Executive Summary
Recommendation to approve and authorize the Chairman to sign a Landlord Payment Agreement with Mary Biddle for
the provision of medium-term rental assistance under the Rapid Re-Housing and Homelessness Prevention Program
funded by the Emergency Solutions and Rapid Unsheltered Survivor Housing Grant Programs.
OBJECTIVE: To support comprehensive affordable housing opportunities by providing rental assistance to individuals
and families who are homeless and at risk of homelessness including those who may be impacted by Hurricane Ian and
any other declared disaster who may also be homeless or at risk of homelessness in Collier County.
CONSIDERATIONS: The U.S. Department of Housing and Urban Development (HUD) provides Emergency
Solutions Grants (ESG) and Emergency Solutions Grant Rapid Unsheltered Survivor Housing (ESG-RUSH) funds to
address housing-specific homeless and at-risk homeless needs identified in the community. These funds may include
payment for rental application fees, security deposits, utility deposits or payments, last month’s rent, as well as short- or
medium-term rental assistance.
Every five years, the County is required to prepare a Consolidated Plan outlining the goals and objectives for intended
uses of HUD entitlement funds over the five-year period. Additionally, the County must annually submit One Year
Action Plans delineating the specific activities for each Program Year (PY). On June 22, 2021, Agenda Item 16.D.7, the
Board approved the current 2021-2025 Consolidated Plan. This is the fourth program year. On July 23, 2024, Agenda
Item 16.D.4, the Board approved the current PY24-25 One-Year Action Plan, as well as the ESG funding for PY23 and
PY24.
On October 26, 2022, the County was notified of the award in the amount of $861,716 in Emergency Solutions Grant
Rapid Unsheltered Survivor Housing (ESG RUSH) funding. On December 13, 2022, Agenda Item 16.D.8, the Board
approved a Substantial Amendment to the PY22-23 Annual Action Plan to accept the ESG RUSH funds with a period of
performance date of February 14, 2023, to February 13, 2025. On February 29, 2024, the County was notified of a
second allocation award in the amount of $1,150,486 in ESG RUSH funding. On May 28, 2024, Agenda Item 16.D.4, a
Substantial Amendment to the FY23-24 Annual Action Plan was approved by the Board to accept the second allocation
from HUD in the amount of $1,150,486 for the ESG RUSH Program. On May 10, 2024, the final award agreement was
received from HUD with a period of performance date of May 13, 2024 to May 12, 2026.
In order to fully expend the 2023 and 2024 ESG and 2022 and 2024 ESG RUSH funds, it is necessary for the County to
directly administer an ESG/ESG RUSH program due to the lack of subrecipients. As part of this program, the priority is
to serve those who are homeless and at risk of homelessness as well as those impacted by recent natural disasters.
Pursuant to 25 CFR 576.106(e), HUD requires the County to enter into a rental assistance agreement with each landlord
in order to remit payment on behalf of the program participant. Landlords are only paid for those costs associated with
the leases, i.e. rent, pet fees, utilities etc. The maximum amount of assistance is determined by the recertification
eligibility of the tenant and as defined by the ESG program parameters.
Staff has identified Mary Biddle as a landlord willing to participate in the program and has prepared a Landlord
Payment agreement pursuant to 25 CFR 576.106(e). If this item is approved, the attached standard Landlord Payment
Agreement will be forwarded to the Board Chairman for signature and execution and shall end upon thirty (30) days'
written notice by either party.
FISCAL IMPACT: The proposed actions have no new Fiscal impact. The funding sources for the award are the
Emergency Solutions Grants which are budgeted in Housing Grant Fund (1835), Projects 33840, 33910, 33856, and
33917. The required match is available in Housing Grant Fund (1836), Project 33856 and 33917.
GROWTH MANAGEMENT IMPACT: Acceptance and implementation of this will further the Goals, Objectives,
and Policies within the Housing Element of the Growth Management Plan.
