Executive Summary
Recommendation to approve the release of two code enforcement liens with an accrued value of $30,000, for a reduced
payment of $11,517.70, in the code enforcement action titled Board of County Commissioners vs. Carmen Vasallo,
relating to property located at 1013 New Market Rd. W., Collier County, Florida.
OBJECTIVE: The Board of County Commissioners accepts an offer to release two code enforcement liens with an
accrued value of $30,000 for payment of $11,517.70 in relation to Code Enforcement Special Magistrate Case No.
2006-11049 and Code Enforcement Board (CEB) Case No. 2007-46.
CONSIDERATIONS: As a result of code violations at 1013 New Market Rd, W., the Code Enforcement Board and
Special Magistrate ordered the imposition of two liens against Carmen Vasallo.
In CEB Case No. 2007-46, the violation consisted of unpermitted partition walls, an unpermitted carport, and an
unpermitted extension to the shed with electricity, possibly used as living quarters. The lien was recorded on August 30,
2007, at O.R. Book 4276, Page 3214, in the amount of $1,543.66. Fines continued to accrue at 141 days at a rate of
($100 per day from July 3, 2007, through November 20, 2007) for a total amount of $14,100. The property was brought
into compliance on November 20, 2007.
In Special Magistrate Case No. 2006-110409, the Special Magistrate imposed a lien for the accumulation of litter on the
residential property consisting of, but not limited to, excessive amounts of wood and aluminum materials. The lien was
recorded on February 22, 2008, at O.R. Book 4332, Page 0562, in the amount of $16,076.53. The lien accrued at 159
days at a rate of ($100 per day from April 28, 2007, through October 3, 2007) which included a $246.66 operation cost
paid on August 20, 2024, leaving a balance of $15,900. The property was brought into compliance on October 3, 2007.
Pursuant to Resolution No. 2023-90, a request for reduction of fines may be considered, in part, when a lien encumbers
property under new ownership, and the new owner has diligently pursued abatement and achieved compliance and/or
when payment of the lien would impose a severe financial hardship on the owner. Mrs. Vasallo believed her attorney
had helped resolve the violation and fines 18 years ago and only discovered that the liens were still active during the
process of refinancing her home. The unpermitted walls, carport, and extension to the shed were demolished, and a
Certificate of Completion was issued on November 7, 2007. There are no known violations at this time. The
recommended payment of $11,517.70 is based on ten percent of Collier County Property Appraiser's Assessed Value of
$115,177 and meets the criteria outlined in Resolution 2023-90.
Code Enforcement is recommending a waiver of $18,482.30 in accrued fines, as outlined in the attached Code Lien
Relief Application. The property has no known violations.
FISCAL IMPACT: Acceptance of payment of $11,517.70 to settle the lien will correlate to what is outlined in Collier
County Resolution 2023-90.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action.
LEGAL CONSIDERATIONS: The County Attorney's Office has reviewed this item and approved it as to form and
legality. Majority support is required for approval. This item conforms to the Board's policy contained in Resolution
2023-90. RTT
RECOMMENDATIONS: To approve the recommended reduction of fines in the amount of $18,482.30, accept
payment amount of $11,517.70, release the liens, and authorize the Chairman to sign the attached release and
satisfaction of lien for recording in the Official Public Records.

The reasons, if any, compliance was not obtained prior to the order of imposition:
J was unaware of the v1olat1ons at the time they were issued, as I believed that my attorney had resolved these issues
Unfortunately, It was only during the refinancing process that I discovered the violations were still active. The situation was
further complicated by a prolonged and difficult communication process with the county.
Provide the factual basis as to why a reduction of the lien should be granted. Please describe
the extent to which payment of the full lien would impose a severe financial hardship, the
measurable expenses incurred to bring the property into compliance, and the diligence of
the pursuit to bring the property into compliance. All supporting documents to show the
fmeasurable expenses shall be attached. (Attach additional pages I documents i necessa,y)
I am an elderly single woman currently in the process of refinancing my home and, unfortunately, I
cannot afford to pay the full amount of the liens, which are from 18 years ago. I initiated the
search revealed these outstanding liens. I have worked diligently with my attorney and the title company to address these violations, but the cost of paying the full lien amounts would impose a
