Agenda 12/10/2024 Item #16F 8 (Approve an "after-the-fact request for public assistance tot the Federal Emergency Management Agency (FEMA) for reimbursement of expenses incurred during Hurrican Helene and Hurricane Milton - Execute the subsequent funding)12/10/2024 Item # 16.F.8 ID# 2024-2161 Executive Summary Recommendation to approve an “after-the-fact” request for public assistance to the Federal Emergency Management Agency (FEMA) for reimbursement of expenses incurred during Hurricane Helene and Hurricane Milton and authorize the County Manager to execute the subsequent funding agreements. OBJECTIVE: To ensure the County is eligible for FEMA Public Assistance related to Hurricane Helene and Hurricane Milton. CONSIDERATIONS: In order to be eligible for federal financial assistance in preparation for and in response to Hurricane Helene and Hurricane Milton, Collier County must submit a Request for Public Assistance to FEMA and the State of Florida Department of Emergency Management (FDEM) as the pass-through agency. Once approved, the County will seek reimbursement for all eligible expenses including labor, equipment, and materials in support of the emergency. Prior to any reimbursement, funding agreements will be required to be executed by the County Manager. FEMA issued the Hurricane Helene initial notice of a major disaster declaration for the State of Florida (FEMA-DR- 4828-FL) on September 28, 2024, the notice was subsequently amended to include Collier County. The Hurricane Milton initial notice of major disaster declaration for the State of Florida (FEMA-DR-4834-FL) for was issued on October 11, 2024, and included Collier County. The county is eligible to request financial assistance for both events. To begin the process, the Request for Public Assistance funding applications were submitted through the Florida Department of Emergency Management’s electronic system (Grants Portal) on December 4, 2024. Collier County CMA #5330 authorizes the County Manager to approve the submittal of grant applications with subsequent Board of County Commissioners action at the next available Board meeting to ratify the approval as “after- the-fact.” FISCAL IMPACT: Approval of the request will enable Collier County to be reimbursed for eligible expenses associated with Hurricane Helene (Project 50312) and Hurricane Milton (Project 50320). Expenses associated with Hurricane Helene and Hurricane Milton are currently estimated at $7.6 million and $15.7 million respectively. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, raises no legal issues at this time and requires majority vote for approval. -JAK RECOMMENDATIONS: To approve an “after-the-fact” Request for Assistance to secure the County as an eligible applicant for FEMA reimbursement of Hurricane Helene and Hurricane Milton related expenditures and authorize the County Manager to execute the funding agreements. (ATF 25-002). A local government entity seeking Public Assistance funding from FEMA must submit a Request for Public Assistance (RPA) to FEMA within 30 days of the respeclive area being designated in the declaration. Estimated recovery costs for Hurricane Helene and Milton total $23,327,7O0. The federal share of assistance is not less than 75% of the eligible cost for emergency measures and permanent restoration. FDEM historically participates in hatf of the remaining 25% share resulting in a 12.5o/o local match from the County. To expedite submittal of the funding request, staff is requesting that the County Manager approve the RPA for early submittal on November 25, 2024, followed by an after-the-fact approval by the Board of County Commissioners at the December 10,2024, meeting. The approval also requests the County Manger or designee act as the Authorized Representative to executed future funding agreements. Furthermore, the OMB Grants Compliance Manager will serve as the primary contact for administrative responsibilities related to this grant application and appro/al of Projec{ Worksheeb finalized in the FEN4A Granb Portal before transfening to FDEM for execution to receive reimbusement.
