Executive Summary

Behavioral Health Center (CCBHC) project Infrastructure Surtax Fund (3018), Project No. 50239 (Companion to item
11B)
OBJECTIVE: To provide the Board with an update on the Collier County Behavioral Health Center project as
requested during the September 24, 2024, BCC Meeting.
CONSIDERATIONS: On March 12, 2024, (Agenda Item 11.C), the Board accepted a project update on the Collier
County Behavioral Health Center and directed to proceed with the design for 87 total beds (45 CSU, 30 adult
Medicare/Acute and 12 ESAC) with an estimated construction cost of $49.9 million based on the Design Development
package.
Currently, the estimated construction cost remains in line with the anticipated amount discussed on March 12, 2024. The
design is complete, and the Construction Manager is expected to deliver the Guaranteed Maximum Price (GMP) in
December 2024. The GMP amendment is expected to be presented to the Board for approval in January 2025.
FISCAL IMPACT: The latest approved construction cost estimate of $49.9 million is unchanged at this time. Funding
for the Collier County Behavioral Health Center, Project No. 50239, is provided in the Infrastructure Sales Tax Fund
(3018). Surtax collections have been sufficient to cover this updated project estimate. The Citizens Surtax Committee
has received periodic updates on project progress and cost estimates. The difference in funding requirement between the
original programed amount of $25 million and the final Guaranteed Maximum Price contract will be presented to the
Surtax Committee for validation at a future date.
GROWTH MANAGEMENT IMPACT: This project meets current Growth Management Plan standards to ensure the
adequacy and availability of viable public facilities.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, raises no legal issues at this time
and requires majority vote for approval. -JAK

•The Collier County Behavioral Health Center is an important Community Priority Project endorsed by the
voters in 2018 and identified as the number one priority of the Collier County Mental Health and
Addiction Ad Hoc Advisory Committee (now under the auspices of the Collier Coalition for Healthy
Minds). This project is funded by Infrastructure Sale Surtax Funding.
•The Facility will function as the Central Receiving Facility for those receiving services under both the
Baker and the Marchman Acts and will greatly increase mental health crisis support in Collier County.
•The proposed new Facility will serve the mental health needs of Collier County's expanding population
and will reduce demands currently placed on the Collier County Sheriff’s Office.

•The Board requested an update on the Collier County Behavioral Health Center Project on September 24,
2024.
•Facilities staff will update the project schedule in preparation for returning to the Board in January with a
Guaranteed Maximum Price amendment for approval.
•The David Lawrence Center staff will present an update on the intended operations of the facility and answer
any questions.
•The operational discussion will be a pre-cursor to a companion item to seek approval to proceed with naming
rights opportunities.

•Lease Effective Date: Closing date.

•Lease Termination: 30 years from the date of issuance of the Certificate of Occupancy.
•Options at End of Term:
- the County may terminate the Lease; or
- the County may renew the Lease for additional 5 years; or
- DLC (if the County does not terminate or renew the Lease) may purchase the Behavioral Health Center
for the greater of fair market value of the building established by appraisal by a mutually
agreed appraiser at DLC’s expense or the tax dollar expenditures by the County for the construction
– DLC has 6 months to elect purchase option. Otherwise, County will own the facility and the parcel.
•Rent: $1 per year in advance. DLC pays all costs, fees and charges.
•Insurance:
- DLC is required to carry all risk property insurance.

•Maintenance / Repair – DLC Responsibilities:
DLC is responsible for, maintaining and repairing the facility at its own cost and expense, including but not
limited to:
- Painting, janitorial, fixtures, and appurtenances (lighting, heating, plumbing , and air conditioning)
- Ensuring the property is kept in good, sanitary, and neat order, condition, and repair.
•Replacement – Collier County Responsibilities:
The County is responsible, at its expense, for replacing, as necessary:
- heating / ventilation / cooling systems
- generator
- roof
- weight bearing walls and columns
- parking lot resurfacing
- footings / foundations / structural floors .
