Executive Summary
Recommendation to approve a Resolution for final acceptance of the private roadway and drainage improvements, and
acceptance of the plat dedications, for the final plat of Montiano, Application Number PL20140002750, and authorize
the release of the maintenance security in the amount of $168,017.50.
OBJECTIVE: To have the Board of County Commissioners (Board) grant final acceptance of the infrastructure
improvements associated with the subdivision, accept the plat dedications, and authorize the release of the maintenance
security.
CONSIDERATIONS:
1. On July 22, 2016, the Growth Management Department granted preliminary acceptance of the roadway and
drainage improvements in Montiano.
2. The Treviso Bay Property Owners Master Association and the Wentworth Estates Community Development
District will maintain the roadway and drainage improvements.
3. The required improvements have been constructed in accordance with the Land Development Code. The
Growth Management Department inspected them on February 27, 2025, and is recommending their final
acceptance.
4. Staff has prepared a resolution for final acceptance, which the County Attorney's Office has approved. The
resolution is a requirement of Section 10.02.05 C of the Land Development Code. A copy of the resolution is
attached.
This item is consistent with the Collier County strategic plan objective to operate an efficient and customer-focused
permitting process.
FISCAL IMPACT: The Treviso Bay Property Owners Association and the Wentworth Estates Community
Development District will maintain the roadway and drainage improvements. The existing security of $168,017.50 will
be released upon Board approval and is based on the work performed and completed pursuant to the terms of the
Construction and Maintenance Agreement dated September 8, 2013.
GROWTH MANAGEMENT IMPACT: There is no growth management impact.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a majority vote for
Board approval. - DDP
RECOMMENDATIONS: To grant final acceptance of the roadway and drainage improvements in Montiano,
Application Number PL20140002750, and authorize:
1. The Chairman to execute the attached resolution authorizing final acceptance of the improvements and plat
dedications.
2. The Clerk of Courts to release the maintenance security.

THIS ASSIGNMENT AND ASSUMPTION OF CONSTRUCTION AND
MAINTENANCE AGREEMENTS FOR SUBDMSION IMPROVEMENTS (this
'Assigp$e$") is made and entered effective as of the z c da! of September, 2022 ("EffegUy9
Date), by and between Lennar Homes, LLC, a Florida limited liability company ( AsciCttq")
and Imperial Homes of Naples, LLC, a Florida limited liability company ("Ass!gnee").
WITNESSETH:
WHEREAS, Lennar Homes, LLC, a Florida limited liability company, as "DgelgpeI",
and the Board of County Commissioners of Collier County, Floridq as the "Board" are parties to
that certain Construction and Maintenance Agreement for Subdivision Improvements dated
September 8, 2015 associated with Montiano (PL20140002750), (the 'ASEE4qE!" attached
hereto as Exhibit by reference made a part hereto); and
WHEREAS, Assignor desires to transfer and assign to Assignee, and Assignee desires to
accept and assume the assignment thereof, all of Assignor's right, title, and interest in and to the
Agreemenq and
WHEREAS, Assignee wishes to fumish and/or replace the Agreement's original
subdivision performance security referenced in paragraph 2 of the Agreement with a replacement
subdivision performance security (attached hereto as Exhibit "B" and by refercnce made a part
hereof).
NOW, THEREFORE, for and in consideration of the sum of TEN DOLLARS ($10.00)
and other good and valuable consideration, the receipt and sufficiency of which is hereby
acknowledged, As'signee and Assignor agree as follows:

Assignment.
Recitals. The foregoing recitals are true and corrcct and comprise a pafi of this

assignment of the above-referenced righs, title, interest, powers, privileges, b€nefits, and
assumes and agrees to perform, fully, timely and in accordance with the terms and conditions of
the Agreement, the obligations of Assignor (as Developer) in, to and under the Agreement.
including posting its altemate security in the current amount of$168,017.50 in favor of Collier
County within five (5) days from the execution of this Assignment. The parties agree that failure
to post the altemate security under the Agreement shall be a default under the Agreement and the
Agreement shall terminate.

4. Indemnification. Assignee hereby indemnifies and holds Assignor hannless from
any and all liability, claims, actions, suits or demands by any person, corporation or other entity
arising under the Agreement, including but not limited to any damage or loss from a claim on the
bond by Collier County for Assignee's failure to firlfill any ofthe obligations assumed under this
Assignment.
5. Further Assurances. The parties herelo covenant and agree to execute all such
further instruments and take such further action as reasonably required by either Party or the
Board to further effectuate this Assignment and the transactions contemplated herein.
6. Survival of Provisions. The covenants, representations, and obligations contained
in this Assignment shall survive the consummation of all transactions contemplated herein, and
this Assignment shall bind and inure to lhe benefit of the parties hereto and their respective
successors and assigns.
7. Authorization. The undersigned represent and warrant that they have the authority
to sign on behalf of the parties and that all necessary consents, if any, have been obtained.
8. Counterparts. This Assignment may be executed in one or more duplicate
counterparts, each of which shall, upon execution by all parties, be deemed to be an original.
Signatures by electronic mail or facsimile transmission of this Assignment shall be acceptable
and binding upon the parties hereto.

RESOLUTION NO.25-
A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COT]NTY, FLORJDA
AUTHORIZING FINAL ACCEPTANCE OF CERTAIN
ROADWAY AND DRAINAGE IMPROVEMENTS AND
PLAT DEDICATIONS IN MONTIANO, ACCORDING TO
THE PLAT THEREOF RECORDED IN PLAT BOOK 59,
PAGES 28 THROUGH 30, AND Rf,LEASE OF THE
MAINTENATICE SECURITY.
WHEREAS, the Board of County Commissioners of Collier County, Florida, on
September 8, 2015, approved the plat of Montiano for recording; and
WHEREAS, the Developer has constructed and maintained the roadway and drainage
improvements in accordance with the approved plans and specifications as required by the Land
Development Code (Collier County Ordinance No. 04-41 , as amended); and
WHEREAS, the Developer is requesting final acceptance of the roadway and drainage
improvements and release ofthe maintenance security; and
WHEREAS, the Development Review Division has inspected the roadway and drainage
improvements, and is recommending acceptance of said facilities.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COLTNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that final acceptance is hereby
granted for those roadway and drainage improvements and plat dedications in Montiano,
pursuant to the plat thereof recorded in Plat Book 59, pages 28 through 30, and the Clerk is
hereby authorized to release the mainlenance security.
BE IT FURTHER RESOLVED AND ORDERED that the roadway and drainage
improvements within Montiano will be maintained privately in the future and will not be the
responsibility of Collier County.
