Executive Summary
Recommendation to approve Change Order No. 3, adding a total of sixty-seven (67) days, correcting an error on Change
Order No. 2 adjusting the contract amount to $22,886,658.04 under Agreement No. 20-7811 with Quality Enterprises
USA, Inc., for the “Design-Build of the Immokalee Area Improvements – Tiger Grant” project, and authorizing the
Chairman to sign the attached Change Order. (Project No. 33563)
OBJECTIVE: To add an additional sixty-seven (67) days and correcting an error on Change Order No. 2 adjusting the
contract total to $22,886,658.04 under Agreement No. 20-7811, Design-Build Immokalee Area Improvements - Tiger
Grant Project, to complete the obligations of the construction contract.
CONSIDERATIONS: On February 8, 2022, the Board of County Commissioners (the "Board"), approved Agreement
No. 20-7811 (the “Agreement”) providing for the design-build of the Immokalee Area Improvements – Tiger Grant (the
“Project”) to Quality Enterprises USA, Inc. (“QE”). On March 12, 2023, the Board approved Change Order No. 1
(agenda item 16B2) under the Agreement, extending the contract 237 additional days. On November 12, 2024, the
Board approved Change Order No. 2 (agenda item 16B11) under the Agreement, adding $17,377.84 & extending the
contract 64 additional days.
Further extending the time of the Agreement is necessary, because forty-five weather & holidays have occurred over the
duration of the project. Due to Hurricane Milton, LCEC's subcontractor was not able to complete its work related to the
new street lighting, which curtailed QE's progress on the project. As a result, the contractor is requesting twenty-two
additional days to complete its obligations under the Agreement. Those combined time-related requests total sixty-seven
days.
Additionally, this Change Order is correcting a typing error on Change Order No. 2, correcting the original contract
amount to $22,869,280.20 & current Board approved amount to $22,886,658.04 as of November 12, 2024.
This item is consistent with the Collier County strategic plan objective to design and maintain an effective transportation
system to reduce traffic congestion and improve the mobility of our residents and visitors.
FISCAL IMPACT: The time extension is not requesting additional funding. Funding sources for this contract are
Federal Highway Authority within Transportation Grant and Match Fund (1841 & 1842), Stormwater Bond revenues
Fund (3052), and transfers from the General and Unincorporated General Funds.
GROWTH MANAGEMENT IMPACT: This recommendation is consistent with the Long-Range Transportation Plan
and Objective 1 of the Transportation Element of the Collier County Growth Management Plan to maintain the major
roadway system at an acceptable Level of Service.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote for Board
approval. —SRT
RECOMMENDATIONS: To approve Change Order No. 3, adding a total of 67 days, forty-five (45) days for weather
& holidays and twenty-two (22) additional days for utility conflicts under Agreement No. 20-7811 with Quality
Enterprises USA, Inc., for the “Design-Build of the Immokalee Area Improvements – Tiger Grant” project, and
authorize the Chairman to sign the attached Change Order.
