Executive Summary
Recommendation that the Board, as the Governing Body of Collier County, and the Ex-Officio Governing Board of the
Collier County Water-Sewer District, to approve the termination of two inactive easements – one being an Exclusive
Well, Well Pump, and Water Pipeline Easement and the other being a Utility Easement to support the development of
The Gate, Collier County’s contractor developing and operating the Golden Gate Golf Course, and the State Veterans
Nursing Home.
OBJECTIVE: To terminate an inactive Exclusive Well, Well Pump, and Water Pipeline Easement and Utility
Easement to allow the construction of The Gate and the Veterans Affairs Nursing Home.
CONSIDERATIONS: The Collier County Water Sewer District (“CCWSD”) extended transmission infrastructure
through the Golden Gate Golf Course, after reviewing all existing easements on the property and securing new
easements as stipulated in Ordinance 2022-13. Two utility easements are no longer needed by the CCWSD, and the lines
are inactive.
Utility Easement 1:
• The Exclusive Well, Well Pump, and Water Pipeline Easement was acquired by Florida Cities Water Company,
a predecessor in interest to the CCWSD via an Easement Grant from Golden Gate Inn & Country Club, which
was recorded on Book 2228, Pages 1331- 1335, of the Official Records of Collier County.
Utility Easement 2:
• The Board of County Commissioners of Collier County, Florida, as the Governing Board of the CCWSD, as a
successor in interest to the owners of the Golden Gate Golf Course, acquired a Utility Easement via a Quit-
Claim Deed, which was recorded on Book 1131, Pages 1230-1233, of the Official Records of Collier County.
A termination of both easements is necessary to allow for the development of The Gate and the State Veterans Nursing
Home. A copy of each Termination of Easement is attached. The utility facilities within the easements are currently
inactive.
This item is consistent with the Collier County strategic plan objective to enhance Veterans' access to health, wellness,
and human services while supporting efficient infrastructure planning and inclusive land use development. This item is
also consistent with the Collier County strategic plan objective to encourage diverse economic opportunities by fostering
a business-friendly environment and to develop and utilize partnerships to ensure that government facilities meet public
expectations.
FISCAL IMPACT: The estimated cost of recording the Termination of Easement will be $61.00. The source of this
funding is the Facilities Management Division. Funding is available in and is consistent with, the FY 2025 Budget
approved by the Board on September 27, 2024. Funds are available in Fund 3001 Cost Center 110434.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a majority vote for
Board approval - DDP
RECOMMENDATIONS: To approve the attached Termination of Easement for an Exclusive Well, Well Pump, and
Water Pipeline Easement and a Utility Easement, authorize the Chair to execute the Termination of Easements; and
direct the County Manager, or designee, to record the Termination of Easements in the Official Records of Collier,
County, Florida.

TERMINATION OF EASEMENT
THIS TERMINATION OF EASEMENT ("Termination") is made and entered into this
_ day of 2025 by the Collier County Board of County Commissioners, as the
goveming body of Collier County, Florida, and as the Ex-Officio Goveming Board of the Collier
County Water-Sewer District ("Board"), with an address of c/o County Attorney's Offrce,3299
Tamiami Trail East, Suite 800, Naples, FL 34112.
RECITALS
WHEREAS, an Exclusive Well, Well Pump and Water Pipeline Easement Grant, dated
September 10,1996, and recorded on September 13,1996, in Official Records Book 2228,Page
1331, of the Public Records of Collier County, Florida, was granted to the Florida Cities Water
Company ("Easement 1"); and
WHEREAS, a Quit-Claim Deed, dated February 25, 1985, and recorded on April 19,
1985, in Official Records Book 1131, Pages 1230-1233, of the Public Records of Collier County,
Florida, which included certain utility easements, was granted to Avatar Utilities, Inc. of Florida
("Easement2"); and
WHEREAS, Articles of Merger, filed on March 27, 7987, merged Avatar Utilities Inc. of
Florida into Florida Cities Water Company, as evidenced in Official Records Book 1270, Page
2140, Public Records of Collier County, Florida; and
WHEREAS, Florida Cities Water Company entered into a Transfer, Assignment and
Assumption Agreement with Florida Govemmental Utility Authority dated April 7, 1999 and
recorded on April 16,1999 in Official Records Book 2536,Page 0921, of the Public Records of
Collier County, Florida; and
WHEREAS, Florida Governmental Utility Authority entered into an Assignment and
Assumption of Easements with the Board, dated and recorded on March l, 2078 in Offrcial
Records Book 5482,Page 1741, of the Public Records of Collier County, Florida; and
WHEREAS, the Board is the owner of record of Easement I and easement interests in
Easement 2; and
WHER-EAS, the Board seeks to facilitate the redevelopment of the Golden Gate Golf
Course property, specifically the projects The Gate and the Veterans Affairs Nursing Home, by
terminating Easement I and the easement interests in Easement 2, as described in Exhibit "A",

attached hereto an incorporated herein by reference, which burden said property and no longer
serve a practical purpose, all in the public interest.
NOW, THEREFORE, in consideration of TEN DOLLARS ($10.00) and other valuable
consideration, receipt of which is hereby acknowledged, the Board does hereby relinquish,
abandon, and terminate its interest in Easement 1 and easement interests in Easement 2, as
described in Exhibit "A", and releases the servient estate from these easements.

and year first above written.
