Approved unanimously 6.Community/Business – Presentations: None 7.Old Business: a.Derelict Boat in Haldeman Creek Update (Attachment) Shirley Garcia: Has been removed and is now off our list. 7.b.Marker 16 Replacement Update Shirley Garcia: We did get a buoy because poles would not go into that area due to too much rock. 7.c.Bathymetric Survey Scope Draft (Attachment) Shirley Garcia: In your packet is a memorandum of a snippet of what the scope was from 2019 and I also put in suggestions. There are additional ideas from 2006 if you would like me to add those – for a deeper scope if you would prefer. Roy Wilson: All the legal information and format that one would need to use we Item 4a April 1, 2024 2 survey the depths in a way to make a comparison to the post construction survey that Shirley handed out, and I refer to that as baseline. After the dredge they did the post survey – go back to that and then summarize it for us in such a way to analyze it; identify areas for possible dredge; and recommendations. When I met with Mr. Rodriguez, he talked about having access to engineers that are on the county payroll and the idea that I picked up was he is going to supplement that perhaps with some new hires. I would like to have a scenario, Shirley, where we get an engineering head involved as we go through this request for proposal and then the analysis, the type of analysis that's actionable for us. I'd like somebody to be able to take us through so we know where there are problem spots and where the original dredge company could not dredge to the depth we needed. We will need an estimate of what it would cost to address this, but more importantly we want to get real information back that we can deal with. There are hard surface locations that the earlier dredge could not remove. If that buildup consists of shells and other matter (calcified/dense material underneath the dirt – not base rock), you can remove that, but it takes a different approach to dredging. The permit said dredge and not remove rock. Tami Scott: You should request an opinion of what it will cost to get back to the 2006 dredge – what the elevations were at that point in time because that's the baseline. Further discussion ensued regarding the canals, measurements not specified, the prior dredging company has closed its doors, get the original bid document, documentation from 20 years ago that cannot be found, the need for all measurements. Pull up the information from the last one done with Ian – 2019 – and look at that. (Shirley found the dredge documents from 2019 and discussion ensued.) I recommend we look at those stormwater inlets because most of them are failing and it's tilting in because those stormwater outlets and inlets are failing. I would like to work with stormwater to see if (a) they could do an inspection on the stormwater and outlets and inlets before we do a bathymetric, to do their determination, and is it on private property or (b) is it something that stormwater would handle and then maybe we could partner with them? 7. d. Draft Ordinance (Attachment) Roy Wilson: I would move that Staff proceed with the appropriate steps with the draft ordinance that we have in front of us with the goal of it being presented to the Board of County Commissioners. have talked about this before. We want to get very clear in this scope that they April 1, 2024 3 Seconds the motion. Shirley Garcia: We would have to go through the county manager's office and have them read over it thoroughly and then it goes to the attorney's office. We will have to meet with the Director of Code Enforcement and the Director of GMD and sit down and review it. In the existing ordinance, the only thing that we are adding is: Any obstacle, vegetative debris, organic or inorganic, which obstructs free passage or presents a potential hazard to the free passage of vessels in the waterways within the Halderman Creek MSTU boundary, or abutting the Haldeman Creek boundary, is hereby prohibited and declared a public nuisance. (Page 2-3, Section 11, Subsection 7) You can trim the mangroves if they do not die. Motion passes unanimously. 8. New Business a. Mileage Neutral or Tax Neutral Roy Wilson: I would recommend a motion for mileage neutral again this year. Bob Wopperer Seconds the motion. Approved unanimously. b. MSTU Residents’ Informational Dissemination Discussion Roy Wilson: Part of my reason for getting this (Information Guide for Waterfront Property Owners) on the agenda is we need somebody to do some forward- thinking work on this. Shirley can bring anybody up to date on the information package we put together. The residents have an obligation to have their dock or sea wall showing their address. We might need a separate flyer related to vegetation while we are waiting for the draft ordinance to go through the process. Shirley Garcia: I can make it in a newsletter format so as not to offend anyone. We want to make sure that everyone is educated – maintenance of docks, April 1, 2024 4 dressing, and vegetation information. I can also include the ordinance that it is applicable to. Further discussion on cross-checking and verifying all the addresses; use of a drone; ordinance includes size and color and what should be on your dock or sea wall to identify your address. ?: Volunteers to assist in this effort and will work with Jacob and Shirley to get as much done prior to his leaving Florida for a few months. 9. Staff Report a. Financials (Attachment) Shirley Garcia: Explained the changes in the financials. More revenue from Regatta Landings. Shirley will find out what Courthouse Shadow will contribute because they have not completed their permitting and will send an email with the information. There are several new projects coming on Arbutus and Mangrove, so that's going to be contributing soon and several other projects that are coming on the waterway too, and I can include them. Roy Wilson: Discussed how the mileage rate affects revenue; hard to determine at this time what it will cost to re-dredge, if needed. We're collecting income at what I call a very conservative rate. The original dredge was not to solve everybody's problem. 10. Correspondence and Communication a. Homeless Camping Fill Article- Attached as informational b. Public Comments Community Member:Overgrowth canal trimming: no permit needed; cannot use heavy machinery; mangrove is sideline trimming of about 10% ( in the brochure as well as information about vacant lots, vegetation removal permit, etc.) Depth of the canals; low tide, high tide or mean low tide; private property is not dredged; east of Bayshore was 20 feet wide and two feet deep at low tide – however boats encounter mud – it kicks up, can’t get the boat in our out – no one on the east side was satisfied; our charge of the HC MSTU is to maintain what was done; no definitive timeline for re-dredging; homeowner could pay to get it done; partner with the MSTU to get the east end done; grant money/funding for docks, letters/numbers on the dock and/or sea walls or staff for dredging; CRA has a residential grant program. 12. Advisory Board General Communications Roy Wilson: Debris coming in with storm water and how to manage it; 2185 Sheepshead Drive Royal Harbor – large new home built and will probably build a dock – the marker needs to be moved (part of City of Naples) – Shirley with check with Code Enforcement regarding the movement of the marker; 2977 Cypress – renewing the sea walls and cement debris is falling into the water – Shirley will call the engineering inspectors to have them check it out; Shirley will look into creating a grant program for sea walls for Haldeman Creek and perhaps partner with the CRA; Three60 Market on Bayview and Celebration Park – proliferation of boats and/or jet skis – Shirley will look into the permits or SDPI. 14. Approved unanimously. 6.Community/Business – Presentations: None 7.Old Business: a.Humistonn and Moore, Matt Goddard, Project Manager via Zoom Roy Wilson: Regarding the letter from September 25, we have your analysis whether or not we had more debris and filling of Haldeman Creek after Irma, but now we have Ian. I would like to see recommendations in layman’s terms or somebody explaining what is in the reports. I didn’t know back then what it told me other than I did not see a red flag saying we had a problem you need to deal with. Matt Goddard: The determination at the time of the September 25 letter was taking the information we had and realizing we didn’t have enough information. It wasn’t a recommendation but just a quick summary. Greg Oravec: By Ordinance #2660, we were created for the purpose of maintenance dredging and the maintenance of navigation channel markers. That is your mission. Help me understand how you want to effectuate that purpose. The Item 4b 2 last time we dredged was in 2006-2007. How often have we been doing the surveying of the channels – one time. That’s really not on a frequency necessary to really know what’s going on. We need a professional opinion/recommendation from Matt to be running it on a useful interval and have a level of service standards. And it’s up to the MSTU to make a recommendation to the DCC on what should be done on what basis and how much will it cost. You should have good baseline information, navigation channel markers and the do’s and don’ts, and a good map. The 2019 report is aging out as far as usefulness and not reliable. If the main channel is your number one priority, I would want to hear from Matt the magnitude and what it would cost to do that in today’s market and compare it to your budget. Your secondary priority is the finger channels. Bill Robbins: It’s never been clear in the surveys what needs to be done. A question I have is what is 8,000, 10,000, or 15,000 cubic yards throughout the entire extent of the area? Can we get a professional say that at a certain amount it would be time to work it over? Further discussion with regard to:  Too shallow along the sides and near boat ramps  Large boats  Large rocks that cannot be removed Matt Goddard: Overall it’s not that bad. You have hot spots where there is settlement/infill. There may be issues in the canals in certain spots and some canals do not have issues. They change from canal to canal. The elevation on the East side of the bridge is different from the West side. Further discussion with regard to:  Hurricane events that causes different area problems  Dredge depths that are different for each canal  Overall costs  Decisions based on intelligent recommendations based on facts to the BCC  Permit is still good from the Army Core of Engineers; need expiration date updated  Property owners getting their own permit to piggyback  Started in 2019 but was set aside before the second phase  Once dredging is finished, there could be have a life expectancy for 50 years Greg Oravec: Matt will receive in writing a request for opinion on the following: (1) what does it take for a property owner to dredge adjacent to their dock and seawall; (2) as a part of a county project in the Haldeman MSTU, can a property owner piggyback on our permit – can the dredging of the dock and seawall areas be done under our permit at that time or does it have to be separate? (3) Give us a monthly report on the status of the permit. 3 Roy Wilson: To move forward we get a baseline survey updated and then get the gears rolling to ask for bids. It still gets back to where we are today and how do we move forward. Al Schantzen: The mechanical dredge is the way to go. The suction dredge that they used back in 2007 they could never keep enough water in the pipe to remove all the silt. Another is using a drone to fly over which would eliminate manpower. Roy Wilson: We would allow the bidder to choose his own method. Motion for staff to prepare the request for bid to do cross sections that match the end of the dredge cross session of Haldeman Creek to indicate depths. Bill Robbins: Seconds the motion. Shirley Garcia: Tasked with getting another bathymetric survey, I would need at least a couple of months to get that in place and look at who is on the contract so we might be able to award somebody. Then bring back an update on that with an amount and an action item. Greg Oravec: I want to get some of these baselines definitively addressed for you in one 4 place so that you can always consult them from here forward. Payment for Services For services rendered, Humiston & Moore Engineers (ENGINEER) will bill Client (OWNER) periodically, on a time and materials basis, or on a lump sum basis as agreed in the Work Order or proposal. Payment of bills is due within thirty days of the invoice date. If the OWNER fails to make any payment due for services and expenses within thirty days, the amounts due may include a late charge at the rate of 1.5% per month beginning on the thirtieth day after the date of the invoice, and in addition, after giving seven days written notice services under this agreement may be suspended until such time as full payment is made for amounts due. ENGINEER shall be entitled to collect reasonable fees and costs, including attorneys’ fees and interest, should it be required to obtain collection of any amount due under this agreement by court action or settlement without court action. Projects which require a retainer, the retainer will be deposited and applied to the final billing. Upon completion of the approved services, the retainer will be applied to the final charges, if the retainer is in excess of the final balance due on the account, the balance will be refunded, should the retainer be less than the account balance, the retainer will be applied and a final invoice will be issued, payment due upon receipt. Additional Services, Reimbursable Expenses, and Application Fees Additional Services not specifically included in the description of Basic Services will be provided at the cost of time and materials. Additional services may include any other services requested by OWNER, such as design and plan modifications, responding to requests of regulatory agencies, attendance at meetings and hearings, making presentations and time spent preparing for same. Reimbursable expenses associated with travel, copies, postage, application fees, laboratory testing fees, etc., will be billed at cost, mileage which will be billed at the prevailing government rate. Project Delays The OWNER recognizes and agrees that various factors can delay the performance of the work, the issuance of permits and licenses. The OWNER agrees that it shall not be entitled to any claim for damages on account of hindrances or delays from any cause whatsoever including but not limited to: the production of contract documents; issuance of permits from any agency; beginning or completion of construction; or performance of any phase of work pursuant to this Agreement. Limitation of Liability OWNER and ENGINEER agree that because of the risks, rewards and benefits of the project relative to the design professional's total fee for services, that the risks have been allocated such that, to the fullest extent permitted by law, ENGINEER's total liability to OWNER for any and all claims, for economic losses, expenses or damages arising out of this agreement from any cause or causes, shall not exceed the total amount of $10,000 or the amount of the fee for Professional Services charged for the specific services described, whichever is greater. Owner’s Responsibility Upon request by the Engineers, OWNER will provide ENGINEER with any criteria and information concerning the Owner’s requirements for the project, as well as all existing site surveys and other site information. Document Reuse All documents prepared or furnished by ENGINEER pursuant to this Agreement are instruments of service in respect to the project and ENGINEER shall retain an ownership and property interest therein whether or not the project is completed. Any reuse without written verification or adaptation by ENGINEER will be at Owner’s sole risk, and OWNER shall indemnify and hold harmless ENGINEER from all claims, damages, losses and expenses including attorneys' fees resulting there from. File Retention and Destruction Generally at the conclusion of each project, H&M will retain electronic copies of documents for a period of three years after we close the file. (SDI) is pleased to submit the following proposal for professional services pertaining to the referenced project. The scope of work shall include a single- beam bathymetric survey within Haldeman Creek, located in Naples, Florida. The survey area shall encompass cross-sections along the defined centerline, as depicted on “Attachment A” herein, encompassing approximately six hundred (600) cross-sections. A summary of the scope and fee estimates shall include: General: SDI shall provide supervision, field / office support staff and equipment to perform the scope of work described, herewith. All work shall be conducted to the highest level of industry standards and under the responsible charge of a Professional Surveyor and Mapper registered in the State of Florida. All work shall meet or exceed the Standards of Practice (Standards) set forth by the Florida Board of Professional Surveyors and Mappers in Chapter 5J-17, Florida Administrative Code, pursuant to Section 472.027, Florida Statutes. If time permits, deviations from the scope of work shall be addressed via formal approved addendum to the executed Agreement for Professional Services. Horizontal and Vertical Data: Horizontal Datum: Feet, relative to the Florida State Plane Coordinate System, East Zone, North American Datum of 1983 (NAD83) Vertical Datum: Feet, relative to the North American Vertical Datum of 1988 (NAVD88) Bathymetric Data Collection: The bathymetric surveys shall be conducted using an automated hydrographic system comprised of a survey launch equipped with a marine grade, single-beam sounder, differential global positioning system and computer-based navigation / data collection system. A differential GPS system shall be used for vessel positioning and navigation. The survey-grade sounder will include a 200-kHz narrow beam (3˚) transducer. This system, when calibrated to manufacturer’s specifications, will yield accuracies of 1 cm plus 0.10% of the water depth when corrected for sound velocity. The sounder shall be calibrated via bar checks at the beginning of each survey day. Data shall be collected along pre-defined transects oriented perpendicular to the defined centerline, at maximum intervals of fifty (50) feet. Hydrographic (bathymetric) data of shall be acquired as close to seawalls, docks, or vegetation as practical and within the safe operating limits of the automated hydrographic vessel and crew. AMENDMENTS TO PROCEDURES FOR MANDATORY LOT MOWING PROGRAM SECTION Section Nineteen, “Procedures for Mandatory Lot Mowing Program,” of Ordinance Number 05-44 is hereby amended to read as follows: SECTION NINETEEN Procedures for Mandatory Lot Mowing Program 1. Inclusion in mandatory lot mowing program. If a public nuisance is determined to exist three or more times after July 15, 2001, on a particular lot or parcel of unimproved property any lot or parcel subject to this ordinance while under the same ownership, then at the discretion of the County Manager or his/her designee, such property will be placed in the Mandatory Lot Mowing Program, as set forth below. 2. Exemption from lot mowing program. Individual property owners of record whose real property is included in the County's mandatory lot mowing program may request an exemption from inclusion in the program by submitting to the County Manager, or his designee, a signed written agreement, acceptable to the County, covenanting that the property owner will maintain the property so that the height of any grass, weeds, or otherwise regulated vegetative matter will not constitute a public nuisance or exceed eighteen inches in height. In addition, the property owner must provide a letter of credit, contract agreement, escrow agreement, or some other surety with a mowing company that is acceptable to the County. The surety provided may vary but must remain in effect throughout the property owner's ownership of the property(s). The agreement must also include a provision of understanding by the owner that should he/she fail to keep the contract agreement and ensure no violation of this Ordinance exists on the property(s), the agreement approved by the County will become null and void. CONFLICT AND SEVERABILITY SECTION In the event this Ordinance conflicts with any other ordinance of Collier County or other applicable law, the more restrictive shall apply. If any court of competent jurisdiction holds any phrase or portion of this Ordinance invalid or unconstitutional, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaindering portion. INCLUSION IN THE CODE OF LAWS AND ORDINANCES SECTION The provisions of this Ordinance shall become and be made a part of the Code of Laws and Ordinances of Collier County, Florida.
