Executive Summary
Recommendation to approve the release of two code enforcement liens with an accrued value of $286,200, for a reduced
payment of $43,960.20, in the code enforcement action titled Board of County Commissioners vs. Nicholas Ballo in
Special Magistrate Case Nos. CEPM20190011873 and CEV20220000047, relating to property located at 807 108th Ave.
N., Collier County, Florida.
OBJECTIVE: Recommendation to approve the release of two code enforcement liens with an accrued value of
$286,200 for a reduced payment of $43,960.20 in the code enforcement action titled Board of County Commissioners
vs. Nicholas Ballo in Special Magistrate Case Nos. CEPM20190011873 and CEV20220000047, relating to property
located at 807 108th Ave. N., Collier County, Florida.
CONSIDERATIONS: In Case No. CEPM20190011873, the Special Magistrate ordered the imposition of a lien against
Nicholas Ballo for a violation consisting of an outdoor swimming pool without a permanent protective barrier and a
damaged fence with missing panels, located in the rear of the property. The lien was recorded in the Official Records on
September 29, 2020, at O.R. Book 5822, Page 1187 in the amount of $32,323.50. Fines continued to accrue for 1,738
days ($150 per day from February 4, 2020, through November 6, 2024), totaling $260,700. Permit PRFW20240625389
was finaled and the owner brought the property into compliance on November 6, 2024.
In Case No. CEV20220000047, the Special Magistrate ordered the imposition of a lien against Nicholas Ballo for a
violation consisting of an unlicensed, inoperable vehicle on an improved residential property. The lien was recorded in
the Official Records on June 22, 2022, at O.R. Book 6144, Page 996 for the amount of $3,023.45. Fines continued to
accrue for 510 days ($50 per day from April 9, 2022, through August 31, 2023), totaling $25,500. The owner brought
the property into compliance on August 31, 2023.
Pursuant to Resolution No. 2023-90, a request for a reduction of fines may be considered when payment of the lien
would impose a severe financial hardship on the owner. Mr. Ballo states his income was limited due to losing his job
around the time of the violations. He is now working full-time and diligently working towards repaying debt. With the
assistance of his family, Mr. Ballo was able to bring the property into compliance and hopes to use the sale proceeds
from the home to attend law school. The property is being actively maintained, and the owner offers to pay $44,000 to
settle the liens; however, Code Enforcement recommends the board accept $43,960.20 to settle the fines. The
recommended payment of $43,960.20 is based on ten percent of the Collier County Property Appraiser’s Assessed
Value of $439,602 and meets the criteria outlined in Resolution 2023-90.
This item is consistent with the Collier County strategic plan objective to preserve and enhance the character of our
community.
FISCAL IMPACT: Acceptance of a payment of $43,960.20 to settle the liens will correlate to what is outlined in
Collier County Resolution 2023-90.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action.
LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it as to form and
legality. Majority support is required for approval. This item conforms to the Board’s policy contained in Resolution
2023-90. RTT
RECOMMENDATIONS: To approve the recommended reduction of fines in the amount of $242,239.80, accept
payment in the amount of $43,960.20, release the liens, and authorize the Chairman to sign the attached releases and
satisfaction of liens for recording in the Official Public Records.
