OBJECTIVE: To appoint Jimmy Nieves to the Immokalee Beautification Advisory Committee, to fill the remainder of a vacant term expiring on September 23, 2026, and reclassify Cherryle Thomas from the Immokalee Chamber of Commerce Representative to the category of Resident. CONSIDERATIONS: This 7-member committee was established by Ordinance No. 11-39, as amended by Ordinance Nos. 20-47 and 21-30, to assist the Board of County Commissioners in the business affairs of the Immokalee Beautification Taxing District and prepare and recommend an itemized budget to carry out the business of the district for each fiscal year. Members must be electors of Collier County and qualify in one of the following categories: Four members shall be permanent residents within the MSTU, and three members may be an owner of a business or commercial property within the MSTU or may be an appointed representative of a non-profit entity operating within the MSTU. Terms are 4 years. A list of the current membership is included in the backup. There are three vacant seats on this board. The vacancies were advertised, and the following application was received: APPLICANT CATEGORY DIST. VOTER ADVISORY COMM. Jimmy Nieves Immokalee Eastern Chamber of Commerce Representative Lee No None Section 122-1840(b) of the Code of Laws describes the committee membership requirements as follows: “… One member may be an owner of residential or commercial property within the MSTU or an appointed representative of a business located within the MSTU and elector of Collier County.” COMMITTEE RECOMMENDATION: Cherryle Thomas, the current representative for the Immokalee Chamber of Commerce, asked to be moved to the category of Resident within the MSTU as she is no longer a member of the Chamber. The Chamber of Commerce recommended that Jimmy Nieves be their replacement representative. At its meeting on October 16, 2024, the committee voted unanimously to recommend that Jimmy Nieves be appointed to a seat on the committee and that residency requirement be waived for this appointment as Mr. Nieves resides in Lee County. Recommendation memos are included in the backup. The remaining vacancies will continue to be advertised. FISCAL IMPACT: There is no fiscal impact associated with this action. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action. LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote for Board approval. - JAK RECOMMENDATIONS: That the Board appoint Jimmy Nieves to the Immokalee Beautification Advisory Committee, to fill the remainder of a vacant term expiring on September 23, 2026, and reclassify Cheryl Thomas from the Immokalee Chamber of Commerce Representative to the category of Resident. WHEREAS, Collier County Ordinance No. 11-39, as amended by Ordinance No. 20-47, established the Immokalee Beautification Advisory Committee to advise the Board of County Commissioners (Board) on matters pertaining to the Immokalee Beautification Municipal Service Taxing Unit (MSTU); and WHEREAS, Ordinance No. 20-47 provides that the Advisory Committee shall be composed of seven members, all electors in Collier County: four members shall be permanent residents of the MSTU; three members may be an owner of a business or commercial property within the MSTU or an appointed representative of a non-profit entity located within the MSTU; and WHEREAS, there are three vacant seats on this Committee; and WHEREAS, the Board of County Commissioners has provided public notice soliciting applications from interested parties; and WHEREAS, the Immokalee Beautification Advisory Committee has provided the Board with its recommendation for appointment. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that CHERYL THOMAS, who is currently classified as a Non-Profit Representative, be reclassified to the category of Resident, for the remainder of her current term that expires on September 23, 2025, and BE IT FURTHER RESOLVED that JIMMY NIEVES, is hereby appointed to the Immokalee Beautification Advisory Committee in the category of Non-Profit Representative (Chamber of Commerce) to fill the remainder of a vacant term expiring on September 23, 2026, and that the residency requirement is hereby waived for the term of this appointment.
