Executive Summary
Recommendation to ratify administratively approved Change Order No. 3 for contract No. 24-8292 with Earth Tech
Enterprises, Inc., for the Park Shore Beach Renourishment, increasing the contract amount by $7,000; authorize the
Chairman to execute the Change Order; and make a finding that this item promotes tourism (Project 90067).
OBJECTIVE: To compensate the contractor for work performed under construction contract 24-8292 for the 2024
truck haul beach renourishment project at Park Shore, increasing the contract amount by $7,000.
CONSIDERATIONS: On December 10, 2024, (Item 16.B.14), the Board of County Commissioners (the “Board”)
approved contract 24-8292 Park Shore Beach Renourishment, with Earth Tech Enterprises, Inc., in the amount of
$3,817,530.
Shortly after the project started, the Sea House Condominium contacted staff and advised that they would not agree to a
standard Temporary Beach Restoration Easement and required a Beach Access License Agreement before allowing the
County to proceed with renourishment on their property. As the contractor advanced beach fill activities, staff directed
the contractor to forego filling at Sea House until an agreement was reached. A Beach Access License Agreement was
agreed to on February 7, 2025. At that time the contractor had advanced the beach fill operation well to the south of Sea
House Condominium. It is important to the County’s design that all properties in Park Shore are filled to the design
template to ensure sustainability of design and protection of upland properties. Completion of this design serves a public
purpose.
On February 19, 2025, staff issued a written Work Directive to the contractor to fill the beach at Sea House
Condominium. Since hauling northward will damage the newly constructed beach, the contractor needs to re-work the
damaged beach by re-blading the previously completed section.
Filling the beach at the Sea House parcel is important so that the new beach berm is a continuous elevation providing
protection to upland properties without a gap in the berm.
A summary of the changes identified in the Work Directive is shown below:
• Return operations to beach at Sea House parcel approximately R-45+700 to fill per design template.
• Re-blade completed beach to remove ruts from hauling activities between Sea House and Horizon Way.
The County's Procurement Service Division administratively approved Change Order No. 3, as authorized under the
Procurement Ordinance, Section Nineteen, Contract Administration, Section 19, subsection 3.b.
ADVISORY COMMITTEE RECOMMENDATIONS: This item was approved by the Coastal Advisory Committee
(CAC) on March 13, 2025 and the Tourist Development Council (TDC) on March 18, 2025.
This item is consistent with the Quality of Place Objectives of the County’s Strategic Plan.
FISCAL IMPACT: Change Order #3 increases the overall contract by $7,000. The additional funding is available
within the TDC Beach Renourishment Fund (1105), Project 90067. The source of funding is Tourist Development Tax.
FDEP cost-share funding will be requested if eligible at a future date to reimburse Collier County for a portion of the
completed work.
GROWTH MANAGEMENT IMPACT: This item is consistent with the Conservation and Coastal Management
Element of the Growth Management Plan.
