Agenda 02/25/2025 Item #17 B (Resolution - Approve petition VAC-PL20200001169 to disclaim, renounce, and vacate the County and the Public interest in the Conservation Easement recorded in the Official Record Book 4296, Page 1735)2/25/2025 Item # 17.13 ID# 2025-306 Executive Summary Recommendation to approve Petition VAC-PL20200001169, to disclaim, renounce, and vacate the County and the Public interest in the Conservation Easement recorded in Official Record Book 4296, Page 1735, of the Public Records of Collier County, Florida, located approximately 400-feet east of Industrial Boulevard, south of Mercantile Avenue, in Section 36, Township 49 South, Range 25 East, Collier County, Florida. OBJECTIVE: To adopt a Resolution to vacate the County and the public interest in the Conservation Easement as recorded in Official Record Book 4296, page 1735 of the public records of Collier County, Florida, in Section 36, Township 49 South, Range 25 East, Collier County, Florida, being more specifically shown in Exhibit "A." CONSIDERATIONS: Petition VAC-PL20200001169 has been received, with a request to vacate the Conservation Easement as recorded in Official Record Book 4296, page 1735 of the public records of Collier County, Florida in Section 36, Township 49 South, Range 25 East, Collier County, Florida. According to the Collier County Property Appraiser and a warranty deed recorded at O.R. Book 5356, page 1089, Oakes Farms, Inc. owns the real property underlying the subject conservation easement. The applicant proposes vacating a 0.13-acre conservation easement on a 1.36-acre property zoned Industrial. The conservation easement was originally granted to the County in 2005 as a requirement of SDP AR-8752 and then required preservation standards. However, the Collier County Land Development Code (LDC) was amended in 2014 (Ord. 2014-33) to exempt Industrial zoned parcels with a native vegetation retention requirement of 2 acres or less from LDC preservation standards. Much of the vegetation within the conservation easement was removed during the clean-up of the damage that occurred from Hurricane Irma in September 2017. Per LDC 3.05.07.B.2.h, Industrial zoned parcels with native retention of 2 acres or less are exempt from preserve standards, therefore there will be no public detriment from the vacation of this conservation easement. The vacation of the conservation easement will allow Oakes Farm, Inc. to expand the use of the site, offering benefits for the economic well-being of the business and the public, serving the public interest. The Development Review Division has reviewed this petition and found no reason for objection. FISCAL IMPACT: Growth Management Community Development Department, Development Review Division staff has collected a $2,000 "Petition to Vacate" fee from the petitioner. This fee covers the County's cost of recording and processing the Petition. GROWTH MANAGEMENT IMPACT: There is no growth management plan impact associated with this action. LEGAL CONSIDERATIONS: Petitioner requests the vacation of the conservation easement described in O.R. Book 4296, Page 1735, in the Public Records of Collier County, Florida. Pursuant to Resolution 2021-243 and Florida Statutes sections 125.01 and 125.37, the Board may adopt resolutions to extinguish, vacate, abandon, discontinue, and close any easements, or any portion thereof, granted to the County or public by any instrument recorded in the public records of Collier County and to renounce and disclaim any right of the County and the public in and to any land in connection therewith; when such interest is granted to the County or public by any instrument recorded in the public records other than on a subdivision plat when the following criteria are met: 1. Public benefit is established, or no public detriment is established. 2. The Petitioner owns the fee simple title to the whole or that part of the parcel on which a public or County dedicated easement is sought to be extinguished. Moreover, this request to vacate a conservation easement is consistent with the County's vacation procedures under Page 92 of 94 2/25/2025 Item # 17.13 ID# 2025-306 Resolution 2021-243 and section 704.06(4), Florida Statutes, which states that "A conservation easement may be released by the holder of the easement to the holder of the fee even though the holder of the fee may not be a governmental body or a charitable corporation or trust." (PL20200001169) WHEREAS, pursuant to Resolution 2021-243, Petrtioner, Chris Lascano, of Phoenix Associates of FL, Inc., on behalf of the property owner, has requested the vacation of the County and the Public interest in the Conservation Easement as recorded in Official Record Book 4296, Pages 1735 through l74l of the Public Records of Collier County, Florida, in Section 36, Township 49 South, Range 25 East, Collier County, Florida, being more specifically shown in Exhibit "A", attached hereto; and WHEREAS, on October 22,2013, Agenda Item 11.C, the Board of County Commissioners ("Board") approved a prioritized list of Land Development Code (LDC) amendments, including revising the LDC "to be consistent with EAR-based changes to the Conservation and Coastal Management Element (CCME) of the Growth Management Plan"; and WHEREAS, County staff subsequently worked with stakeholder groups, community members, and advisory boards to develop and publicly vet the proposed amendments (including the Development Services Advisory Committee and Planning Commission), and on July 8, 2014, Agenda Item 9.A, the Board adopted Ordinance No. 14-33, implementing the 2013 prioritized list of LDC Amendments; and WHEREAS, this LDC amendment added an exemption to the native vegetation requirement imposed by the table in LDC section 3.05.07.8.1, exempting industrial zoned parcels having a native vegetation retention requirement of 2 acres or less; and WHEREAS, prior to this amendment, such industrial zoned parcels were required to have onsite vegetation and others to have separately recorded conservation easements as part of their Site Development Plan (SDP). WHEREAS, the Board of County Commissioners of Collier County, Florida ("Board"), pursuant to sections 125.01, 125.37, 177.101, 336.09 and 336.10, Florida Statutes, Collier County Ordinance No. 2004-31, as amended, and the Collier County Land Development Code, is authorized to grant or deny vacations and annulments of plats of subdivided land, road rights-of- way, alleyways, and public dedicated easements conveyed by separate instrument recorded in the public records, and exchange of real property; and WHEREAS, the Board, on July 25, 2006, adopted Resolution 2006-160, which superseded and replaced Resolution 1998-465, establishing the policies and procedures previously established for the above; and WHEREAS, the Board, on September 10, 2013, adopted Resolution 2013-166, which amended Resolution 2006-160, to further amend the policies and procedures previously established for the above; and WHEREAS, the Board desires to further amend the policies and procedures for: 1) closing and vacation of road rights-of-way; 2) vacation and annulment of plats or portions of plats of subdivided land; and 3) extinguishment of public easements conveyed by separate instrument records in the public records (conveyances other than on a subdivision plat) on platted or unplatted land, except for public roads, and exchange of real property.
