HALDEMAN CREEK MSTU MINUTES OF THE DECEMBER 19, 2024 MEETING
The meeting of the Haldeman Creek MSTU Advisory Committee was called to order by Roy Wilson
at 3:30 p.m. at 4870 Bayshore Drive, Botanical Garden FGCU/Buehler Auditorium, Naples, Florida
34112

a. Mangrove Row Development- Brandon Cooper, Davidson Engineering (Attachment)
Mr. Copper presented the PowerPoint “Mangrove Row Multi Family Development – Haldeman
Creek MSTU December 19, 2024” noting:
The Mangrove Row development is proposed on Arbutus Street, west of Bayshore Drive.
The parcel is vacant but was previously the site of residential development with the
structures removed back in the 2002 – 2004 timeframe.
The property is bounded by multifamily development on the north and east sides and single
family on the south and west (across the canal).
The developer proposes to construct 8 units on the parcel, 6 allowed under the base zoning
and 2 additional units per the limited density bonus pool.
The site abuts a canal with access to Haldeman Creek and the project includes a proposal
for 8 boat docks.
To provide for the dock area, a seawall will be constructed 15 feet into the property and
extend 12.5 feet into the canal for a total length of 27.5 feet.
The docks are designed in accordance with County Codes allowing a dock extending into
the canal 25 percent of the width of the waterway.
Landscape buffers are proposed on all sides of the property.
During Committee discussion, the following was noted:
The maximum length of boat allowed at the dock is 27.5 feet.
The grade level on site is 4 feet, the seawall is proposed at 5 feet, garages at 8 feet and first
floor at 10 feet.
There is an extensive drainage system planned for the site and the units will have
generators and hurricane impact windows and doors.
Construction is anticipated to initiate in 3 months.
b. Bathymetric Survey Scope of Work, Matthew Goddard, Humiston & Moore (Attachment)
Ms. Scott and Mr. Dunnock reported:
Proposals were obtained through Humiston & Moore Engineers for a bathymetric survey of
the MSTU waterways as follows:
Sea Diversified $24,900 lump sum dated October 11, 2024 for the data collection.
Humiston & Moore Engineers $17,224 Time and Materials dated December 4, 2024
for the data review and reporting.
Diversified Sea was recommended by Mr. Goddard after obtaining 3 proposals for the
work and being deemed the lowest qualified bidder.
The scope of work includes determining the changes since the 2019 dredging project
undertaken in the waterways.
Mr. Goddard noted the original dredging of the areas occurred in 2007 and the data from that
activity will be used as a baseline in determining and work which may want to be considered.
During Committee discussion, it was noted:
The survey data will determine existing widths and depths of the channels, however
identifying specific debris or rock formations will be difficult until the time any dredging
occurs.
Mr. Wilson will provide the consultant with any data available from reports by boaters of
shallow spots or areas of concern.
The goal is for the Committee to obtain a user friendly, layman style report of the data.
It would be beneficial to approve an expenditure for a “not to exceed” amount for the work
given the proposals are still being finalized.
Robert Wopperer moved to authorize an expenditure not to exceed $45,000.00 for the work required
to complete the bathymetric survey and associated report. Second by Jacob Dutry Van Haeften.
Approved unanimously.
Mr. Moore noted they are still working on obtaining the necessary permit updates for any dredging
activity proposed.
6. Old Business:
a. Draft Ordinance Vegetation Removal (Attachment)
Ms. Garcia provided the update noting:
Investigation is underway to update the County codes to require vegetation maintenance by
owners along their shoreline property.
The concept at this point is to incorporate any requirements into the existing ordinance
regulating litter, weeds and exotics on private property.
One concern is ensuring the owners are aware of any requirements for mangrove tree
trimming to prevent unintended violations of standards regulating the species.
b. Emergency Debris Removal Contract
Mr. Wilson reported:
Consideration should be given to allowing an expenditure of $3,000 or less for emergency
removal of debris in the waterway.
Coastal Zone Management will respond to requests, however there are delays due to their
workload and by the time a response occurs, the item may have moved or disappeared.
It would be beneficial to have an immediate response to an issue to help ensure the
waterway remains a safe place to navigate.
The Committee, Staff and those present discussed the recommendation noting it would be
advantageous to have the ability to immediately address debris issues in the waterway.
Roy Wilson, Chairman moved to authorize up to $3,000.00 of funds for emergency debris
removal when the need arises. Second by Jacob Dutry Van Haeften. Approved unanimously.
7. New Business:

The Committee reported the next meeting will be held on Monday, March 10, 2025.

9. Public Comments (this Item was heard after Item 4, Approval of Minutes)
A member of the public recommended consideration be given to maintenance dredging east of
Bayshore Drive, an area included in the MSTU.
Krista Orick of Naples Boatyard noted the business is willing to assist in dredging activities or
clearing debris in the MSTU waterways. They have barges in service which are in and out of the area
on a regular basis and all the operations associated with the business are registered with the County, (if
required).

Dear Mr. Goddard:
In accordance with your request, Sea Diversified, Inc. (SDI) is pleased to submit the following updated proposal for
professional services pertaining to the referenced project. The scope of work shall include a single-beam bathymetric survey
within Haldeman Creek, located in Naples, Florida. The survey area shall encompass cross-sections along the defined
centerline, as depicted on “Attachment A” herein, encompassing approximately 540 cross-sections. A summary of the scope
and fee estimates shall include:
General:
SDI shall provide supervision, field / office support staff and equipment to perform the scope of work described, herewith.
All work shall be conducted to the highest level of industry standards and under the responsible charge of a Professional
Surveyor and Mapper registered in the State of Florida. All work shall meet or exceed the Standards of Practice (Standards)
set forth by the Florida Board of Professional Surveyors and Mappers in Chapter 5J-17, Florida Administrative Code, pursuant
to Section 472.027, Florida Statutes. If time permits, deviations from the scope of work shall be addressed via formal approved
addendum to the executed Agreement for Professional Services.
Horizontal and Vertical Data:
Horizontal Datum: Feet, relative to the Florida State Plane Coordinate System, East Zone, North American Datum of
1983 (NAD83)
Vertical Datum: Feet, relative to the North American Vertical Datum of 1988 (NAVD88)
Bathymetric Data Collection:
The bathymetric surveys shall be conducted using an automated hydrographic system comprised of a survey launch equipped
with a marine grade, single-beam sounder, differential global positioning system and computer-based navigation / data
collection system. A differential GPS system shall be used for vessel positioning and navigation. The survey-grade sounder
will include a 200-kHz narrow beam (3˚) transducer. This system, when calibrated to manufacturer’s specifications, will yield
accuracies of 1 cm plus 0.10% of the water depth when corrected for sound velocity. The sounder shall be calibrated via bar
checks at the beginning of each survey day.
Data shall be collected along pre-defined transects oriented perpendicular to the defined centerline, at maximum intervals of
fifty (50) feet. Hydrographic (bathymetric) data of shall be acquired as close to seawalls, docks, or vegetation as practical and
within the safe operating limits of the automated hydrographic vessel and crew. An automated pressure gauge will be set to
record water levels at no greater than five minute intervals during course of data collection activities. The gauge will be set
relative to published vertical control in proximity to the project.
Data Processing and Final Deliverables
Upon completion of field survey activities, data will be edited and reduced to the project datum and translated to an x,y,z,
ASCII format for submittal to Humiston & Moore (H&M). H&M will be provided the following deliverables:

Agency, we are pleased to provide this Scope of Work for Professional Services to assist the
Haldeman Creek MSTU and Collier County Stormwater Department with the proposed monitoring
of the engineered channel within Haldeman Creek.
Task 1 will provide an analysis of survey data and volumes of potential dredging areas. This will allow
for discussions to move forward if dredging is required. The analysis will be provided as a draft for
stakeholders’ consideration of cost and time

a)An updated bathymetric survey following the survey scope of the 2006/2007 dredging and
2019 survey scope. This will allow H&M to compare all three profiles and provide volume
computation and gain a better understanding of infilling rates. The survey will be performed
by SDI in an accurate and timely manner, which was the previous surveyor of the 2019
analysis. Their proposal is attached for reference.
Sub‐consultant Fee: $24,850
b)H&M will process survey data and prepare cross sections. A report will be prepared
calculating the volume above the dredge template. With the additional data, a historical
infilling rate can begin to be established.
c)Attend three MTSU meetings. One as a kick‐off meeting to gain the understanding of the
members, a second as an update meeting, and third as final results.

Standard General Conditions
January 1, 2025
The purpose of these standard General Conditions is to govern all services performed by Humiston &
Moore Engineers.
Proposals are valid for 30‐days. If a signed agreement is not received within 30‐days of proposal date,
Humiston & Moore has the option to update the proposal based on current fees, terms and
conditions.
Payment for Services
For services rendered, Humiston & Moore Engineers (ENGINEER) will bill Client (OWNER) periodically,
on a time and materials basis, or on a lump sum basis as agreed in the Work Order or proposal.
Payment of bills is due within thirty days of the invoice date. If the OWNER fails to make any payment
due for services and expenses within thirty days, the amounts due may include a late charge at the
rate of 1.5% per month beginning on the thirtieth day after the date of the invoice, and in addition,
after giving seven days written notice services under this agreement may be suspended until such
time as full payment is made for amounts due. ENGINEER shall be entitled to collect reasonable fees
and costs, including attorneys’ fees and interest, should it be required to obtain collection of any
amount due under this agreement by court action or settlement without court action.
Projects which require a retainer, the retainer will be deposited and applied to the final billing. Upon
completion of the approved services, the retainer will be applied to the final charges, if the retainer is
in excess of the final balance due on the account, the balance will be refunded, should the retainer be
less than the account balance, the retainer will be applied and a final invoice will be issued, payment
due upon receipt.
Additional Services, Reimbursable Expenses, and Application Fees
Additional Services not specifically included in the description of Basic Services will be provided at the
cost of time and materials. Additional services may include any other services requested by OWNER,
such as design and plan modifications, responding to requests of regulatory agencies, attendance at
meetings and hearings, making presentations and time spent preparing for same.
Reimbursable expenses associated with travel, copies, postage, application fees, laboratory testing
fees, etc., will be billed at cost, mileage which will be billed at the prevailing government rate.
Application fees and impact fees, etc., are the responsibility of OWNER; if paid by ENGINEER such fees
will be reimbursable by the OWNER. Unless otherwise stated, the Proposal for Professional Services
does not include any reimbursable expenses.

Project Delays
The OWNER recognizes and agrees that various factors can delay the performance of the work, the
issuance of permits and licenses. The OWNER agrees that it shall not be entitled to any claim for
damages on account of hindrances or delays from any cause whatsoever including but not limited to:
the production of contract documents; issuance of permits from any agency; beginning or completion
of construction; or performance of any phase of work pursuant to this Agreement.
Limitation of Liability
OWNER and ENGINEER agree that because of the risks, rewards and benefits of the project relative to
the design professional's total fee for services, that the risks have been allocated such that, to the
fullest extent permitted by law, ENGINEER's total liability to OWNER for any and all claims, for
economic losses, expenses or damages arising out of this agreement from any cause or causes, shall
not exceed the total amount of $10,000 or the amount of the fee for Professional Services charged for
the specific services described, whichever is greater.
Owner’s Responsibility
Upon request by the Engineers, OWNER will provide ENGINEER with any criteria and information
concerning the Owner’s requirements for the project, as well as all existing site surveys and other site
information.
Document Reuse
All documents prepared or furnished by ENGINEER pursuant to this Agreement are instruments of
service in respect to the project and ENGINEER shall retain an ownership and property interest therein
whether or not the project is completed. Any reuse without written verification or adaptation by
ENGINEER will be at Owner’s sole risk, and OWNER shall indemnify and hold harmless ENGINEER from
all claims, damages, losses and expenses including attorneys' fees resulting there from.
File Retention and Destruction
Generally at the conclusion of each project, H&M will retain electronic copies of documents for a
period of three years after we close the file. At the expiration of the three‐year period, the file may be
destroyed unless we are notified by you to the contrary.

Mr. Dunnuck is getting clarification on the width and distance of what is considered
navigable waterway from the property line to be considered intrusion into the navigable
waters.
