA20230008527. The repeated violation consisted of weeds and grass growth in excess of 18” throughout the property, including the swale. The lien was recorded in the Official Records on March 28, 2024, at O.R. Book 6353, Page 298, for $10,059.35. Fines continued to accrue; therefore, the current lien amount of $10,000 is based on a reduced fine of $5,000 and a previously assessed civil penalty of $5,000, totaling $10,000. The new owner brought the property into compliance on February 5, 2024. Pursuant to Resolution No. 2023-90, a request for reduction of fines may be considered, in part, when a lien encumbers property under new ownership, and the new owner has diligently pursued abatement and achieved compliance and/or when payment of the lien would impose a severe financial hardship on the owner. All violations occurred prior to the Bernhardt family ownership. They spent a substantial amount of time and money attending Code Enforcement Board hearings, abating the violations, and legal costs. The recommended payment of $15,641.70 is based on 10% of the Collier County Property Appraiser’s assessed value of $156,417 and meets the criteria outlined in Resolution 2023-90. There are no known violations at this time. This item is consistent with the Collier County strategic plan objective to preserve and enhance the character of our Page 1118 of 5243 5/13/2025 Item # 16.A.14 ID# 2025-1426 community. FISCAL IMPACT: Acceptance of payment of $15,641.70 to settle the lien will correlate to what is outlined in Collier County Resolution 2023-90. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action. LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it as to form and legality. Majority support is required for approval. This item conforms to the Board’s policy contained in Resolution 2023-90. RTT RECOMMENDATIONS: To approve the recommended reduction of fines in the amount of $66,608.30, accept payment amount of $15,641.70, release the liens, and authorize the Chairman to sign the attached releases and satisfaction of liens for recording in the Official Public Records.
