Executive Summary
Recommendation to approve final acceptance of the potable water and sewer utility facilities and accept the conveyance
of the potable water and sewer facilities for Esplanade by the Islands - Phase 3I, PL20240010530.
OBJECTIVE: To have the Board of County Commissioners, as Ex-Officio Governing Board of the Collier County
Water-Sewer District, approve final acceptance of these potable water and sewer utility facilities in accordance with the
Collier County Utility Standards and Procedures, Ordinance No. 2004-31.
CONSIDERATIONS:
1. The Developer has constructed the potable water and sewer utility facilities for Esplanade by the Islands - Phase
3I, within dedicated easements to serve this development (see attached location map). The potable water and
sewer utility facilities were offered for conveyance to the County, as described in Official Records (O.R.) Book
6437, Page (PG) 3176, and are located within County utility easements dedicated by the plat of Esplanade by
the Islands – Phase 3I, recorded in Plat Book 73, Pages 88 through 89 of the Public Records of Collier County,
Florida. The value of these potable water and sewer utility facilities (assets) was $41,072.61 and $34,537.23
respectively.
2. Staff recorded all final acceptance documents associated with the potable water and sewer utility facilities
conveyed to the County in the public records of Collier County, which were reviewed and approved by the
County Attorney’s office as to form and legality. The County acquired its interest in potable water and sewer
utility facilities through the warranty deed and bill of sales recorded in 6437, PG 3176, of the Public Records of
Collier County, Florida (“The Utilities Facilities Deeds”).
3. A final inspection to discover defects in materials and workmanship was conducted by staff on December 23,
2024, in coordination with Public Utilities, and these facilities were found to be satisfactory and acceptable.
4. Staff recommends final acceptance of the subject potable water and sewer utility facilities in the amount of
$75,609.84. Staff also recommends acceptance of the Utilities Facilities Deed and the facilities described in the
Certification of Contributory Assets, which is attached to this Executive Summary.
5. This final acceptance is in accordance with Collier County, Ordinance No. 2004-31, as amended.
6. Staff are unaware of any issues that would serve to negate the recommendation to approve this final acceptance.
This item is consistent with the Collier County strategic plan objective to operate an efficient and customer-focused
permitting process.
FISCAL IMPACT: Approval of this Executive Summary will result in the Collier County Water-Sewer District
receiving title to the potable water and sewer utility facilities, which have a gross value of $75,609.84 (no depreciation
applied) and an asset will be recorded in the financial records of the county.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a majority vote for
Board approval.–DDP

THIS INDENTURE made this 30 day of OctoBer 2024, between CURRENTS
COMMUNITY DEVELOPMENT DISTRICT, a community development district established and existing
pursuant to Chapter 190, Florida Statutes, whose address is c/o JP Ward & Associates, LLC, 2301 Northeast
37th Street, Fort Lauderdale, FL 33308 (hereinafter referred to as "Grantor"), and BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, AS THE GOVERNING BODY OF
COLLIER COUNTY, AND AS THE EX-OFFICIO GOVERNING BOARD OF THE COLLIER
COUNTY WATER-SEWER DISTRICT, its successors and/or assigns, whose address is 3299 Tamiami
Trail East, 3rd Floor, Naples. FL 34112, its successors and/or assigns (hereinafter referred to as "Grantee").
WITNESSETH:
That said Grantor, for and in consideration of the sum of Ten Dollars ($10.00) and other good and
valuable consideration to said Grantor in hand paid by said Grantee, the receipt whereof is hereby
acknowledged, has granted, bargained and sold to the said Grantee, and Grantee's heirs, successors and
assigns forever, all potable water and wastewater utility facilities and/or system(s) or portion(s) thereof
lying in, on, over and under the following described land, for operation, relocation, installation, repair
and/or maintenance of said facilities, system(s) or portion(s) thereof, all situate and lying and being in
Collier County, Florida, to wit:

which depicts the physical location of the utility systems being conveyed.)
and said Grantor does hereby fully warrant the title to said utility facilities and/or system(s) or portion(s)
thereof, be they realty, personalty, or mixed, and Grantor will defend such title against all claims of all
persons whomsoever. For the purposes of this conveyance, the utility facilities, system(s) and/or portion(s)
thereof conveyed herein shall not be deemed to convey any of the lands described in either exhibit. Grantor
and Grantee are used for singular or plural, as context allows. A sketch or other graphic representation
showing the location of the utility facilities, etc., being conveyed is attached as Exhibit B.

upon said land, excavate, relocate and/or take or introduce materials for the purpose of constructing,
