CESM Minutes 12/06/2024 December 6, 2024 1 MINUTES OF THE HEARING OF THE COLLIER COUNTY SPECIAL MAGISTRATE Naples, Florida, December 6, 2024 LET IT BE REMEMBERED the Collier County Special Magistrate, having conducted business herein, met on this date at 9:00 AM in REGULAR SESSION in Administrative Building “F,” 3rd floor, Collier County Government Complex, Naples, Florida, with the following persons present: SPECIAL MAGISTRATE: Honorable Patrick H. Neale ALSO PRESENT: Thomas Iandimarino, Code Enforcement Director Cristina Perez, Code Enforcement Supervisor Helen Buchillon, Code Enforcement Specialist December 6, 2024 2 Any person who decides to appeal a decision of the Special Magistrate will need a record of the proceedings pertaining thereto, and therefore may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based. Neither Collier County nor the Special Magistrate shall be responsible for providing this record. I. CALL TO ORDER-SPECIAL MAGISTRATE PATRICK H. NEALE PRESIDING The Honorable Special Magistrate Patrick H. Neale called the Hearing to order at 9:00 AM. All those testifying at the proceeding did so under oath. II. Pledge of Allegiance The Pledge of Allegiance was recited. Prior to conducting the Hearing, Respondents were given an opportunity to speak with their Investigating Officers for a Resolution by Stipulation. The County’s goal is to obtain compliance without being punitive. Recessed: 9:10am Reconvened: 9:20am III. Shed erected in rear yard without proper Collier County permit. Determination concluded a permit is needed for addition on rear of property. FOLIO NO: 36238520009 PROPERTY ADDRESS: 5375 Hunter Blvd, Naples, FL 34116 Marcos Benavides and Madai Hernandez testified they obtained permits for alterations to the septic system and the work has been completed at a cost of $15,000. There are approximately 30 inspections remaining for the other permits and requested a 120 extension in the case. Officer Owen had no objection to the request. Special Magistrate Neale, after hearing the testimony, Granted the Respondent’s Motion for an Extension of the Compliance Deadline until the April 2025 Special Magistrate Hearing date. C. Property has 7 total hooved animals. FOLIO NO: 38055680007 PROPERTY 3510 31st Ave SW, Naples, FL 34117 Officer Owen requested the hearing reporting the repeat violation has been abated. He requested a finding the landowner was not in compliance with the Ordinance at the time the Notice of Violation was issued. . The Stipulation was entered into by Javier Guevera on December 6, 2024. Special Magistrate Neale found the Respondent in violation of the subject Ordinance on the date the Notice of Violation was issued and ordered him to: 1. Pay Operational Costs in the amount of $111.70 incurred in the prosecution of this case. 2. Pay a Civil Penalty of $250.00 for a repeat violation within 30 days of this hearing. 3. Notify Code Enforcement Investigator when the violation has been abated in order to conduct a final inspection to confirm abatement. If the Respondent fails to abate the violation the County may abate the violation and may use the assistance of the Collier County Sheriff’s Office to enforce the provisions of this agreement and all costs of abatement shall be assessed to the property owner. Running at large, issued on November 10, 2024, at 10:45 am, 1st Offense “Hera”. FOLIO NO: PROPERTY ADDDRESS: 3810 28th Ave SE, Naples, FL 34117 Supervisor Mucha and Officer Frank requested the hearing. The Stipulation was entered into by Dayanis Ruiz on December 6, 2024. Special Magistrate Neale found the Respondent GUILTY of the alleged violation and was ordered to: 1. Pay Operational Costs in the amount of $50.00 incurred in the prosecution of this case. 2. Pay and Administrative Fee of $7.00 incurred in the prosecution of this case. 3. Pay a Fine of $500.00. A fine amount of $400.00 to be waived if there are no further incidents involving the dog and Domestic Animal Services within 6 months of this hearing. CASE NO: CENA20230011168 OWNER: A PAUL GREGG TR OFFICER: Jason Packard VIOLATIONS: Collier County Code of Laws and Ordinances, Article VI, Section 54-185(d). Prohibited Collier County Exotics present on an unimproved property including but not limited to Ear leaf Acacia and Brazilian Pepper within 200 feet of multiple improved parcels. FOLIO NO: 55254880005 PROPERTY NO SITE ADDRESS, Naples, FL 34113 Date of Notice of Hearing by Certified Mail: 11/5/24 Date of Property/Courthouse Posting: 11/21/24 The Respondent was not present. Supervisor Packard represented the County testifying the landowner was notified of the violation via the address on record and there has been no response to date. Evidence Entered: Exhibit 1: Aerial photo of the property Exhibit 2: Zoning Map Exhibit 3 – 5: Documentation of Property Ownership Exhibit 6: Plat Map Exhibit 7 – 11: Photos taken 12/20/23 December 6, 2024 6 Exhibit 12 – 14: Photos taken 12/5/24 Exhibit 15: Violation Determination by Jamie Cook of the Growth Management Division Sonja Frey testified she is the adjacent landowner and expressed concern the area is overgrown and harbors Palm Rats and other wildlife including coyotes and is a nuisance to the neighborhood. Special Magistrate Neale queried if the County could abate the violation if necessary. Director Iandimarino testified the land is only valued at $94 with annual taxes of 94 cents. It would not be in the best interest of the County to abate the violation and charge the owner based on the value of the property. Ms. Frey noted she, or others, may have an interest in acquiring the property however the landowner is difficult to contact. . Special Magistrate Neale CONTINUED the case to the February 2025 Special Magistrate hearing date. 5. CASE NO: CEROW20240008754 OWNER: John Christmas OFFICER: Brian Owen VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 110, Article II, Section 110-32. Vegetative materials in the right-of-way that is obstructing the natural flow of water. FOLIO NO: 36912560000 PROPERTY ADDRESS: 321 21st St NW, Naples, FL 34120 Date of Notice of Hearing by Certified Mail: 11/6/24 Date of Property/Courthouse Posting: 11/77/24 Officer Owen represented the County testifying the case is the result of a complaint from the Collier County Right of Way Department regarding vegetation in the swale. The Notice of Violation was issued on 9/23/24 however Mr. Christmas stated he wanted to wait until the rainy season was over to address the issue as the swale was full of water. The violation remains as of today and he requested evidence be entered in the case Mr. Christmas objected to the evidence has he had requested time to abate the violation and has cleared the swale of vegetation. Officer Owen noted the swale is cleared by the area needs to be cleared 30 feet from the crown of the road and there are stumps and other debris in the restricted area. Special Neale overruled the objection. Evidence Entered: Exhibit 1 – 5: Photos dated 9/11/24 Exhibit 6: Photo dated 11/4/24 Exhibit 7 – 13: Photos dated 12/5/24 Mr. Christmas testified he has cleared the swale and drainage is unimpeded. Other property owners in the area have swales with impediments and he was unaware the stumps had to be treated with a herbicide containing dye. Special Magistrate Neale noted the County requires the area in question to be cleared 30 feet from the crown of the road and other property owner’s situations are not the subject of the hearing. Special Magistrate Neale found the Respondent GUILTY of the alleged violation and was ordered to: December 6, 2024 7 1. Pay Operational Costs in the amount of $111.70 incurred in the prosecution of this case within 30 days of this hearing. 2. Obtain all required Collier County Right-of-Way Permit(s), or Demolition Permits, Inspections and Certificate of Completion to restore the right-of-way to its originally permitted condition by removing all prohibited/unpermitted vegetation within the right-of - way by January 10, 2025 or a fine of $100.00 per day will be imposed until the violation has been abated. 3. Notify Code Enforcement Investigator when the violation has been abated in order to conduct a final inspection to confirm abatement. If the Respondent fails to abate the violation the County may abate the violation and may use the assistance of the Collier County Sheriff’s Office to enforce the provisions of this agreement and all costs of abatement shall be assessed to the property owner. Total Amount Due: $111.70 VIII. NEW BUSINESS B. MOTION FOR IMPOSITION OF FINES AND LIENS 2. CASE NO: CESD20230006622 OWNER: Fernando Perez and Mercedes Alonso OFFICER: Craig Cooper VIOLATIONS: Collier County Land Development Code 04-41, as amended, Sections 10.02.06(B)(1)(a), 10.02.06(B)(1)(e) and 10.02.06(B)(1)(e)(i). Un-permitted altered electrical improvement removed prior to obtaining an electrical demolition permit. FOLIO NO: 38501160000 PROPERTY 41 33rd Ave NE, Naples, FL 34120 Officer Cooper represented the County testifying the violation has been abated but not in the prescribed timeframe. Mr. Perez applied for permits on 7/2/24 (prior to the date required to abate the violation) however they were not issued until 9/27/24. The abatement occurred within 3 weeks of the permits being issued. Special Magistrate Order: No. 6408 Page: 2405 Fine Amount: $100.00/day Duration: 42 days Total Fine Amount: $4,200.00 Unpaid Operational Costs: $111.85 Total to Date: $4,311.85 Mr. Perez testified he took measures to abate the violation immediately after obtaining the permits. Special Magistrate Neale, after hearing the testimony and reviewing the factors of the case, noted the violation was abated in a timely manner, GRANTED the County’s Motion for Imposition of Fines and Liens in the amount of $111.85. Said amount to be paid within 30 days of this hearing and become a lien on the property. VII. PUBLIC HEARINGS A. HEARINGS 6. CASE NO: CEPM20240008133 December 6, 2024 8 OWNER: PACIFICA NAPLES LLC OFFICER: Jonathan Musse VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 22, Article VI, Sections 22-228(1), 22-231(1), 22-231(11), 22- 231(12)(i) and 22-231(19). Presence of mold in the hallway closet, leak that appears to be coming from the ceiling hallway closet, inoperable disposal unit, clogged drain in the kitchen sink, leak in the refrigerator, loose front doorknob not properly secured, and missing doorbell with exposed wires. FOLIO NO: 35830040001 PROPERTY ADDRESS: 4185 Heritage Cir, Unit 108, Naples, FL 34116 Date of Notice of Hearing by Certified Mail: 11/18/24 Date of Property/Courthouse Posting: 11/19/24 Yiraliz Torres, Property Manager represented the Respondent. Officer Musse represented the County testifying the violation remains unabated and he is unsure if the unit is occupied. Evidence Entered: Exhibits 1 -18: Photos dated 8/27/24 Ms. Torres testified:  Vendor issues have delayed abating the numerous violations on site and proposals have been obtained to address all of them.  Staffing issues also contribute to the delays as there are only 2 maintenance employees for the 3 properties held by the landowner in Naples.  She is unsure if the unit is occupied and requested more time to abate the violation. Special Magistrate Neale noted the issues on site have been ongoing for a long time and expressed concern the landowner is not diligent in addressing the issues. Special Magistrate Neale found the Respondent GUILTY of the alleged violation and was ordered to: 1. Pay Operational Costs in the amount of $111.75 incurred in the prosecution of this case within 30 days of this hearing. 2. Pay a Civil Penalty of $500.00 for a repeat violation. 3. Hire a licensed mold remediation company to treat, clean and sanitize the mold in the unit an provide a post mold report to confirm the dwelling is free from mold infestation to bring the property into compliance with the Collier County Property Maintenance Code within 14 days of this hearing or a fine of $250.00 per day will be imposed until the violation has been abated. 4. Obtain all required Collier County Building Permit(s), Inspections and Certificate of Completion to bring the property into compliance with the Collier County Property Maintenance Code within 30 days of this hearing or a fine of $250.00 per day will be imposed until the violation has been abated. 5 Notify Code Enforcement Investigator when the violation has been abated in order to conduct a final inspection to confirm abatement. If the Respondent fails to abate the violation the County may abate the violation and may use the assistance of the Collier County Sheriff’s Office to enforce the provisions of this agreement and all costs of abatement shall be assessed to the property owner. CASE NO: CEPM20240004571 OWNER: PACIFICA NAPLES LLC OFFICER: Jonathan Musse VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 22, Article VI, Sections 22-228(1), 22-231(12)(i), and 22-231(19). Inoperable A/C system not properly cooling the dwelling, microbial growth on the A/C Handler that would need to be cleaned and sanitized, front door not weather-tight and weatherproof and rotting wood on the front door frame. FOLIO NO: 35830040001 PROPERTY 4185 Heritage Circle Unit 207, Naples, FL 34116 Officer Musse represented the County testifying the violation has not been abated amassing fines and costs to date in the amount of $15,361.75. A permit is on file for replacement of the A/C system. Yiraliz Torres, Property Manager represented the Respondent testifying a proposal has been approved to abate the violation. Special Magistrate Neale CONTINUED the case to the January 2025 Special Magistrate Hearing date with fines continuing to accrue. 4. CASE NO: CEPM20240003929 OWNER: PACIFICA NAPLES LLC OFFICER: Jonathan Musse VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 22, Article VI, Section 22-228(1). Inoperable A/C System. FOLIO NO: 35830040001 PROPERTY ADDRESS: 4280 Heritage Lane Unit #208, Naples, FL 34116 Yiraliz Torres, Property Manager represented the Respondent. Officer Musse represented the County testifying the violation has not been abated amassing fines and costs to date in the amount of $24,223.50. There is not a permit on file for replacement of the A/C system. Special Magistrate Neale CONTINUED the case to the January 2025 Special Magistrate Hearing date with fines continuing to accrue. 5. CASE NO: CEV20240005764 OWNER: Beaumanoir Desrosiers and Eddyge Charles OFFICER: Brian Owen VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 130, Article III, Section 130-96(a). Travel trailer not stored in the proper location on the property. FOLIO NO: 36314000003 PROPERTY ADDRESS: 2312 51st St SW, Naples, FL 34116 Officer Owen represented the County testifying the violation has been abated but not in the prescribed timeframe. Special Magistrate Order: No. 6407 Page: 3126 Fine Amount: $100.00/day December 6, 2024 10 Duration: 53 days Total Fine Amount: $5,300.00 Unpaid Operational Costs: $223.40 Total to Date: $5,523.40 Mr. Desrosiers testified:  He was given the option to remove the trailer off site or move it to the rear of the property.  He wanted to move it to the rear of the property however needed to have a tree removed.  He didn’t appear at the prior hearing for the case regarding the Notice of Violation as he was unaware the certified mail was delivered as it was received by another person in the home while he wasn’t present.  When he became aware of all the issues relating to the code case and Imposition of Fines hearing, he ultimately removed the trailer from the site on November 12, 2024. Supervisor Perez presented a photo depicting the Notice of Hearing posted on the front door of the home on 9/5/24. Mr. Derosiers testified he never saw the posting and it must have been removed by a family member. Special Magistrate Neale, after hearing the testimony and reviewing the factors in the case GRANTED the County’s Motion for Imposition of Fines and Liens in the amount of $973.40 ($750.00 in fines and $223.40 for Operational Costs). Said amount to be paid within 30 days of this hearing and become a lien on the property. Recessed: 11:20am Reconvened: 11:30am VII. PUBLIC HEARINGS A. HEARINGS 2. CASE NO: CEEX20240010409-FA-210528 OWNER: Lorranine Mustari OFFICER: Tami Canger VIOLATIONS: Collier County Ordinance No. 2019-04. Excessive false alarms: Residential. FOLIO NO: PROPERTY 251 Ospreys Landing #1302, Naples, FL 34104 Officer Canger testified the Citation was issued on 10/24/24 due to 7 false alarms being responded to at the premise within a 180-day timeframe. Since the Citation was issued there have been 2 additional incidents bringing the total to 9 within the timeframe. Ms. Mustari notified her there were neighbor and management employee issues contributing to triggering the alarm, however when the officers arrived, they found no criminal activity occurring on site. Ms. Mustari testified she believes the alarm triggers due to a noisy neighbor residing above her premise, unauthorized persons entering the unit and or intentional disturbances outside her door. The alarm company has been notified and provided maintenance to the system and it is working as intended. Officer Canger noted video surveillance at the time of the incidents have revealed there was no activity at the door and she has contacted the monitoring company but due to privacy matters they will not provide any detailed information of the incidents. December 6, 2024 11 During discussion with the parties and Special Magistrate Neale, it was noted it is likely the system may be malfunctioning triggering false alarms and not operating as intended. Special Magistrate Neale after hearing the testimony UPHELD Issuance of the Citation and ordered the Respondent to pay a Fine of $150.00, Operational Costs of $50.00 and a $5.00 Administrative Fee for a total amount due of $205.00 payable within 30 days of this hearing. 7. CASE NO: CESD20230003747 OWNER: BROUWER ENTERPRISES 2010 INC OFFICER: Cristina Perez VIOLATIONS: Collier County Land Development Code 04-41, as amended, Sections 10.02.06(B)(1)(a), 10.02.06(B)(1)(e) and 10.02.06(B)(1)(e)(i). Mini split air conditioning unit installed without a valid/issued permit. FOLIO NO: 63760002220 PROPERTY ADDRESS: 6032 Diamonte Pl, Ave Maria, FL 34142 Date of Notice of Hearing by Certified Mail: 11/18/24 Date of Property/Courthouse Posting: 11/19/24 The Respondent was not present. Supervisor Perez testified the Notice of Violation was issued on 5/8/24 and the case revolves around permits issued, renewed and expiring without the final inspections being completed. The owner resides out of the country and occupies the home part time and was under the impression the inspections were completed and the case resolved.
