Resolution 2025-046 Ce w J J 0 F- a RESOLUTION NO. 2025- 4 6 � U o a a A RESOLUTION OF THE BOARD OF COUNTY N CC COMMISSIONERS OF COLLIER COUNTY, FLORIDA, TO 0^ o o DISCLAIM, RENOUNCE AND VACATE THE COUNTY AND THE " PUBLIC INTEREST IN THE CONSERVATION EASEMENT AS N � � ° RECORDED IN OFFICIAL RECORD BOOK 4296, PAGES 1735 (NI cx THROUGH 1741, OF THE PUBLIC RECORDS OF COLLIER NU � M= Z • COUNTY, FLORIDA, LOCATED APPROXIMATELY 400-FEET EAST OF INDUSTRIAL BOULEVARD, SOUTH OF Gwu- otS cc ° w M MERCANTILE AVENUE, IN SECTION 36, TOWNSHIP 49 Y °° SOUTH, RANGE 25 EAST, COLLIER COUNTY, FLORIDA. cowz cc S cc (PL20200001169) WHEREAS, pursuant to Resolution 2021-243, Petitioner, Chris Lascano, of Phoenix Associates of FL, Inc., on behalf of the property owner, has requested the vacation of the County and the Public interest in the Conservation Easement as recorded in Official Record Book 4296, Pages 1735 through 1741 of the Public Records of Collier County, Florida, in Section 36, Township 49 South, Range 25 East, Collier County, Florida, being more specifically shown in Exhibit"A", attached hereto; and WHEREAS, on October 22, 2013, Agenda Item 11.C, the Board of County Commissioners ("Board") approved a prioritized list of Land Development Code (LDC) amendments, including revising the LDC "to be consistent with EAR-based changes to the Conservation and Coastal Management Element (CCME) of the Growth Management Plan"; and WHEREAS, County staff subsequently worked with stakeholder groups, community members, and advisory boards to develop and publicly vet the proposed amendments (including the Development Services Advisory Committee and Planning Commission), and on July 8, 2014, Agenda Item 9.A, the Board adopted Ordinance No. 14-33, implementing the 2013 prioritized list of LDC Amendments; and WHEREAS, this LDC amendment added an exemption to the native vegetation requirement imposed by the table in LDC section 3.05.07.B.1, exempting industrial zoned parcels having a native vegetation retention requirement of 2 acres or less; and WHEREAS, prior to this amendment, such industrial zoned parcels were required to have onsite vegetation and others to have separately recorded conservation easements as part of their Site Development Plan (SDP). While such preserves established by an SDP may be removed today by revising the SDP, those preserves placed into conservation via easement (including the subject Conservation Easement) may currently only be vacated pursuant to Resolution No. 2021-243; and WHEREAS, the Board of County Commissioners, on this day, held a public hearing to consider the petitioner's request and notice of said public hearing was given as required by law; and [20-EIS-04277/1902913/1] Page 1 of 2 CAO WHEREAS, the Board finds that no public detriment is caused by the granting of the petitioner's request. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County and Public interest in the Conservation Easement as recorded in Official Record Book 4296, Pages 1735 through 1741, of the Public Records of Collier County, Florida, in Section 36, Township 49 South, Range 25 East, Collier County, Florida, being more specifically shown in Exhibit "A", is hereby vacated, extinguished, renounced and disclaimed, and this action is declared to be in the public interest and for the public benefit. BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Board is hereby directed to record a certified copy of the Resolution in the Public Records of Collier County, Florida.
