GEOGRAPHIC LOCATION:
The subject property is located on a 0.24 +/— acre property at 8967 Lely Island Cir., in Section
34, Township 50 South, Range 26 East, Collier County, Florida. (See the location map on page
2.)
PURPOSE/DESCRIPTION OF PROJECT:
The petition requests a reduction from the northern and southern side yard setbacks and the rear
yard accessory setback for an existing screen enclosure that encroaches into the required 10-foot
setbacks. The subject property is in the Lely, A Resort Community Planned Unit Development
PUD.

GROWTH MANAGEMENT PLAN (GMP) CONSISTENCY:
The subject property is in the Urban Residential Subdistrict on the County's Future Land Use
Map (FLUM) of the Growth Management Plan GMP's Future Land Use Element (FLUE). The
GMP does not address individual variance requests but deals with the larger issue of the actual
use. As noted, the petitioner requests reductions from the required 10-foot side and rear setbacks
for an existing encroaching screen enclosure. The subject use is consistent with the FLUM of the
GMP. The requested Variance does not impact this property's consistency with the County's
GMP.
STAFF ANALYSIS:
The subject property is located within the Lely, A Resort Community PUD. Per Section 3.07,
Table II A, of the Lely, A Resort Community PUD document, single-family detached dwelling
units shall have a 10-foot side yard setback and a 10-foot rear yard setback for accessories.
The contractor, KDG Landscape Architecture, Inc. (dba) Knaak Design Group were issued a
building permit for a pool screen enclosure, Permit# PRAS20220734712, on behalf of the
owners, Debra and Michael Feaser, on 11-29-22. On July 19, 2023, a spot survey via
Permit#PRAS20220734712 found that the pool screen enclosure encroached into the minimum
10-foot required side and rear yard setbacks. Per the property survey by Miguel Espinosa, dated
10-3-2024, the pool screen enclosure structure encroaches 5.3 feet into the north side yard
setback (leaving 4.7 feet between the screen enclosure structure and the property line), .15 feet
into the south side yard setback (leaving 9.85 feet between the screen enclosure structure and the
property line), and .35 feet into the rear yard setback for accessory structures (leaving 9.65 feet
between the screen enclosure structure and the property line). (See Attachment A — Boundary
Survey, dated 10-3-24) As such, an after -the -fact variance is being requested for the single-
family detached dwelling unit on the north side from 10 feet to 4.7 feet, and on the south side
from 10 feet to 9.85 feet, and from the Rear Yard Setback Accessory, from 10 feet to 9.65 feet
for the screen enclosure.
The pool screen enclosure was determined to be constructed within the required 10-foot side and
rear setbacks. Staff discussed that the property owner must move the screen enclosure out of the
setbacks or apply for an after -the -fact variance. Because demolishing and reconstructing the pool
screen enclosure out of the setbacks would cause a financial burden on the property owner, it
was decided that applying for the after -the -fact variance would be the better option. On
November 7, 2023, the contractor submitted an after -the -fact variance application of the pool
screen enclosure on the north side from 10 feet to 4.7 feet, on the south side from 10 feet to 9.85
feet, and from the Rear Yard Setback Accessory, from 10 feet to 9.65 feet for the screen
enclosure.
There have been no other variances granted within this neighborhood. This pool screen enclosure
encroachment has existed for the past two years. To date, no known complaints have been
received from any neighboring properties. It should be noted that the property owner has
received letters of no objection from their neighbors. (See Attachment B — Letters of No
Objection) It should be noted that on February 10, 2025, staff received a phone complaint from a

non -adjacent member of the community that objected to the variance of the contractor not
following the approved building permit and constructed the pool screen enclosure illegally into
the setbacks, therefore, is of the opinion there is no basis for granting the variance.
The decision to grant a variance is based on the criteria in LDC Section 9.04.03.A—H (in bold
font below). The staff has analyzed this petition relative to these provisions and offers the
following responses:
a. Are there special conditions and circumstances existing which are peculiar to the
location, size, and characteristics of the land, structure, or building involved?
Yes, the irregular pie shape of the lot did not result in any action from the applicant.
b. Are there special conditions and circumstances, which do not result from the action
of the applicant such as pre-existing conditions relative to the property, which are the
subject of the Variance request?
No, this variance request does not address special conditions and circumstances that do not
result from the applicant's action, such as pre-existing conditions relative to the property.
C. Will a literal interpretation of the provisions of this zoning code work unnecessary
and undue hardship on the applicant or create practical difficulties for the applicant?
Yes, it is possible that the existing pool screen enclosure would have to be demolished and
reconstructed out of the 10-foot side and rear yard setbacks if a literal interpretation of the
zoning code were applied.
d. Will the Variance, if granted, be the minimum variance that will make possible the
reasonable use of the land, building or structure and promote health, safety and
welfare standards?
Yes, The Variance proposed would be the minimum Variance to allow reasonable use of
the existing pool screen enclosure. The pool screen enclosure has existed within the
required 10-foot side and rear yard setbacks for two years without complaint or issue.
Approval of the Variance would not negatively impact standards of health, safety, and
welfare.
e. Will granting the Variance confer on the applicant any special privilege denied by
these zoning regulations to other lands, buildings, or structures in the same zoning
district?
Yes, a Variance bestows some dimensional relief from the zoning regulations specific to a
site. However, LDC Section 9.04.02 provides relief through the Variance process for any
dimensional development standard, such as the requested reduced side and rear yard
setbacks. As such, other properties facing similar hardships would be entitled to make
similar requests and be conferred equal consideration on a case -by -case basis.

f. Will granting the Variance be in harmony with the general intent and purpose of this
Land Development Code, and not be injurious to the neighborhood, or otherwise
detrimental to the public welfare?
Yes, as previously stated, the existing pool screen enclosure has been encroaching for the
past two years. The neighbors have not complained about the enclosure. As such, the
granting of the variance will be in harmony with the general intent and purpose of the Land
Development Code and will not harm public safety, health, and welfare.
g. Are there natural conditions or physically induced conditions that ameliorate the
goals and objectives of the regulation, such as natural preserves, lakes, golf courses,
etc.?
There are no natural conditions or physically induced conditions, such as natural preserves,
lakes, golf courses, etc. that ameliorate the goals and objectives of the regulation.
h. Will granting the Variance be consistent with the GMP?
Approval of this variance will not affect or change the requirements of the Growth
Management Plan.
RECOMMENDATION:
Staff recommends that the Collier County Hearing Examiner (HEX) approve Petition VA-
PL20230015856, Feaser Screen & Pool from Ord. No. 92-15, Section 3.07, Table II A, Side
Yard Setbacks for a single-family detached dwelling unit on the north side from 10 feet to 4.7
feet, and on the south side from 10 feet to 9.85 feet, and from the Rear Yard Setback Accessory,
from 10 feet to 9.65 feet for the screen enclosure.

Please allow this letter to serve as a description of the project narrative for the address
listed above. The home in question was built in 1998 and the current owners
purchased the property on May 23, 2022. Knaak Design Group completed
construction of the pool, pergola and screen cage in 2023.
Based on Zoning review correction comments 1 and 2 by Timothy Finn, the boundary
survey has been updated. The revised survey shows the three variances we are
requesting. The variances are from Ordinance No. 92-15, Section 3.07, Table II A. On
the North side yard the required setback is 10' and the variance proposed is 4.7'. On
the South side yard the setback required is 10' and the variance proposed is 9.85'. On
the rear yard accessory the setback required is 10' and the variance proposed is 9.65'.
The variances are requested because the screen cage construction which took place
in 2023 was over the required setbacks. As general contractor, Knaak Design Group
was unaware of the required setbacks.
3. Pursuant to LDC section 9.04.00, staff shall be guided in their recommendation to
the Hearing Examiner, and the Hearing Examiner shall be guided in the determination
to approve or deny a variance petition by the criteria (a-h) listed below. Please address
the following criteria:
