Resolution 1981-190pffi .... mil l|||l||||■ll||||illll|l|||l| fm ^ 063 ml9i August 25, 1981 RESOLUTION 81-190 RELATING TO PETITION CCCL-81-2C FOR A VARIANCE FROM THE COASTAL CONSTRUCTION CONTROL LINE AS REQUIRED BY ORDINANCE 75-19 NBEREAS, Vanderbilt Surf Colony Associates, Ltd. has requested a variance from the Coastal Construction Control Line as required in Ordinance 75-19 for the purpose of sodding an area ninety (90) feet seavard of the State of Florida established Coastal Construction Control Line on the following described property: Lots 3 and 4, Block "A", Baker-Carroll Point,j ana ^# oawwjw — —- - -- - - - - - recorded in Plat Book 8, Page 62, Public Records of Collier County, Florida. MHEREAS, the Environmental Consultant and the Community Develop- Bient Administrator have reviewed said petition and have made a determination that the granting of said petition is consistent with the requirements of Ordinance 75-19; and, WHEREAS, the Board of County Commissioners had made a finding that the granting of this petition is consistent with the intent and purpose of Ordinance 75-19; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of Collier County, Florida, that Petition CCCL-81-2C be and the same is granted and subject to the following: .1. The granting of the petition is to permit the placement of sod and creating a lawn-type condition no more than eighty seven (87) feet seaward of the established Coastal Construction Control Line. 2. the sod shall be the Floratam variety of St. Augustine grass. 3. MO fill material will be added or removed from the variance site. 4. «ie last three (3) or more feet seaward of the proposed sodded area shall be planted in shrub height Sea Grape plants (Cocolojto uvifera). 5. Boarded walkways shall be constructed from the sodded area over the planted Sea Grapes and the existing Sea Gats (Uniola paniculata) up to the sand beach. C. Oonditions stipulated in items 4 ai^ 5 shall be planted and constructed for the previously sodded area of Phase X. Signs designating Federal and/or Florida State penalties for damage caused to Sea Oat plants shall be placed in clearly visible 7. Any required variance from the toning requirements must be requested by the petitioner and processed through the Board of Zoning Appeals as provided by law. 10. The granting of this variance shall not be valid unless the peti­ tioner receives a variance from the State Cabinet from the State Regulations governing the Coastal Construction Control Line. BE IT FURTHER RESOLVED that this resolution be recorded in the sdLnutes of this Board.
