Executive Summary
Recommendation to (1) adopt a Resolution authorizing approval of a Substantial Amendment to Collier County's U.S.
Department of Housing and Urban Development (HUD) Annual Action Plans for Program Years 2022-2023 and 2024-
2025 to: (a) reallocate HOME funds to align with project schedules and expenditures, (b) assign HOME project delivery
costs, (c) reprogram $1,000,000 of CDBG funds to Collier County Redevelopment Agency in the Bayshore Gateway
Triangle CRA to purchase two contiguous lots to develop a neighborhood passive park; (2) authorize the Chairman to
execute the approved Emergency Solutions Grant Rapid Unsheltered Survivor Housing (RUSH) SF 424 Application for
Federal Assistance, Certifications and Assurances and submit to HUD to accept a special allocation from HUD in the
amount of $731,570 for the Emergency Solutions Grant Rapid Unsheltered Survivor Housing (RUSH) program for
citizens in areas affected by Hurricane Helene or Hurricane Milton, and (3) authorize transmittal of the substantial
amendment to HUD.
OBJECTIVE: To maintain compliance with federal regulations that allow for the acceptance and use of federal U.S.
Department of Housing and Urban Development entitlement funds to advance the County’s strategic plan by fostering
comprehensive affordable housing opportunities for low- to moderate-income households of Collier County.
CONSIDERATIONS: The U.S. Department of Housing and Urban Development (HUD) provides entitlement funds to
local governments to meet program-specific community needs. Entitlement programs include Community Development
Block Grant (CDBG), HOME Investment Partnerships (HOME), and Emergency Solutions Grant (ESG).
Community and Human Services (CHS) staff have recently identified changes to various activities to better address
community needs. HUD regulations at 24 CFR Part 91.505 require amendments to Annual Action Plans whenever there
is a change in the allocation priorities or method of distributing funds presented in the plan; a change in the use of funds
to an activity not described in the Annual Action Plan; or a change in the purpose, scope, location, or beneficiaries of an
activity.
Collier County is proposing to amend Program Years (PY): 2022-2023 and 2024-2025 U.S. Department of Housing and
Urban Development (HUD) Annual Action Plans. The Board of County Commissioners approved the PY 2022-2023
Annual Action Plan on June 28, 2022 (Agenda Item #16.D.4) and PY 2024-2025 Annual Action Plan on July 23, 2024
(Agenda Item #16.D.4). The Board of County Commissioners approved substantial amendments for PY 2022-2023 on
May 28, 2024 (Agenda Item #16.D.4), for PY 2022-2023 and 2024-2025 on February 11, 2025 (Agenda Item #16.D.6),
and PY 2024-2025 on January 14, 2025 (Agenda Item #16.D.5).
A substantial amendment to an Action Plan or Consolidated Plan requires advertising and a 30-day public comment
period. The required notice was published in the Naples Daily News on February 26, 2025. The advertisement identified
a 30-day public comment period from February 27, 2025, to March 27, 2025. On March 13, 2025, a public hearing was
held to address the proposed actions, and no comments were received on this item.
To meet required HUD expenditure deadlines, a substantial amendment is necessary to reallocate HOME funds in the
PY 2022-2023 and PY 2024-2025 HUD Annual Action Plans (AAP). To reallocate these funds amongst program years,
the following changes, to include the addition of project delivery costs, are proposed to the PY2022 and PY2024 Annual
Action Plans (in all areas where the activity description is referenced).
Modify Project: Project Name: HOME: Non-CHDO Housing Development
Amend Activity: Renaissance Hall Senior Living LLLP; Subrecipient Award $1,351,340.93

The following substantial amendment changes are proposed to the PY2022-2023 Annual Action Plan (in all areas where
the activity description is referenced).
Modify Project: Project Name: HOME TBRA
Amend the CHS HOME TBRA activity as follows: Allocate $1,500 towards project delivery costs for CHS HOME
TBRA which assists individual households with rent payments, utility and/or security payments. This program will be
administered by Community and Human Services.
The following substantial amendment changes are proposed to the PY2024-2025 Annual Action Plan (in all areas where
the activity description is referenced).
Modify Project: Project Name: ESG24 Collier County Homeless Programs (ESG-RUSH)
Amend activities as follows: Expand the scope of the PY2024-2025 ESG RUSH Program and recognize the special
allocation of $731,570 to address the needs of homeless individuals or families, or individuals or families at risk of
homelessness in areas affected by major disasters, Hurricane Helene or Hurricane Milton. This program will be
administered by Community and Human Services.
This special allocation of Rapid Unsheltered Survivor Housing (RUSH) funding under the ESG Program is in response
to the President’s major disaster declarations dated September 28, 2024, DR-4828-FL, for Hurricane Helene and
October 11, 2024, DR-4834-FL, for Hurricane Milton.
Amend Project: Project Name: CDBG: Affordable Housing to CDBG: Public Facilities & Infrastructure
Modify activities as follows to reprogram funding: Remove the Renaissance Hall at Old Course, LLC
predevelopment costs activity associated with new construction of Phase 1 of affordable housing and reprogram the
$1,000,000 of PY2024 CDBG entitlement funds to Collier County Community Redevelopment Agency in the Bayshore
Gateway Triangle Community Redevelopment Area (BGTCRA) to purchase two (2) contiguous lots on Pineland
Avenue in Naples, FL to develop a neighborhood passive park to serve individuals and families of the Gateway Triangle
Community. An agreement between BGTCRA and the County will be presented to the Board at a future meeting.
Modify Project: Project Name: HOME: Non-CHDO Housing Development
Amend the CHS HOME TBRA activity as follows: Allocate an additional $5,341.00 towards project delivery costs
for CHS HOME TBRA which assists households with rent payments, utility and/or security payments. This activity
will be administered by Community and Human Services.
This item is consistent with the Collier County strategic plan objective by fostering comprehensive affordable housing
opportunities for low- to moderate-income households of Collier County.
FISCAL IMPACT: There is no new fiscal impact associated with this item. Funds have been previously appropriated
within the Housing Grant Fund (1835), Projects 33688, 33762, 33810, 33864, 33915 and HOME Grant Fund (1836)
Project 33918. A separate Board action will appropriate RUSH funding once the funding agreement is issued by HUD.
GROWTH MANAGEMENT IMPACT: Acceptance and implementation of this HUD substantial amendment furthers
the Goals, Objectives, and Policies of the Housing Element and the Growth Management Plan.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to form and
legality and requires majority vote for approval. -JAK

requirements of Titles II and III of the Uniform Relocation
Assistance and Real Property Acquisition Policies Act of
1970 (P.L. 91-646) which provide for fair and equitable
treatment of persons displaced or whose property is
acquired as a result of Federal and federally-assisted
programs. These requirements apply to all interests in real
property acquired for project purposes regardless of
Federal participation in purchases.
12.Will comply with the provisions of the Hatch Act (5 U.S.C.
§§1501-1508 and 7324-7328) which limit the political
activities of employees whose principal employment
activities are funded in whole or in part with Federal funds.

flood insurance if the total cost of insurable construction
and acquisition is $10,000 or more.

prescribed pursuant to the following: (a) institution of
environmental quality control measures under the National
Environmental Policy Act of 1969 (P.L. 91-
190) and Executive Order (EO) 11514; (b) notification
of violating facilities pursuant to EO 11738; (c)
protection of wetlands pursuant to EO 11990; (d)
evaluation of flood hazards in floodplains in accordance
with EO 11988; (e) assurance of project consistency
with the approved State management program
developed under the Coastal Zone Management Act of
1972 (16 U.S.C. §§1451 et seq.); (f) conformity of
Federal actions to State (Clean Air) implementation
Plans under Section 176(c) of the Clean Air Act of
1955, as amended (42 U.S.C. §§7401 et seq.); (g)
protection of underground sources of drinking water
under the Safe Drinking Water Act of 1974, as
amended (P.L. 93-523); and, (h) protection of
endangered species under the Endangered Species
Act of 1973, as amended (P.L. 93-205).
16.Will comply with the Wild and Scenic Rivers Act of
1968 (16 U.S.C. §§1271 et seq.) related to protecting
components or potential components of the national
wild and scenic rivers system.
17.Will assist the awarding agency in assuring compliance
with Section 106 of the National Historic Preservation
Act of 1966, as amended (16 U.S.C. §470), EO 11593
(identification and protection of historic properties), and
the Archaeological and Historic Preservation Act of
1974 (16 U.S.C. §§469a-1 et seq).
18.Will cause to be performed the required financial and
compliance audits in accordance with the Single Audit
Act Amendments of 1996 and OMB Circular No. A-133,
"Audits of States, Local Governments, and Non-Profit
