Agenda 02/11/2025 Item #16B 9 (The Lely Golf Estates Beautification MSTY to accept a zero-cost donation of existing decorative traffice signposts)2/11/2025 Item # 16.B.9 ID# 2024-2241 Executive Summary Recommendation to authorize the Lely Golf Estates Beautification Municipal Service Taxing Unit (Lely MSTU) to accept a zero-cost donation of existing Decorative Traffic Signposts from the Lely Civic Association (LCA) to assume ownership to perform all duties of maintenance and improvement and authorize the County Manager or her designee to sign the zero-dollar bill of sale. OBJECTIVE: To transfer ownership of existing Decorative Traffic Signposts from the Lely Civic Association (LCA) to the Lely MSTU to assume ownership and maintenance duties for continued beautification within the district. CONSIDERATIONS: For many years the LCA has funded and maintained the black metal decorative street & traffic signposts within the Lely MSTU district. Due to constraints on the LCA ability to increase HOA dues by way of a vote by property owners, funding for their maintenance and upkeep is in jeopardy. Upon consideration by the MSTU Advisory Committee a motion was passed four to zero (4-0) at the September 19, 2024, monthly public meeting to proceed with the transfer, executed by way of a Zero Dollar bill-of-sale. Upon completion of the transfer, the Lely Golf Estates MSTU will assume ownership and maintenance of the decorative signposts utilizing funds available in the MSTU Fund 1620. Because the signage is within the right-of-way (ROW) on County-maintained roads, the Traffic Operations Division will continue to provide standard Manual of Traffic Control Device (MUTCD) compliant traffic sign panels at no cost for separate installation into the decorative signposts by the MSTU. This item is consistent with the Collier County strategic plan focus area Quality of Place and the objective to support and enhance our commitment to robust public safety services. FISCAL IMPACT: Annual maintenance costs for the decorative signposts have averaged $3,000 or less over a recent six-year period ending in 2023, exclusive of damage incurred by hurricanes. MSTU costs for repair of damage from Hurricane Ian are estimated at $20,000 or less. Funds in the amount of $150,000 are reserved and available in the Lely MSTU Fund (1620-162541) to cover costs associated with this agreement. GROWTH MANAGEMENT IMPACT: This item is consistent with the County's Growth Management Plan. LEGAL CONSIDERATIONS: This item is approved for form and legality and requires a majority vote for approval. - SAA RECOMMENDATIONS: To authorize the County Manager or designee to sign the attached Zero-Dollar Bill of Sale to facilitate the Lely Golf Estates Beautification Municipal Service Taxing Unit (Lely MSTU) to accept a zero-cost donation of existing Decorative Traffic Signposts from the Lely Civic Association (LCA) to assume ownership to perform all duties of maintenance and improvement going forward.
