Executive Summary
A Resolution of the Board of County Commissioners of Collier County, Florida, closing the approved Terafina Planned
Unit Development, which has fully completed all its development pursuant to its Development Order(s) and has been
found by Collier County to have only one Transportation Commitment remaining. (PL20240012112)
OBJECTIVE: To close-out of the Terafina Planned Unit Development such that this PUD will have commitments,
except one transportation commitment, deemed completed in accordance with Section 10.02.13.F.5 of the Land
Development Code (LDC) and be relieved of their Annual Monitoring responsibilities as defined by Sections,
10.02.13.F of the LDC
CONSIDERATIONS: Staff seeks the approval of the Terafina PUD Close-Out resolution so that the PUD is
designated, without uncertainty, as “complete,” “built-out,” and/or “closed-out.” Once approved, it will be certified as
having met its commitments. The one remaining transportation commitment will still be in effect and tracked through
the Commitment Tracking System.
The Closed-Out PUD shall remain in that status whereby no further development orders shall be issued relative to
applications for the authorization of additional residential density within the subject PUD. In order to grant future
development rights for density and/or intensity within a Closed-Out PUD, the Board of County Commissioners shall
approve a PUD amendment which shall return the PUD to an active status and require the PUD to be compliant with the
reporting responsibilities of the Land Development Code Section 10.02.13.F.
There is one remaining transportation commitment. The commitment is for a fair share contribution towards a traffic
signal at the project entrance. This commitment states:
The developer shall make a fair share contribution towards the capital cost of traffic signals at the project
entrance when deemed warranted by the Transportation Services Administrator, or his designee. These signals shall be
owned, operated and maintained by Collier County.
After the Board of County Commissioners renders the final determination of Close-Out, this Closed-Out PUD will be
eliminated from any further demands for commitment contributions or assessment of commitment compliance by staff.
It will remain Closed-Out until subsequent action is approved by the Board of County Commissioners as an amendment
specific to the PUD. The PUD amendment will then return the PUD to an active status for monitoring.
The Terafina PUD summary of development and compliance with the developer commitments follows:
Ordinances: 01-71, 04-15, 04-69, 05-06, and 08-45
Ordinance Authorized: 850 Residential Dwelling Units
Recorded Built Out: 802 Residential Dwelling Units
Unbuilt Units: 48 Residential Dwelling Units
This item is consistent with the Collier County strategic plan objective to operate an efficient and customer-focused
permitting process.
FISCAL IMPACT: The Close-Out of the Terafina PUD will have no fiscal impact on the County. The application fee
submitted has been applied to the staff hours allocated to preparing the PUD documents for verification reviews and
presentation to the Board.
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this Executive
Summary.
LEGAL CONSIDERATIONS: This item is approved as to form and legality, and requires majority vote for Board

RESOLUTION NO. 2025 - ____
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, CLOSING THE APPROVED TERAFINA
PLANNED UNIT DEVELOPMENT WHICH HAS COMPLETED ALL ITS
DEVELOPMENT PURSUANT TO ITS DEVELOPMENT ORDER(S) AND HAS
BEEN FOUND BY COLLIER COUNTY TO HAVE ONLY ONE
TRANSPORTATION COMMITMENT REMAINING.
WHEREAS, it is in the mutual interests of the Terafina Planned Unit Development and Collier
County to close out the Planned Unit Development so that annual reporting obligations on behalf of the
Planned Unit Development and review of those reports by the County will become unnecessary upon
approval of this Resolution; and
WHEREAS, the Planned Unit Development has explicitly complied with each and every
developer commitment except for one remaining transportation commitment for a fair share contribution
towards a traffic signal at the project entrance-which will remain in effect and will be tracked through the
Commitment Tracking System; and
WHEREAS, LDC Section 10.02.13.F.5 requires that a release of PUD commitments determined
to be no longer necessary be approved by the Board of County Commissioners.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA that the Terafina Planned Unit
Development within Collier County is found to be “built-out” and therefore is deemed “closed out” for
purposes of the LDC Section 10.02.13.F.
BE IT FURTHER RESOLVED that the Board finds the commitment for a fair share
contribution towards a traffic signal at the project entrance will remain in effect and be tracked through
the Commitment Tracking System.
BE IT FURTHER RESOLVED that this closed-out PUD will be eliminated from any further
demands for PUD monitoring compliance by staff, and the PUD will remain closed-out until subsequent
action is approved by the Board of County Commissioners as an amendment specific to the PUD. The
PUD amendment will then return the PUD to an active status for monitoring.

Notice is hereby given that a public hearing will be held by the Collier County Board of County Commissioners
commencing at 9:00 a.m. on April 22, 2025, in the Board of County Commissioners meeting room, third floor, Collier
Government Center, 3299 East Tamiami Trail, Naples, FL, to consider:

The PUD is located in Collier County, Florida, approximately one mile north of Immokalee Road (CR 846), east of the
Quail Creek Subdivision and north of the Old Cypress PUD, in Section 16, Township 48 South, Range 26 East,
consisting of 637 acres.
A copy of the proposed Resolution is on file with the Clerk to the Board and is available for inspection. All interested
parties are invited to attend and be heard.
All persons wishing to speak on any agenda item must register with the County Manager prior to presentation of the
agenda item to be addressed. Individual speakers will be limited to 3 minutes on any item. The selection of an individual
to speak on behalf of an organization or group is encouraged. If recognized by the Chairman, a spokesperson for a group
or organization may be allotted 10 minutes to speak on an item. Written materials intended to be considered by the
Board shall be submitted to the appropriate County staff a minimum of 7 days prior to the public hearing. All materials
used in presentations before the Board will become a permanent part of the record.
As part of an ongoing initiative to encourage public involvement, the public will have the opportunity to provide public
comments remotely, as well as in person, during this proceeding. Individuals who would like to participate remotely
