FOREST PARK PUBLIC WALKWAY PEDESTRIAN PATH AGREEMENT BETWEEN COLLIER COUNTY
BOARD OF COUNTY COMMISSIONERS AND FOREST PARK MASTER PROPERTY OWNER'S
ASSOCIATION
This Agreement is made and entered this /a day of ,J('C.C.ri r , 202.i by and
between Collier County Board of County Commissioners("County")and Forest Park Master Property
Owner's Association, Inc., having an address of 4060 Recreation Lane, Naples, FL 34116 ("Forest
Park")
RECITALS:
WHEREAS, the Forest Park Subdivision Plat recorded in Plat Book 35, pages 1 through 7 and the
Forest Park III (Replat) Subdivision Plat recorded in Plat Book 39, pages 49 through 55, of the public
records of Collier County, contain a dedication from the landowner to Collier County for a Bicycle
(and Pedestrian) Access Easement (B.A.C.) which commences at the entrance to the Forest Park
community and runs along the north side of Recreation Lane, terminating at the Hudson Court cul-
de-sac, as depicted on the attached Exhibit"A"Sheet 2.
WHEREAS, on February 23, 1999, the County and Forest Park Development Company
("Developer") entered into an agreement (the"Bike Agreement") allowing Developer to construct a
meandering walkway with a paved width of six (6)feet on the north side of Recreation Lane instead
of the south side of Recreation Lane in the B.A.C.The location of this walkway is depicted on Exhibit
"A,"Sheet 2.
WHEREAS, In addition to the meandering walkway, the Bike Agreement required the Developer
to convey to Collier County, a twelve (12) foot easement for a public walkway/ bike path between
platted lots 142 and 143 of the Forest Park III subdivision in Plat Book 39, Page 4 at the terminus of
Hudson Court in the Forest Park community and construct a six(6)foot paved walkway/bike pathway
within the easement to connect to and from Golden Gate High School. The location of this walkway
is depicted on Exhibit"A,"Sheet 1.
WHEREAS,the Collier County School District controls bicycle and pedestrian access through the
paved walkway/bike pathway at the terminus of Hudson Court in the Forest Park community to the
Golden Gate High School with a gate that is locked when school access is not permitted (the"School
Gate"); and
WHEREAS, Forest Park installed a pedestrian gate (the"Pedestrian Gate") at the main entrance
to the Forest Park community for safety reasons, in the location depicted on Exhibit"C";
WHEREAS,the parties desire to set forth terms related to the locking of the Pedestrian Gate.
Now,therefore, in consideration of the foreign Recitals and other good and value consideration,
the receipt of which is hereby acknowledged,the parties agree as follows:
1. This Agreement incorporates all the conditions and allowances of the Bike Agreement attached
as Exhibit"B"and incorporated herein, except as revised in this Agreement.

2. The Forest Park may secure (lock) the Pedestrian Gate between the hours of 6:00 PM and 5:00
AM Monday through Friday and 6:00 PM and 6:00 AM Saturday and Sunday and during the hours
that the Collier County School District locks the School Gate.
3. The County may at any time change the hours that Forest Park may lock the Pedestrian Gate in
paragraph 2 of this Agreement,to coincide with the hours that the School Gate is open.As of the
date of this Agreement,the School Gate is open to the public Monday through Friday, 5:30 AM to
7:00 AM and 1:30 PM to 4:00 PM. Collier County shall provide 30-days written notice to Forest
Park of any change to the hours that the Pedestrian Gate may be locked.
IN WITNESS WHEREOF,the parties hereto have caused this Agreement to be executed by their
appropriate officials, as of the date first above written.

i, Forest Park's Subdivision plans cu..anGy call for a sidewalk on the South
side of the street segment as is indicated by Legend"SW' on the attached
Exhibit"A."
2. The previovely planned sidewalk segment need not be constructed. In lieu
thereof Forest Park hereby agrees to construct a public meandering walkway
that shall have a paved width of six (6) feet on the north side of the street
segment, The location of this walkway is depicted by the Legend"\4rW"on
the attached Exhibit"A."
3, At no cost to Collier County,Forest Park shall convey to Collier County a
twelve (12) foot easement for a Fublic walkway/bike path. This
wail aylbike path shall have a paved width of six (6) feet, This
improvement is depicted by on Exhibit "A" as "BP-" This improvement
shall be centered on the lot line that divides the two residential lots in the
northeast corner of Forest Park.
