Executive Summary
*** This item has been continued from the December 10, 2024, BCC Meeting *** This item requires that ex-parte
disclosure be provided by Commission members. Should a hearing be held on this item, all participants are required to
be sworn in. Recommendation to approve a Resolution designating Plot W of the Rosemary Cemetery as historically
significant, pursuant to the historic/archaeological preservation regulations as provided in Section 2.03.07.E of the
Collier County Land Development Code. The subject property, approximately .04± acres, is located south of Pine Ridge
Road, approximately 592 feet east of US 41, in Section 15, Township 49 South, Range 25 East, Collier County, Florida,
PL20240009512. (This item is a companion to 9A)
OBJECTIVE: To have the Board of County Commissioners (BCC) consider an application designating Plot W of the
Rosemary Cemetery as historically significant, pursuant to the historic/archaeological preservation regulations as
provided in Section 2.03.07.E of the Collier County Land Development Code.
CONSIDERATIONS: The BCC adopted Ordinance 91-102, establishing the Historical and Archaeological
Preservation Ordinance, which was re-codified in Ordinance 2004-41, as amended. This Ordinance was enacted to
protect, preserve, and perpetuate Collier County's historic and archaeological sites, districts, structures, buildings, and
properties. The BCC may distinguish properties with architectural and/or historical significance by designating them as
local historic landmarks.
The Collier County Museums Division, at the direction of the BCC (December 14, 2021, BCC meeting, Agenda item
16D23), has submitted an application designating Plot W of the Rosemary Cemetery as historically significant.
The Collier County Historic and Archaeological Preservation Board (HAPB) reviewed and considered the application
for historical designation of Plot W of the Rosemary Cemetery during their public meeting on October 25, 2024, and
voted 5-0 to forward petition PL-20240009512 to the BCC with a recommendation to designate Plot W of the Rosemary
Cemetery as historically significant The HAPB found that the subject structures qualify as a locally significant historic
structure pursuant to criteria "a," "b," "c," "d," "e," "f," and "h" of the Designation Criteria as listed in the LDC Section
2.03.07.E.1 and as noted below:
a. The area is associated with distinctive elements of the cultural, social, ethnic, political, economic, scientific,
religious, prehistoric, or architectural history that have contributed to the pattern of history in the community,
the County, the State of Florida, or the nation.
Plot W of Rosemary Cemetery is the burial site of at least two infants (Pollack and Allen) as well as a World War I
veteran, Harvey Tomlinson. Tomlinson was once accidentally shot in the chest by his brother while hunting
alligators but survived. The stories of the lives of the people buried in Plot W are representative of life in Collier
County, the State of Florida, and the United States in the 1930s and 40s (and prior), when access to prenatal and
neonatal medical care was limited, family life was often disturbed by the draft requiring military service abroad, and
day-to-day existence was marked with potential dangers rarely faced in modern society.
b. The area is associated with the lives of persons significant in history.
As mentioned, Plot W is the burial site of Harvey Tomlinson, a World War I veteran.
c. The area embodies the distinctive characteristics of a type, period, method, or materials of construction that possess
high artistic value, quality of design craftsmanship, or that represent an individual architect or builder's prominence or
contribution to the development of the County, the State of Florida, or the nation.
The original grave markers of the people buried in Plot W, which probably would have been made of wood or other
easily accessible but impermanent materials, have been lost to time As such, no artifacts of significant artistic, design,
or craftsmanship value remain (if ever there were any) Although he was not its "architect or builder," the land for
Rosemary Cemetery was donated by Ed Crayton, who was the president of Naples Development Company and later a

City Councilman and personally financed many early infrastructure projects to advance the town.
d. The area was the location of historic or prehistoric activities including, but not limited to, habitation, religious,
ceremonial, burial, or fortification during a particular period of time, which may maintain a sufficient degree of
environmental integrity to reflect a significant aspect of the relationship of the site's original occupants to the
environment.
As part of the original plat of Rosemary Cemetery, Plot W is part of the location of the historic burial site for Naples
residents between 1930 and 1947. The cemetery's relative dearth of burials is due to many residents' preference to be
buried in the cities from which their families hailed in states to the north or to be buried in Ft. Myers due to the
environmental factors (sugar sand and a high-water table) that made Rosemary problematic These factors demonstrate
early residents' tenuous relationship to their town and its environment.
e. The area is a historical or prehistoric site that has been severely disturbed but may still allow useful and representative
data to be recovered.
As a historic site and cemetery, Plot W has been severely disturbed on its surface. The degree of subsurface disturbance
is known. At this time, staff would not recommend disturbing the interments in Plot W for research purposes. However,
future technologies may allow for information gathering in ways that would be considered appropriate to cultural norms.
Any such activity should be undertaken in consultation with descendant communities if any are known.
f. The area has yielded or is likely to yield information on local history or prehistory.

h. The area is the birthplace or grave of a historical figure or is a cemetery that derives its primary significance
from graves of persons of importance, from age, distinctive design features, or from association with historical
events.
As indicated, Plot W is a portion of Naples's historic cemetery and derives its significance from its age and association
with historical events.
Once a site and/or structure is designated "historic," the property owner (in this case, the County) is required to obtain a
Certificate of Appropriateness from the HAPB prior to the issuance of permits to alter, excavate, relocate, or demolish it.
Certificates of Appropriateness: The HAPB issues such certificates for designated sites before the issuance of permits to
alter, excavate, relocate, reconstruct, or demolish; these are needed before the issuance of building, tree removal, or
demolition permits.
An historic designation can make designated sites and structures eligible for the following:
Building Code: Designated projects may be eligible for administrative variances or other forms of relief from building
codes as follows:
Repairs and alterations may be made without conformance to requirements of the Standard Building Code when the
work has been issued a Certificate of Appropriateness . . . provided that:
1. The restored building will be no more hazardous than it was in its original condition,
2. Plans are sealed by a Florida registered architect or engineer if required,
3. The Growth Management Department (GMD) Department Head has required the minimum necessary
correction to be made before use in the interest of public health, safety, and welfare.

Zoning Ordinance: Subject to the conditions contained in the LDC, a variance for any historically designated site or
structure regarding setbacks, lot widths, depths, area requirements, development regulations, open space and parking
requirements, and similar variances not related to a change in use of the property can be approved.
Financial Assistance: Historically designated sites and structures are eligible for financial assistance set aside for historic
preservation projects by the State of Florida or the federal government, provided they meet the requirements for those
financial assistance programs.
HISTORICAL AND ARCHAEOLOGICAL PRESERVATION BOARD (HAPB)
RECOMMENDATION: The HAPB heard this petition on October 25, 2024. At this meeting, HAPB voted 5-
0 to forward petition PL-20240009512 to the BCC with a recommendation to designate Plot W of the
Rosemary Cemetery as historically significant.
FISCAL IMPACT: This petition by and of itself will not have a fiscal impact on Collier County. However, historic
designated sites and structures are eligible to receive financial assistance set aside for historic preservation projects by
the State of Florida and/or the federal government, provided it meets the requirements of those financial assistance
programs.
GROWTH MANAGEMENT IMPACT: The subject property is zoned General Commercial (C-4) District. The Future
Land Use designation is Mixed Use Activity Center (MUA) Subdistrict. The Land Development Regulations have been
adopted to implement the GMP in order to ensure the protection of historic resources. Policy 3.1:h of the Future Land
Use Element provides protection of historically significant properties.
LEGAL CONSIDERATIONS: This item is approved as to form and legality, and a majority vote is needed for
Board approval. (HFAC)

The Designation of Historical/Archaeological Sites, Structures, Districts, Buildings and Properties as "Historically
Significant” is authorized by Section 2.03.07.E of the Collier County Land Development Code (LDC). The
recommendation of the Historic and Archaeological Preservation Board (HAPB) and the decision of the Board of County
Commissioners will be based on the below listed criteria. Provided a detailed response, including any documentation or
other resources, to each of the criteria, which is applicable to this petition. For consideration by the Board of County
Commissioners, the petition need only meet one of the required criteria. However, a detailed response should be
provided to any of the criteria, which appear relevant.
1. Association with distinctive elements of the cultural, social, ethnic, political, economic, scientific, religious,
prehistoric and architectural history that have contributed to the pattern of history in the community, Collier
County, the State of Florida or the nation; or
2. Association with the lives of persons significant in history; or embodiment of the distinctive characteristics of a
type, period, method or materials of construction, or that possess high artistic values, quality of design and
craftsmanship, or that represent an individual architect or builder’s prominence or contribution to the
development of the County, the State of Florida, or the nation; or
3. Location of historic or prehistoric activities such as habitation, religious, ceremonial, burial, fortification, etc. during
a particular period of time, and may maintain a sufficient degree of environmental integrity to reflect a significant
aspect of the relationship of the site’s original occupants to the environment; or
4. An historic or prehistoric site which has been severely disturbed but which may still allow useful and representative
data to be recovered; or
5. Have yielded or are likely to yield information on local history or prehistory; or
6. Derive it’s primary significance from architectural or artistic distinction of historical importance; or
7. Is the birthplace or grave of an historical figure or is a cemetery which derives its primary significance from graves
of persons of transcendent importance, from age, distinctive design features, or from association with historic
events; or
8. A building or structure removed from its original location which is significant for architectural value, or is the sole
surviving structure most importantly associated with an historic period, person or event; or
9. A property primarily commemorative in intent where design, age, tradition or symbolic value has invested it with
its own historical significance; or
10. Area contains known archaeological sites that have not been assessed for significance but are likely to conform to
the criteria for significance or areas where there is a high likelihood that unrecorded sites of potential significance
are present based on prehistoric settlement patterns and existing topographic features; or are listed in the
National Register of Historic Places.

The parcel is bordered on the north by parking and Pine Ridge Road, on the east by parking for the
Regal Point Condominium, on the south by a one-story commercial shopping plaza, and on the

1. Mailed Notice
Written notice shall be sent to property owners of record whose land is under consideration for designation initiated
by the Preservation Board at least 30 days before the first Preservation Board or Board of County Commissioners
scheduled hearing date. Notices will be provided by certified mail return receipt request. The first notice shall provide
pertinent information regarding the designation site
A second notice shall be sent to indicate when the Board of County Commissioners will consider an official designation
of the site in an advertised public hearing.
2. Newspaper Advertisement
The legal advertisement shall be published at least 15 days before the advertised hearing in a newspaper of
general circulation. The advertisement shall include at a minimum:
a. Date, time, and location of the hearing;
b. Application number and project name;
c. 2 in. x 3 in. map of project location; and
d. Description of location.

EXECUTIVE SUMMARY
Recommendation to direct staff to begin the process of acquiring two additional Rosemary
Cemetery Parcels (Plot W and Plot N), to perform necessary improvements and annual
maintenance to conform with standards similar to the County-owned Rosemary Cemetery Parcel
(Unit B located on the Southeast corner of US41 and Pine Ridge Road) in order to honor and
remember our community's forebears. (Museum Fund 198, Estimated Fiscal Impact:
Improvements $27,543, Annual Maintenance $3,024)
OBJECTIVE: To honor and remember all our community’s forbears buried in the original Rosemary
Cemetery.
CONSIDERATIONS: Rosemary Cemetery was founded in 1930 on twenty (20) acres of land donated
by Ed Crayton between US 41 and the railroad (now Goodlette Road) south of Pine Ridge Road to allow
removal of graves from the downtown area near St. Ann’s Church. The historical record of burials in the
cemetery is incomplete. It is known that ten (10) burials were moved from St. Ann’s to Rosemary Unit B
and Plot W in the 1930s, but the high water table and sugar sand at Rosemary made burials problematic.
Overall, the cemetery was “unpopular,” and many of the departed were sent up north or to Ft. Myers
instead of finding a final resting place in Rosemary. The last interment in Rosemary was in 1947 and it
officially closed in 1955.
The most reliable source on information we have about Rosemary is a 1944 survey completed by City
Engineer Cambier, which identifies twenty-four (24) actual graves (fourteen (14) known, ten (10)
unknown) in Unit B, nine (9) named graves in Plot W, and “eight (8) Negro Graves - Unmarked” in Plot
N.
In 1950 Ed Crayton’s widow sold the cemetery to John Pulling and Robert Benson. Throughout the 1960s
development happened around the burial plots. In the mid-1970s community interest arose about the
cemetery and in 1976 Pulling and Benson quit claim deeded Unit B to Collier County. Various
community organizations cared for the plots through the 1970s and ’80s, and in 1993 at the
recommendation of the Historical and Archaeological Preservation Board, the Board of County
Commissioners (Board) designated Unit B as a historic site and authorized new markers and maintenance
under direction of Museums. Museums, with the help of Facilities Management, has maintained Unit B
ever since. Plots W and N, however, remain in private ownership.
In May of 2020 Museum staff noticed that two (2) of the four (4) concrete posts that are the only
remaining indicator of the location of Plot N had been damaged. Museums contacted the heir of the
property owners of record (Alec Pulling), who stated he had no material interest in retaining ownership of
the properties. In the meantime, Facilities Management made temporary repairs to the pillars, as
community interest and concern was starting to grow.
In August of 2020 a citizen attended the Historical and Archaeological Preservation Board (HAPB)
meeting asking about the process to designate one of the Rosemary outparcels as historic. The project was
referred to the Museum Division due to the property ownership issue.
Staff recommends the following course of action:
1. Arrange for a quit claim deed for Plots W and N from Alec Pulling, bring to Board for approval
2. Present Plots W and N to the HAPB for historic designation; if recommended by HAPB, bring to

3. Fence the properties and install headstones in the same manner as Unit B
4. Maintain the properties under our contracted landscaping service in the same manner as Unit B
5. Submit applications to the State Division of Historic Resources for Historic Markers for the
parcels
6. If not successful, erect “local” historic markers as has been done for Unit B

Through the Community Foundation of Collier County, the NAACP Collier Chapter has secured $10,000
to put toward the work needed on Plot N. The Friends of the Collier County Museums have also offered
to financially support the project.
FISCAL IMPACT: There is no fiscal impact associated with approving this project in concept. Funding
in the amount of $27,543, for the County's estimated portion of the project, is available within Museum
Fund (198) Reserves for Capital. Annual maintenance expenses of $3,024 can be absorbed within
Museum operating budgets. Staff will bring forward a Budget Amendment with a future action item to
accept ownership. The sources of funds for Museum operating and capital expenditures are Tourist
Development Taxes and the General Fund.
GROWTH MANAGEMENT IMPACT: There is no Growth Management impact.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, raises no legal
issues at this time and requires majority vote for approval. -JAK

All persons wishing to speak on any agenda item must register with the County Manager prior to
