Agenda 12/10/2024 Item #17C (Execute a Utilities Quitclaim Deed and Termination of Utility Easement, quitclaiming and terminating the utility facilities and appurtenant easements originally conveyed to the County)12/10/2024 Item # 17.C ID# 2024-1653 Executive Summary Recommendation to approve and authorize the chairman to execute a Utilities Quitclaim Deed and Termination of Utility Easement, quitclaiming and terminating the utility facilities and appurtenant easements originally conveyed to the County by those instruments recorded in Official Record Book 1395, Page 2290, and Official Record Book 1395, Page 2287, of the Public Records of Collier County, Florida, and located approximately 420-feet north of Palm View Drive, lying easterly and adjacent to Palm River Blvd. in Section 23, Township 48 South, Range 25 East, Collier County, Florida. [VAC-PL20240002369] (Companion to items 17A and 17B) OBJECTIVE: To quitclaim and terminate the County’s interest in certain utility facilities and appurtenant easements to allow the proposed redevelopment of the property located at 208 Palm River Boulevard in connection with petitions Palm River Corporate Housing (SDP), SDP-PL20230015865, GMPA-PL20230011318, and PUDZ-PL20230011319 (the “Palm River Corporate Housing Project”). CONSIDERATIONS: Petition VAC-PL20240002369 has been received by the Development Review Division, Growth Management Community Development Department, requesting to vacate the two 15-foot-wide Sewer Easements, #1 and #2 as described Official Record Book 1395, Page 2287 of the Public Records of Collier County, Florida, located in Section 23, Township 48 South, Range 25 East, Collier County, Florida. Additionally, within the easements are County wastewater facilities servicing 208 Palm River Boulevard, originally conveyed to the County in 1988 through that instrument recorded in Official Record Book 1395, Page 2290, of the Public Records of Collier County, Florida. This vacation application is companion to the proposed Palm River Corporate Housing Project located at 208 Palm River Boulevard, Naples, Florida (companion GMPA-PL20230011318 and PUDZ-PL20230011319). It proposes demolishing the three (3) existing multi-family residential buildings and constructing one (1) new multi-family residential building. The property is part of Block F, Unit 4 of the Palm River Estates Plat Book 8, Page 70. There are currently two sanitary sewer utility facilities and appurtenant easements on the property; one is located on the north portion of the site, and the other is located on the south portion. Both include 15-foot wide utility easements, per Official Record Book 1395, Page 2292, and utility facilities, per Official Record Book 1395, Page 2290, for an existing 8-inch sanitary sewer main and a terminal manhole, which are proposed to be removed as part of the Palm River Corporate Housing Project. A new privately owned 8-inch sanitary main is proposed to serve the new building, which will not require a utility easement on private property. The Development Review Division has reviewed this petition and found no reason for objection. FISCAL IMPACT: Growth Management Community Development Department, Development Review Division staff has collected a $2,000 “Petition to Vacate” fee from the petitioner, which covers the County’s cost of recording and processing the Petition. GROWTH MANAGEMENT IMPACT: There is no growth management plan impact associated with this action. LEGAL CONSIDERATIONS: The proposed Utilities Quitclaim Deed and Termination of Utility Easement reverses the original conveyance of utility facilities and appurtenant easement and safeguards the County by ensuring that the existing utilities will be abandoned in a manner satisfactory to the County. The Utilities Quitclaim Deed and Termination of Utility Easement is a more appropriate method of terminating the County’s interest (as opposed to a vacation resolution) because the easements (1) are not platted, (2) exist solely between the County and the property owner (without public interest or common law dedications), and (3) contain utility facilities whose ownership and subsequent abandonment must also be contemplated. Page 10560 of 10663 12/10/2024 Item # 17.C ID# 2024-1653 Resolution No. 2021-243, Attachment “C,” Section B. establishes a policy where such “[r]equests will be granted as long as the public benefit is established or no public detriment is established” and authorizes the Board to “[q]uitclaim, renounce, and disclaim any right of the County and the public in and to any land, or interest therein, acquired by purchase, gift, devise, dedication or prescription for drainage, utilities, access, maintenance, preservation, or conservation or other public purposes; when such interest is granted to the County or public by any instrument recorded in the public records of Collier County other than on a subdivision plat.” This item has been approved as to form and legality and requires a majority vote for Board approval. –DDP RECOMMENDATIONS: To approve and authorize the chairman to execute a Utilities Quitclaim Deed and Termination of Utility Easement, quitclaiming and terminating the utility facilities and appurtenant easements originally conveyed to the County by those instruments recorded in Official Record Book 1395, Page 2290, and Official Record Book 1395, Page 2287, of the Public Records of Collier County, Florida, and located approximately 420-feet north of Palm View Drive, lying easterly and adjacent to Palm River Blvd. in Section 23, Township 48 South, Range 25 East, Collier County, Florida.
