Executive Summary
Recommendation to approve a Fourth Amendment to Radio Tower Lease Agreement 787-B with Crown Castle GT
Company, LLC, authorizing the County to install a larger propane tank required for the operation of the County's public
safety radio system, and increasing monthly rent by $320 for the additional space.
OBJECTIVE: To capture additional equipment and a rent increase for additional space needed in a Radio Tower Lease
Agreement related to the public safety radio system for emergency communications on behalf of the Emergency
Management Division of the Public Safety Department.
CONSIDERATIONS: Since 1995, Collier County has utilized space on a communications tower owned by Crown
Castle GT Company LLC (Landlord), located at 15571 Tamiami Trail East, for the public safety radio system for
emergency communications.
The attached Fourth Amendment to Radio Tower Lease Agreement 787-B authorizes the County to replace the existing
county -owned 500-gallon propane tank with a larger, county -owned 1000-gallon tank, at the site. With this additional
equipment the monthly rent has been increased by $320, which results in a new monthly rental payment of $1,020 as of
March 1, 2025. This date is based on the owner reserving ground space pending approval of this lease amendment. With
Board approval the County will proceed with installation of equipment.
The additional equipment placed on the Krehling tower will provide additional run time for the fixed -mounted propane
generator at the site, in case of prolonged loss of commercial power at the location, such as after a major weather event.
This item is consistent with the Collier County strategic plan objective to prepare for the impacts of natural disasters on
our critical infrastructure and natural resources
FISCAL IMPACT: The monthly rent of $1,020 will be paid from the 800MHz Inter -Governmental Communications
Program account number 1060000000-140480-644600. These costs were factored into the FY25 budget for fund
106000000.
GROWTH MANAGEMENT IMPACT: There are no Growth Management Impacts associated with this action.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires a majority vote for Board
approval. - SAA
RECOMMENDATIONS: That the Board approves the Fourth Amendment to Radio Tower Lease Agreement with
Crown Castle GC Company, LLC, and authorizes the Chairperson to execute the Amendment.

FOURTH AMENDMENT TO RADIO TOWER LEASE AGREEMENT
This Fourth Amendmentto Radio Tower Lease Agreement ("Amendment') is made and entercd
into as of by and between Crown Castle GT Company LLC, a Delaware limited
liability company ("Crown") and Board of County Commissioners, Collier County, Florida. a political
subdivision of the State of Florida ("Customer").
WHI,REAS, Crown (and/or certain of its predecessors-in-interest) and Customer (and/or cerain
of its predecesors-in-interest) entered into a certain Radio Tower LeaseAgeement dated April I 8, 1995,
as may have been previously amended and/or assigned (hereinafter the "TLA"). whereby Cusomer le ases
or licenses from Crown certain space at a telecommun ications facility described in the TLA (he "Site");
and
WHEREAS, Crown and Customer desire to amend the TLA pursuant to the terms and subject to
the conditions set forth herein.
NOW, THEREFORE, for good and valuable consideration. the receipt and sufficiency of which
are hereby acknowledged, the parties hereto agree to be legally bound to this Amendment as follows:
L Unless clear from the context in which they are used, all capitalized terms used herein shall have
the same meanings ascribed to them in the TLA.
3. The parties acknowledge that Customer is making certain modifications to its space and/or
equipment at the Site as described in Attachment A, attached hereto.
4. The descriptions of Customer's spaceon the ground set forth in the TLA (including, without
limitation, any descriptions of Customer's space on the ground set forth in any schedules exhibis or
anachments to the TLA) are hereby amended and deleted in their entirety and replaced and superseded by
and with the descriptions of Customer's space on the ground set forth in Attachment A and Attachment B,
attached hereto.
5. The equ ipment descriptions and specifications u,ith respect to Customer'sg'ound-based equipment
set forth in the TLA (including, without limitation, any equipment descriptions and specifications with
respect to Customer's ground-based equipment set forth in any schedules, exhibits or attachments to the
TLA) are hereby amended and deleted in their entirety and replaced and superseded by and with the
equipment descriptions and specifications with respect to Customer's ground-based equipment set fortr in
Attachment A and Attachment B, attached hereto. The parties acknorvledge and agreethat no$vithstanding
anythingto the contrary herein, this Amendment does not in any rvay modif the equipment descriprions
and specifications with respect to Customer's towerflounted equipment set forth in the TLA (including

2. The month ly fee due under the TLA shall increase by Three Hundred Twenty and 00/100 Dolhrs
($320.00) which brings the total monthly fee under the TLA to S I ,020.00 (One Thousand Twenty and
00/l 00 Dollars) on the earlier of: i) the date Crown issues a written notice to proceed with the modification
of Customer's equipment at the Site, or ii) March l, 2025.

without limitation, any equipment descriptions and specificalions with respect to Customer's tower-
mounted equipment set forth in any schedules, exhibits or attachments to the TLA).
6. Exceptions to Non-Disclosure. Notwithstanding anything to the contrary in the TLA, and witrout
limiting or deleting any exceptions to non -d isclosure that may be set fo(h therein, (a) either party may
d isclose the terms ofthe TLA, as amended, or any portion thereof, to: (i) such party's af{iliated entities, (i)
such party's auditor, accountant, lender or attorney, (iii) such party's em ployees, d irectors, consultanls, or
agents who have a reasonable need to know such information and who shall agree in writing to be bound
by the terms and conditions of th is non-d isc losure provision, or (iv) a govemment entity or agency to the
extent requ ired by regulation, subpoenaorgovemmentorderto reveal, d isclose or publish such in form ation;
and (b) Crown may disclose the TLA, as amended, or the relevant portions thereof. to (i) the owner of he
real property on which the Site is located (or to Crown's lessor. sublessor or licensor), if Crown does not
own the Site in fee, or (ii) any of Crown's creditors.
