Resolution 1993-355i RESOLUTION NO. 93- 355 AUGUST 24, 1993 ‘A-- RESOLUTION APPROVING WITH CONDITIONS PETITION CCSL-93-4 REQUESTING A VARIANCE FROM THE COASTAL CONSTRUCTION SETBACK LINE (CCSL) TO CONSTRUCT A BRICK PAVER WALKWAY TO EXISTING WALKOVER BRIDGE AND CONSTRUCT 6' X 8' GROUND LEVEL DECK WITH SHOWER AND SEATING/STORAGE AREA FOR GULFSIDE I CONDO, TO CONSTRUCT BRICK PAVER WALKWAY TO WALKOVER BRIDGE, REPAIR WALKOVER BRIDGE, CONSTRUCT NEW RAMP AND ADD SHOWER FOR GULFSIDE II CONDO AND TO CONSTRUCT A WATER LINE PROVIDING WATER TO SHOWERS LOCATED AT BOTH WALKOVERS FOR PROPERTY LOCATED ON LOT 5 LESS N'LY 100' AND ALL OF LOTS 3 & 4, BLOCK A, UNIT 2, BAKER CARROLL POINT, IN SECTION 29, TOWNSHIP 48 SOUTH, RANGE 25 EAST, COLLIER COUNTY. FLORIDA. ' WHEREAS, the petitioner, Gilbert H. Neal, Vice President of Vanderbilt Gulfside Condominium Association, Inc. requests a variance from the Coastal Construction Setback Line (CCSL), as required by Collier County Land Development Code, Division 3.13, as amended, to allow l) construction of a brick paver walkway to existing walkover bridge and construct 6' x 8' ground level deck with shower and seating/storage area for Gulf side I Condo and 2) construction of a brick paver walkway to walkover bridge, repair walkover bridge, construct new ramp and add shower for Gulfside II Condo (See Exhibit "A"); and WHEREAS, the subject property is a seven (7±) acre parcel located on the west side of Gulfshore Drive, approximately four hundred feet south of the intersection of Gulfshore Drive and lllth Avenue; and WHEREAS, the proposed brick paver walkways will extend approximately one hundred five (105) feet seaward of the adopted Coastal Construction Setback Line (CCSL); and WHEREAS, the proposed deck and shower at the northern walkover will extend approximately one hundred ten (110) feet seaward of the adopted CCSL; and WHEREAS, the proposed reconstruction of the southern walkovei will extend approximately one hundred thirty (130) feet seaward of the adopted CCSL; and MOK 000page 55 -1- I m AUGUST 24, 1993 WHEREAS, the proposed water line will be set in a shallow trench and will extend approximately one hundred five (105) feet seaward of the adopted CCSL to the northern boardwalk; will run parallel and ten (10) feet landward of the vegetation line approximately one hundred ten (llO) feet seaward of the adopted CCSL amd will extend out to the southern boardwalk approximately one hundred thirty (130) feet seaward of the adopted CCSL; and WHEREAS, structures which extend no further seaward than the parallel line established by adjacent permitted structure which have not been unduly affected by erosion are allowed by Collier County Land Development Code Division 3.13, as amended; and WHEREAS, dune walkovers are consistent with Subsection 161.55 (1) and (2), Florida Statutes, the Coastal Zone Protection Act of 1985 and the Collier County Growth Management Plan - Conservation and Coastal Management Element Policy 11.4.7 and 11.4.8. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: Variance Petition CCSL-93-4 be approved subject to the following conditions: II '■if I L |k. 1. The elevated boardwalk, shall be designed in accordance with the standards of the Florida Department of Natural Resources (FDNR) and approved by the FDNR Division of Beaches and Shores. 2. Construction activities shall not occur within one hundred (100) feet of the sea turtle nesting zone, defined by Collier County Land Development Code Division 3.10, between May 1 - October 31, sea turtle nesting season, without first submitting and obtaining FDNR and Collier County Construction in Sea Turtle Nesting Area Permits. 3.If it is necessary for vehicles to be on the beach during construction, a Collier County Vehicle on the Beach permit shall be required, subject to review and approval by the Project Plan Review - Environmental Staff prior to any construction activity. In the event protected species, burrows or nests are encountered during construction, work shall cease, and Collier County Project Plan Review Environmental Staff shall be contacted immediately. Petitioner shall notify Project Plan Review Environmental Staf' one week prior to commencing work seaward of CCSL and shall again contact Staff within one week following completion of work seaward of CCSL. Outdoor lighting associated with construction, or development within three hundred (300) feet of the high tide line, shall be in compliance with Division 3.10 of Collier Cotinty Land Development Code. wwK OOOpage 56 7. Minor revisions to Coastal Construction Setback Line Variance CCSL-93-4 (including changes in siting and structures) may be approved, in writing, by the Site Development Review Director. This Resolution adopted after motion, second and majority vote favoring same. DONE AND ORDERED DATE; this day of 1993.
