Executive Summary
This item requires that ex parte disclosure be provided by Commission members. Should a hearing be held on this item,
all participants are required to be sworn in. Recommendation to approve for recording the minor plat of Cuomo
Subdivision, Application Number PL20240004831.
OBJECTIVE: To have the Board of County Commissioners approve for recording the plat of Cuomo Subdivision, a
subdivision of lands located in Section 7, Township 49 South, Range 27 East, Collier County, Florida.
CONSIDERATIONS: The Development Review Division of the Growth Management Department has completed the
review of the minor plat of Cuomo Subdivision, and these documents are in compliance with the County Land
Development Code (LDC) and Chapter 177, Florida Statutes. Under LDC Section 10.02.04 D, a minor plat approval
may be requested as an alternative to the standard construction plans and plat approval where the plat does not require
improvements, a construction and maintenance agreement, a security performance bond, or phasing. All fees have been
paid. The Development Review Division recommends that the minor plat of Cuomo Subdivision be approved for
recording.
FISCAL IMPACT: The County will realize revenues as follows:
Fund: Growth Management Fund 1014
Agency: County Manager
Cost Center: 138327 - Land Development Services
Revenue generated by this project: Total: $1,030 plat review fee
GROWTH MANAGEMENT IMPACT: The developer must receive a Certificate of Adequate Public Facilities
(COA) prior to the issuance of the construction plan final approval letter and plat recordation, except when the applicant
elects to delay obtaining a COA for non-residential developments that are required to obtain approval of a site
development plan prior to the issuance of a building permit.
LEGAL CONSIDERATIONS: The applicant is requesting approval of the minor subdivision plat. The Board shall
consider the County Manager or designee’s recommendation and shall take evidence and testimony in regard to the
subdivision plat requirements identified in LDC sections 10.02.04 D, 10.02.04 B, 10.02.04 C, and other provisions of
the LDC, as well as Chapter 177, Florida Statutes. If the Board denies or places conditions on the subdivision plat, it
shall state reasons for such denial or conditions.
In accordance with the LDC, the applicant is required to submit the subdivision plat to the County Manager or designee
for recording within 18 months of the date of approval of the minor subdivision plat by the Board. However, following
approval by the Board, but prior to recordation, the County Manager or designee may approve minor insubstantial
changes to the minor subdivision plat, and the Board may approve any changes that are not minor and insubstantial.
This item has been approved as to form and legality and requires a majority vote for Board approval. -DDP
RECOMMENDATIONS: To approve the minor plat of Cuomo Subdivision, Application Number PL20240004831 for
recording.
