Agenda 12/10/2024 Item #16B16 (Modification to the Forest Park Public Walkway Pedestrian Path Agreement between Collier County BCC and the Forest Park Master Property Owner's Association to secure their pedestrian gate during agreed upon days and hours)12/10/2024 Item # 16.B.16 ID# 2024-2167 Executive Summary Recommendation to approve a modification to the Forest Park Public Walkway Pedestrian Path Agreement between Collier County Board of County Commissioners and the Forest Park Master Property Owner's Association to allow for the gate to be secured during certain days and times. OBJECTIVE: To allow the Forest Park Master Property Owner's Association (MPOA) to secure their pedestrian gate during agreed upon days and hours. CONSIDERATIONS: At the November 23, 1999, Board of County Commissioner's (Board) meeting, the Board approved an agreement with the developer of the Forest Park Subdivision to provide a public walkway/bike path through the Forest Park Planned Unit Development (PUD) connecting to the Golden Gate Community Park. The pathway was constructed, and the required easements were put into place. In 2004, Collier County Public Schools constructed Golden Gate High School (GGHS), which is immediately adjacent to the Forest Park PUD, and the pathway was extended to allow for a connection to GGHS. Initially, the gates on either end of Forest Park were unlocked and allowed access through the community 24 hours a day, seven days a week. Recently, the MPOA was notified by Collier County Public Schools, Chief Operations Office, Kevin Saba, that the gate from Forest Park to GGHS would be unlocked only Monday through Friday from 5:30 a.m. to 7:30 a.m. and 1:30 p.m. to 4:00 p.m. The MPOA is seeking to modify the prior agreement to allow for the pedestrian gate at the entrance to their community to only be unlocked during the same dates and times as the ingress/egress gate to GGHS. Since GGHS has effectively severed the unfettered access that was previously experienced, staff does not object. However, the agreement does allow the County to amend the hours that the gate may be secured with a 30-day written notice to the MPOA. This provision is necessary in the event GGHS modifies its operations and allows for the gate to remain open for different days and times. FISCAL IMPACT: There is no fiscal impact for this agenda item. GROWTH MANAGEMENT IMPACT: This item is consistent with the Growth Management Plan. LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires a majority vote for Board approval.
