Resolution 1980-266BOOK 058 December 2, 1980 RESOLUTION 80- 266 • RELATING TO PETITION CCCL-80-10C FOR 1 A VARIANCE FROM THE COASTAL CONSTRUCTION CONTROL LINE AS REQUIRED BY ORDINANCE • 75-19 WHEREAS, Vanderbilt Surf Colony, Inc. has requested a variance from the Coastal Construction Control Line as re­ quired in Ordinance 75-19 for the purpose of sodding an area one hundred and ten (110) feet seaward of the State of Florida established Coastal Construction Control Line on the following described property: Lot 5, Block "A", Baker-Carroll Point, Unit No. 2, as recorded in Plat Book 8, Page 62, Public Records of Collier County, Florida WHEREAS, the Environmental Consultant Md the Community Development Administrator have reviewed said petition and have made a determination that the granting of said petition is con­ sistent with the requirements of Ordinance 75-19; and, WHEREAS, the Board of County Commissioners has made a finding that the granting of this petition is consistent with the intent and purpose of Ordinance 75-19; NOW, T1:erefORE, be it resolved, by the Board of County . Coinnissioners of Collier County, Florida, that Petition CCCL-80-10C be and the same is granted subject to the conditions shown on Exhibit 1, dated October 27, 1980, and bearing the signature of Jay L. Harmic, Ph.D., County Environmental Consultant, and subject to the following* 1. The granting of the petition is to permit the placement of sod and creating a lawn-type condition one hundred and ten (110) feet seaward of the established Coastal Con­ struction Control Line. 2. The sod shall be the Floratan variety of St. Augustine grass. 3. No fill material will be added or removed from the variance site. 4. The granting of the variance complies with the general intent of Ordinance 75-19. ■1 ■I ..'J December 2. 1980 5. Any required variance from the coning requirements must be requested by the petitioner and processed through the .Board of Zoning Appeals as provided by low. C. The granting of this variance shall not be valid unless the petitioner receives a variance from the State Cabinet from the State Regulations governing the Coastal Construc­ tion Control Line.
