NEALE PRESIDING The Honorable Special Magistrate Patrick H. Neale called the Hearing to order at 9:00 AM. All those testifying at the proceeding did so under oath. 2. Pledge of Allegiance The Pledge of Allegiance was recited. Prior to conducting the Hearing, Respondents were given an opportunity to speak with their Investigating Officers for a Resolution by Stipulation. Water damage to the ceiling and interior walls. FOLIO NO: 25117900023 PROPERTY ADDRESS: 14855 Mystic Lake Circle, Unit 104, Naples, FL 34119 Richard Ricciardi, attorney and Nicole Martinez Property Manager testified they are in the process of obtaining permits for the work and requested a 90 day extension in the case. Officer Musse represented the County and confirmed there is an active permit for the unit. Melissa Buchman , tenant testified the Respondent disregarded the Special Magistrate’s previous order and did not abate the rent according to her account information obtained from the complex’s office staff. She has not received a temporary housing stipend since the previous hearing in November of 2024 and no work has been completed in the unit. She was not allowed to have a copy of her statement from the office staff who only showed her a screen shot of the account. Mr. Ricciardi testified the rent was abated and providing a stipend was optional and they are close to abating the violation. Ms. Martinez testified Ms. Buchman was offered release from the lease, which she did not accept. If available, she could be moved to a similar 4BR apartment or if available downsize to a 3BR unit. Ms. Buchman noted a 3BR unit would be acceptable. April 4, 2025 4 Special Magistrate Neale, GRANTED and Extension for Compliance Deadline in the case until the May Special Magistrate hearing date subject to the following: 1. The rent due for the unit continues to be abated. 2. Ms. Buchman be relocated to a 3BR or 4BR unit as soon as possible. 3. If Ms. Buchman is relocated to a unit in the complex, the abatement of rent ceases upon executing the agreement. 3. CASE NO: CESD20220002913 OWNER: Margarita Granados OFFICER: Thomas Pitura VIOLATIONS: Collier County Land Development Code 04-41, as amended, Sections 10.02.06(B)(1)(a), 10.02.06(B)(1)(e) and 10.02.06(B)(1)(e)(i). Modifications and additions made to the mobile home that require a Collier County Building Permit. FOLIO NO: 293400006 PROPERTY ADDRESS: 237 Polk Pl., Naples, FL 34104 Officer Pitura represented the County. Margarita Granados was present and her daughter Cindy Granados acted as interpreter. Margarita Granados testified contractor issues have prevented the violation being abated. One contractor had his license suspended and the next one they hired passed away. They have engaged a third contractor who is working on the permits required to abate the violation. Officer Pitura noted the case began in 2022. Special Magistrate Neale, after hearing the testimony GRANTED the motion for Extension of Compliance Deadline to the May 2025 Special Magistrate hearing date. 4. CASE NO: CESD20230009119 OWNER: Jose Jaramillo and Maria Guadalupe Jaramillo OFFICER: Delicia Pulse VIOLATIONS: Collier County Land Development Code 04-41, as amended, Sections 10.02.06(B)(1)(a), 10.02.06(B)(1)(e) and 10.02.06(B)(1)(e)(i). Two unpermitted structures on the property. Permit PRROW20200205637 for a new paver driveway, and Permit PRBD20190208512 for a roof mounted grid system that are now expired. Maria Guadalupe Jaramillo testified the violation is nearly abated with sod remaining to be placed for the Right-of-Way permit and the one structure remaining which will be removed from the property. Special Magistrate Neale, after hearing the testimony GRANTED the motion for Extension of Compliance Deadline to the June 2025 Special Magistrate hearing date. 5. CASE NO: CEPM20240007906 OWNER: COAST PREM PROP VII LLC OFFICER: Jonathan Musse VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 22, Article VI, Section April 4, 2025 5 22-228(1). Elevator out of service. FOLIO NO: 61835000007 PROPERTY ADDRESS: 2600 Tamiami Trail E, Naples, FL 34112 Jose Martinez represented the Respondent noting the building is a hotel and the elevator is operational. They are working diligently to abate the violation and are dealing with FEMA as part of the permit application with the County. He requested 90 days to abate the violation. Officer Musse represented the County and confirmed the permit is under review. The Stipulation was entered into by the Respondent’s representative Chris Evans on April 2, 2025. Letitia Accarrino objected to the Stipulation as the poles negatively impact the neighborhood and should be removed until a permit is obtained for the project. Special Magistrate Neale noted both parties have agreed to the Stipulation. Special Magistrate Neale found the Respondent GUILTY of the alleged violation and was ordered to: 1. Pay Operational Costs in the amount of $111.70 incurred in the prosecution of this case within 30 days of this hearing. 2. Obtain all required Collier County Building Permit(s), or Demolition Permits, Variances, Inspections and Certificate of Completion/Occupancy for the driving range poles and protective netting within 120 days of this hearing or a fine of $200.00 per day will be imposed until the violation has been abated. 3. Notify Code Enforcement Investigator when the violation has been abated in order to conduct a final inspection to confirm abatement. If the Respondent fails to abate the violation the County may abate the violation and may use the assistance of the Collier County Sheriff’s Office to enforce the provisions of this agreement and all costs of abatement shall be assessed to the property owner. Florida Island Tours Company operating multiple vessels for the business with a duplicated commercial vessel permit. Multiple vessels not covered by commercial launch permit 110. FOLIO NO: PROPERTY ADDRESS: 750 Palm Point Dr, Goodland, FL 34140 Date of Notice of Hearing by Certified Mail: 3/14/25 Date of Property/Courthouse Posting: 3/7/25 Officer Collier requested the hearing. The Stipulation was entered into by Nathan Lapierre on April 4, 2025. Special Magistrate Neale found the Respondent was in violation of the referenced Code(s)/Ordinance(s) at the time the Notice of Violation was issued for operating a commercial vessel out of a Collier County boat ramp without proper permitting. The Commercial Permit 110 for Florida Island Tours Co. is suspended for a period of 30 days and ordered them to: 1. CASE NO: CEEX20250000784-FA214828 OWNER: David Feliciano Jr OFFICER: Tami Canger VIOLATIONS: Collier County Ordinance No. 2019-04. Excessive false alarms: Residential. FOLIO NO: PROPERTYADDRESS: 440 25th St SW, Naples, FL 34117 Officer Canger represented the County and testified the Citation was issued for a 3rd false alarm within a 180 day period. David Feliciano, Jr. testified: • He was unaware he had to register the alarm system with the County and completed the registration process. • An elderly tenant opened the window not realizing the alarm had been set. • He notified the alarm provider of the false alarm however the officer appeared at the site. Officer Canger testified the County did not receive notification from the service provider on the false alarm and the Officer was dispatched to the scene. No burglary report was filed by Mr. Feliciano. Special Magistrate Neale, after hearing the testimony UPHELD the Citation and ordered the Respondent to pay a $75.00 fine, Operational Costs of $50.00 and an Administrative Fee of $7.00 for a total amount due of $132.00 within 30 days of this hearing. 2. CASE NO: CEEX20250001415-PR066044 OWNER: Elliot Clark Rothman OFFICER: Arthur Ford VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 130, Article II, Section 130-66. Handicap parking, citation issued on January 27, 2025. FOLIO NO: PROPERTYADDRESS: Barefoot Beach Access North, Bonita Springs, FL 34134 Manager Timothy Crotts represented the County noting a plea agreement had been reached for Mr. Rothman to pay a $30.00 fine, $50.00 in Operational Costs and a $5.00 Administrative Fee to resolve the case. Elliot Rothman agreed with the settlement. April 4, 2025 11 Special Magistrate Neale ordered the Respondent to pay a $30.00 fine, $50 .00 in Operational Costs and a $5.00 Administrative Fee for a total due of $85.00 within 30 days of this hearing. 3. CASE NO: CEEX20250002031-PR066542 OWNER: Billy Gene Dodd Jr OFFICER: Mauricio Araquistain VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 130, Article II, Section 130-66. Overnight parking, citation issued on February 13, 2025. FOLIO NO: PROPERTYADDRESS: Vanderbilt Garage, 100 Vanderbilt Beach Rd, Naples, FL 34108 Manager Timothy Crotts and Officer Araquistain represented the County. Officer Araquistain testified on February 2, 2025, he was on routine patrol when he observed the vehicle parked in the garage prior to its opening at 8:00am. There are signs posted outside the facility on the hours of operation (8:00am to sunset). Evidence Entered: Exhibits 1-2: Photos dated 3/14/25 Exhibits 3-5: Photos date 2/2/25 Exhibit 6: Citation Issued 2/2/25 Billy Dodd, Jr. testified he did not park in the facility overnight. He works on a construction project across the street and entered the garage between 6:00 and 6:30am.as the gate was open. Officer Araquistain stated the gate was down however there is unrestricted access to the facility via the exit lanes. Special Magistrate Neale noted the County, based on the evidence it cannot prove the vehicle was parked in the garage overnight.
