A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, AUTHORIZING THE CONDEMNATION
OF THOSE DRAINAGE EASEMENTS NECESSARY FOR THE
CONSTRUCTION OF STORMWATER IMPROVEMENTS AND
MAINTENANCE OF AN EXISTING PRIVATELY-OWNED POND
REQUIRED FOR THE WEST GOODLETTE-FRANK ROAD AREA
STORMWATER IMPROVEMENT PROJECT (PHASE 2); MAKING
FINDINGS OF PUBLIC PURPOSE AND NECESSITY; AND AUTHORIZING
THE APPROPRIATE STAFF TO INITIATE EMINENT DOMAIN
PROCEEDINGS (PROJECT NO. 60249).
WI-IEREAS, Collier County (the "County") is authorized by Chapter 73 and 74, Florida
Statutes to condemn necessary lands and property for public purposes or uses; and
WHEREAS, the perpetual, non-exclusive drainage easements hereinafter described in
Exhibit "A", attached hereto and incorporated herein (the "Drainage Easements") are
proposed to be acquired for the construction of stormwater improvements and maintenance
of an existing privately-owned pond(the"Pond")required for the West Goodlette-Frank Road
Area Stormwater Improvement Project (Phase 2), Project No. 60249 (hereinafter referred to
as "the Project"); and
WHEREAS, acquisition of the Drainage Easements and construction of the Project is in
accordance with the goals,objectives, and policies of all applicable sections of the Stormwater
Management Sub-element and the Conservation and Coastal Management Element of the
Collier County Growth Management Plan, as approved by the Florida Department of
Economic Opportunity; and
WHEREAS, plans and specifications have been prepared for construction of the Project;
and
WHEREAS, construction of the Project and maintenance of the Pond will require the
acquisition of perpetual, non-exclusive drainage easements; and
WHEREAS, the location for the construction of the proposed stormwater improvements
and maintenance of the Pond is collectively represented by the legal descriptions comprising
Exhibit "A", attached hereto and incorporated herein; and
WHEREAS, after consideration of the availability of alternate routes and locations, the
comparative costs of the Project alternatives, various impacts upon the environment, long range
planning options, and public safety considerations, the Board desires to exercise its right to

condemn property for public use or purpose and the property to be condemned is necessary
for that use.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
1. The above recitals are incorporated herein and made a part hereof by this
reference.
2. The Board declares that it is necessary to acquire by eminent domain, perpetual,
non-exclusive drainage easements in the property described in Exhibit "A" (the
"Drainage Easements") for the public purpose of construction of the Project and
maintenance of the Pond, in order to protect the health, safety and welfare of the
citizens of Collier County.
3. The Board has considered alternative locations for the Project, various impacts
to the environment, public health, safety and welfare considerations associated
with the design and construction of the Project, and the costs associated with
acquisition of the Drainage Easements, and construction of the Project; and the
Board finds that after consideration of these issues, the most feasible location
for construction of the proposed improvements and maintenance of the Pond is
collectively represented by the legal descriptions comprising Exhibit "A."
4. The taking of the perpetual, non-exclusive Drainage Easements will provide
the County with the right to place and/or excavate materials for the purpose of
constructing, operating, and maintaining drainage structures including but not
limited to lakes, ponds, ditches, swales, earthen berms, rip-rap and retaining wall
systems, underground pipes, and various types of water control structures within
the Drainage Easements, provided that properly permitted existing boat ramps shall
be allowed to remain within the proposed Drainage Easements.
5. The County Manager or her designee and the Office of the County Attorney are
hereby authorized and directed to immediately acquire by gift, purchase, or
condemnation, in accordance with the provisions of Chapters 73, 74 and 127,
Florida Statutes,the Drainage Easements more particularly described in Exhibit
"A", attached hereto and incorporated herein.
