Executive Summary
Recommendation to approve and authorize the Chairman to sign a Supplemental Agreement to the Local Agency
Program (LAP) Agreement with the Florida Department of Transportation (FDOT) to increase grant funds from
$2,383,352 to $3,023,352 ($640,000 increase) for the construction of a ten-foot multi-use path on County Barn Road
from Rattlesnake Hammock Road to SR 84 (Davis Blvd.); to execute the accompanying Resolution; and to authorize the
necessary Budget Amendments, FPN 438091-2-58-01. (Fund 1841, Project 60254)
OBJECTIVE: To construct a 10-foot-wide multi-use path on County Barn Road from Rattlesnake Hammock Road to
SR 84 (Davis Blvd).
CONSIDERATIONS: Construction funding for the Project was programmed in the 2020 Florida Department of
Transportation (FDOT) Work Program for FY 2023 in the amount of $1,693,376. The Board approved the construction
Local Agency Program (LAP) agreement with FDOT on May 23, 2023, Resolution No. 2023-92. Since the submittal of
the application, construction costs have continued to rise. At the November 14, 2023, Board of County Commissioners
(the "Board") meeting, the Board approved a Supplemental Agreement (No. 1) to increase the reimbursement to
$2,508,376.
Construction Engineering Inspection (CEI) is a requirement for LAP Projects. A contract was negotiated with an FDOT
vendor for $310,024. FDOT had $185,000 available and needed $125,024 to fully fund the CEI phase. Collier County
requested that in lieu of a Locally Funded Agreement, the construction funding be reduced, and those funds be shifted to
the CEI phase. At the June 11, 2024, Board meeting, the Board approved a Supplemental Agreement (No. 2) to decrease
the reimbursement to $2,383,352.
After receiving the construction bid, additional funds were needed and staff was able to obtain $640,000 from the
Collier County MPO. This current Supplemental Agreement (No. 3) adds these funds to the construction phase of the
Project.
FDOT is empowered by legislative authority to contract with other governmental (local) agencies to develop, design,
and construct transportation facilities and to reimburse these governmental agencies for services provided to the
traveling public. The FDOT LAP, administered at the FDOT district level, is the mechanism used to complete a
prioritized project from FDOT’s Five-Year Work Program. Collier County is LAP certified, and the Transportation
Management Services Department staff will be responsible for the administration of the project’s construction phase. In-
house staff and third-party vendors will be responsible for federal and FDOT grant compliance.
This item is consistent with the Collier County Strategic Plan objective to design and maintain an effective
transportation system to reduce traffic congestion and improve the mobility of our residents and visitors.
FISCAL IMPACT: A budget amendment is required to recognize additional grant revenue in the amount of $640,000
in Transportation Grant Fund (1841), County Barn Rd Project (60254) for Construction; the funding source is Federal
Highway Administration for a total of $3,023,352 whereby, these grant dollars are passed through FDOT via the LAP
Agreement. This grant does not require a match.
GROWTH MANAGEMENT IMPACT: These improvements are consistent with the Growth Management Plan
Transportation Element, specifically Section B - Intermodal & Multi-modal Transportation, (1) Non-Motorized Travel,
Objective 4, Policy 4.2, Policy 4.4, Policy 4.5, Policy 4.6, and Policy 4.8
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote for Board
approval. -DDP

The project consists of the construction of a 10-foot-wide multi-use path on the west side of County Barn Road from
Rattlesnake Hammock to SR 84 (Davis Blvd). Replacement of existing storm drain culvert, ditch bottom inlets, and
mitered end sections willbe installed to accommodate the 10-foot-wide multi-use path.
Reason for Supplement and suppoding engineering and/or cost analysis:
The purpose of this SupplementalAgreement #3 is to add construction funding in Fiscal Year 25 funds in the amount of
$640,000.00 (Six Hundred Forty Thousand Dollars). The new adjusted construction funding is $3,023,352.00 (Three
Million Twenty Three Thousand Three Hundred Fifty-Two Dollars) as shown in the attached Exhibit "B" adjusted
"SCHEDULE OF FINANCIAL ASSISTANCE'.

A RESOLUTION BY THE BOARD OF COUNTY COMMISSIONERS,
COLLIER COUNTY, FLORIDA, APPROVING AND AUTHORIZING ITS
CHAIRMAN TO EXECUTE A LOCAL AGENCY PROGRAM
SUPPLEMENTAL AGREEMENT WITH THE STATE OF FLORIDA

WHEREAS, on May 23, 2023, the Board approved a Local Agency Program (LAP)
Agreement (the "Agreement") with the State of Florida Department of Transportation (FDOT),
entered into and executed on August 29,2023, wherein FDOT will reimburse Collier County up
to the sum of to $1,693,376 to construct a ten-foot multi-use path on County Bam Road from
Rattlesnake Hammock Road to SR 84 (Davis Blvd.). (FPN 438091-2-58-01); and
WHEREAS, on November 17, 2023, the Board approved a Supplemental Agreement to
increase the reimbursement to $2,508,376; and
WHEREAS, on June 11,2024, the Board approved a Supplemental Agreement to decrease
the reimbursement to $2,383,352 to shift funds to the required Construction, Inspection, and
Engineering (CEI) phase; and
WHEREAS, FDOT is willing to supplement the Agreement to increase the reimbursement
to $3,023,3 52; and
WHEREAS, the Collier County Board of Commissioners finds that the Agreement is in
the public interest and benefits the citizens of Collier County.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COTINTY
COMMISSIONERS OF COLLIER COLTNTY, FLORIDA, thAt:
1. The Board of County Commissioners approves and authorizes its Chairman to sign the
Supplemental Agreement pertaining to FPN 438091-2-58-01 (Contract No. G2N19).
2. The Collier County Clerk is directed to forward a certified copy of this Resolution along
with the Supplemental Agreement for execution by FDOT.
3. This Resolution shall take effect immediately upon adoption.
THIS RESOLUTION ADOPTED after motion, second, and majority vote favoring
