RECITALS: WHEREAS, the County is the owner of record of that certain Utility Easement granted on September 6, 1988 and recorded on November 21, 1988 in Official Records Book 1395, Page 2287, of the Public Records of Collier County, Florida ("County Utility Easement"), the location of which is shown on Exhibit"A", attached hereto and incorporated herein by reference; and WHEREAS, the County acquired the County Utility Easement in connection with the conveyance of those utility facilities evidenced in that certain Warranty Deed granted on September 6, 1988 and recorded on November 21, 1988 in Official Records Book 1395, Page 2290, of the Public Records of Collier County, Florida(the "Utilities"); and WHEREAS, Petitioner, James A. Can, P.E., of Agnoli, Barber, & Brundage, Inc., on behalf of the property owner, Palm River Accommodations LLC ("Property Owner"), made application to the County to terminate the County Utility Easement in connection with the proposed redevelopment and rezoning of property at or near 208 Palm River Boulevard,Naples, FL 34110, petition numbers GMPA-PL20230011318 and PUDZ-PL20230011319; and WHEREAS, the Property Owner desires to take possession of the underlying Utilities for the purposes of redeveloping their property, in conjunction with the County Utility Easement's termination; and WHEREAS, the County is amenable to terminating the County Utility Easement provided that the underlying Utilities are removed or properly abandoned, and the sufficiency of such removal or abandonment is determined to be sufficient by means of a County Final Site Acceptance Letter for Palm River Corporate Housing (SDP), SDP-PL20230015865. The above recitals are true and correct and are incorporated herein by reference. 2. The County does hereby relinquish, abandon, and terminate its interest in the County Utility Easement and releases the County Utility Easement, subject to the condition in paragraph 4 below. 3. The County does hereby remise, release, and quitclaim unto the Property Owner forever, all the right, title, interest, claim, and demand which the County has in and to those Utilities located within the County Utility Easement, subject to the condition in paragraph 4 below. 4. This UTILITIES QUITCLAIM DEED AND TERMINATION OF UTILITY EASEMENT is conditioned on the Property Owner removing or properly abandoning the Utilities, and that such removal or abandonment is determined to be sufficient by means of a County Final Site Acceptance Letter for Palm River Corporate Housing (SDP), SDP- PL20230015865.
