2/25/2025 Item # 16.A.9 ID# 2025-370 Executive Summary Recommendation to approve the release of a code enforcement lien with an accrued value of $195,600, for a reduced payment of $20,796.90, in the code enforcement action titled Board of County Commissioners vs. Katherine M. Johnson Trust, relating to a condominium located at 1718 Bald Eagle Dr. #C, Collier County, Florida. Code Enforcement Board Case No. CESD20190009030. OBJECTIVE: To have the Board of County Commissioners accept an offer to release a code enforcement lien with an accrued value of $195,600 for payment of $20,796.90 in relation to Code Enforcement Board Case No. CESD20190009030. CONSIDERATIONS: As a result of a code violation consisting of enclosing the condominium's rear porch/lanai with windows and/or sliding glass doors without the required Collier County permits and inspections, a lien was imposed by the Collier County Code Enforcement Board in Case No. CESD20190009030. The lien was recorded on April 5, 2021, at O.R. Book 5920, Page 3901, in the amount of $9,268.56. Fines continued to accrue, and the lien amount of $195,600 is based on 1,304 days at ($150 per day from December 27, 2020, through July 22, 2024), resulting in a total balance of $195,600. The property was brought into compliance on July 22, 2024. Pursuant to Resolution No. 2023-90, a request for reduction of fines may be considered, in part, when a lien encumbers property under new ownership, and the new owner has diligently pursued abatement and achieved compliance and/or when payment of the lien would impose a severe financial hardship on the owner. In 2017, Leslie Sabo, trustee for Katherine M. Johnson Trust, determined her father's health was declining, and his condominium was uninhabitable due to structural damage sustained from Hurricane Irma. Ms. Sabo then became the primary caretaker for her father, and once she became aware of the violation, an architect and contractor were hired to assist with making the necessary corrections. Despite extenuating circumstances, Ms. Sabo reached an agreement with the HOA board, resolved the outstanding permit, PRBD20190938632, and abated the violation in July 2024. It took substantial time and money, over $76,000 in legal expenses, repairs, and permit fees, to achieve compliance, leaving Ms. Sabo in a precarious financial situation. The recommended payment of $20,796.60 is based on ten percent of the Collier County Property Appraiser's Assessed Value of $207,969 and meets the criteria outlined in Resolution 2023-90. There are no known violations at this time. FISCAL IMPACT: Acceptance of payment of $20,796.90 to settle the lien will correlate to what is outlined in Collier County Resolution 2023-90. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action. LEGAL CONSIDERATIONS: The County Attorney's Office has reviewed this item and approved it as to form and legality. Majority support is required for approval. This item conforms to the Board's policy contained in Resolution 2023-90.
