WHEREAS, the United States Department of Housing and Urban Development (HUD) requires a one-year Annual Action Plan be developed and submitted as an application for planning and funding of Community Development Block Grant (CDBG), HOME Investment Partnerships (HOME), and Emergency Solutions Grants(ESG) Program; and WHEREAS,the Five-Year Consolidated Plan for 2021 —2025 was adopted by the Board of County Commissioners on June 21, 2021; and WHEREAS, the Board of County Commissioners approved the Annual Action Plan for Program Year 2022-2023 on June 28, 2022 by Resolution 2022-110, Annual Action Plan substantial amendment for Program Year 2022-2023 on May 28, 2024 by Resolution 2024-96, CAO Annual Action Plan substantial amendment for Program Year 2022-2023 and 2024-2025 on February 11, 2025 by Resolution 2025-34, Annual Action Plan for Program Year 2024-2025 on July 23, 2024 by Resolution 2024-138, Annual Action Plan substantial amendment for Program Year 2024-2025 on January 14, 2025 by Resolution 2025-012; and WHEREAS, the overall goal of the community planning and development programs covered by the action plan is to develop viable communities by providing decent, affordable housing, a suitable Iiving environment and expanding economic opportunities for low and moderate-income persons; and WHEREAS, in order to reprogram the HUD Community Development Blodk Grant (CDBG) funding, each entitlement must amend the Action Plan to recognize reallocation of funding within identified programs to be undertaken and respond to community needs; and NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: 1. The Board of County Commissioners of Collier County approves the amendments to the Program Year 2022-2023 and Program Year 2024-2025 Annual Action Plans and fi authorizes the Community and Human Services Division to transmit the amendments and required documents to the funding authority and take all necessary actions to implement the CDBG, HOME and ESG-RUSH programs. 2. The Annual Action Plan sets forth dollar amounts and project/activity descriptions to be funded by CDBG, HOME and ESG-RUSH grants. This letter conveys the award of$731,570 to address the needs of people who were unhoused or at risk of homelessness before the storms. As authorized by 42 U.S.C. 11364a(c)(1),the Department of Housing and Urban Development's (HUD)Office of Special Needs Assistance Programs(SNAPS)is making a special allocation of Emergency Solutions Grants(ESG) funding to Collier County(Recipient)to address the needs of homeless individuals or families or individuals or families at risk of homelessness in areas affected by a major disaster declared pursuant to the Robert T. Stafford Disaster Relief and Emergency Assistance Act(42 U.S.C. 5121 et seq.)on or after December 20, 2019. These funds shall benefit people whose needs are not otherwise served or fully met by existing Federal disaster relief programs, including the Transitional Sheltering Assistance(TSA)program under such Act(42 U.S.C. 5170b). This special allocation of"Rapid Unsheltered Survivor Housing"(RUSH) funding under the ESG Program is in response to the President's major disaster declarations dated September 28, 2024,DR-4828-FL, for Hurricane Helene,October 11, 2024, DR-4834-FL,for Hurricane Milton, and Federal Emergency Management Agency's (FEMA)determination that these disasters were severe enough to activate its TSA program. This initial allocation of$731,570 was determined using a formula that is based on 42 U.S.C. 11364a(c)(I)and that considers the number of persons experiencing sheltered or unsheltered homelessness(based on the most recent Point-in-Time count)in counties or local municipalities that are within the declared disaster areas and the Fair Market Rent for a one-bedroom apartment in those areas. "Declared disaster areas"refers to areas identified as eligible for FEMA Individual Assistance when a major disaster is declared. Subject to availability of funding,the Department may make a second allocation of RUSH funding as explained in the notice HUD published in the July 18,2024 Federal Register(RUSH Notice). This RUSH funding will be subject to the same federal requirements that apply to annual ESG funding,except as otherwise stated in the RUSH Notice or a later HUD notice,waiver,or rule. Notably,in accordance with 24 CFR 5.110 and as provided in the Department's letter notifying Recipient of its first RUSH allocation,the same waivers HUD made available in the July 1,2024 memorandum"Availability of Waivers of Community Planninand Development Grant Program and Consolidated Plan Requirements to Facilitate Recovery from Presidentially Declared Major www.hud.gov espanol.hud.gov Disasters",are made available for the same justifications and subject to the same conditions with respect to the RUSH funding allocated to the Recipient. In all other cases where ESG funds are used for renovation,the jurisdiction will maintain the building as a shelter for homeless individuals and families for a minimum of 3 years after the date the building is first occupied by a homeless individual or family after the completed renovation.
