Agenda 11/12/2024 Item #16D 6 (Purchase agreement for the Florida Opiod Settlement Fund between BCC and CCSO)11/12/2024 Item # 16.D.6 ID# 2024-1601 Executive Summary Recommendation to approve and authorize the Chairman to approve a Purchase Agreement for the Florida Opioid Settlement Funds between the Collier County Board of County Commissioners and the Collier County Sheriff’s Office in the amount of $2,850,000.00 to provide Medication Assisted Treatment. (Community & Human Services Grant Support Fund 1806) OBJECTIVE: Utilize the funds received from the Florida Opioid Settlement Fund to address the opioid epidemic, to support the County's strategic objective of promoting access to health, wellness, and human services to benefit Collier County residents. CONSIDERATIONS: A local, state, and national crisis arose because of the manufacturing, distribution, and over- prescribing of opioids, which resulted in opioid abuse, misuse, overdoses, addictions, and death throughout municipalities, counties, states, and the nation. These activities contributed to the public health emergency and crisis commonly referred to as the opioid epidemic. Collier County and its municipalities have suffered from this crisis which has caused and is causing an undue strain on local government finances to implement programming to combat the opioid epidemic. The National Opiate Litigation filed by the State of Florida and various local governments against pharmaceutical companies has resulted in numerous settlements to be distributed to the State of Florida over multiple years (“Settlement Funds”). At the June 22, 2021 (Agenda Item #16.K.8) meeting, the Board of County Commissioners (Board) approved Resolution No. 2021-136 supporting the terms and conditions of the Proposed Memorandum of Understanding (MOU) provided by the Office of Attorney General, which set forth a framework of a unified plan for the proposed allocation and allowable uses of Settlement Funds to mitigate the harmful effects of the opioid epidemic (the “Florida Plan”). Resolution No. 2021-136 further authorized the County to execute formal agreements to implement the Florida Plan. As part of the settlement, two allocations will be received annually over the next eighteen years: (1) City/County Fund and (2) Regional Abatement Fund. On April 11, 2023, the Board approved the initial City/County allocation in the amount of $289,151.06 (Agenda Item # 16.D.5) and the Regional Abatement fund allotment in the amount of $2,628,842.15 on June 13, 2023, (Agenda Item #16.D.3). On January 1, 2024, the County received its second-year allocation of $633,277.95 for City/County and $1,241,219.04 for Regional Abatement. On May 2, 2024, the County received an additional allocation of $1,310.30 of City/County funding and anticipates receiving $15,431.56 in additional City/County funding for a total year 2 allocation of $650,019.81. The attached proposed agreement allocates $2,850,000 to the Collier County Sheriff’s Office to implement a Medication-Assisted Treatment (MAT) program in the County jail to provide medication/pharmacy supplies and medical personnel, for program administration, which is an allowable use under the Florida Plan (Core Strategy B: Medication-Assisted Treatment Distribution, and Core Strategy F: Treatment for Incarcerated Population). Other terms of the agreement provide a period of performance of May 1, 2024, through September 30, 2028. The agreement is contingent upon annual allocations of Settlement Funds. Should the County receive reduced funding, the agreement will be revised accordingly. FISCAL IMPACT: The funding for the purchase agreement associated with this item is budgeted in Community & Human Services Grant Support Fund (1806), Projects 44059- Regional and 44085-City/County. The settlement funds are available from 2023 and as such retroactive and pre award expenditures from May 1, 2024 are permissible. There is no new fiscal impact to the County. The parties acknowledge that the Funds originate from the State of Florida, Attorney General and DCF provided OPIOID grant funds and must be implemented in full compliance with all Attorney General and DCF rules and regulations and any agreement between COUNTY and Attorney General governing OPIOID Funds pertaining to this Agreement. In the event of curtailment or non-production of said State Funds, the financial sources necessary to continue to pay SUBRECIPIENT all or any portion of the Funds will not be available. In that event, the COUNTY may terminate this Agreement, which shall be effective as of the date it is determined by the County Manager or designee, in Page 3105 of 5419 11/12/2024 Item # 16.D.6 ID# 2024-1601 his or her sole discretion and judgment, that the Funds are no longer available. In the event of such termination, SUBRECIPIENT agrees that it will not look to, nor seek to hold the COUNTY, nor any individual member of the County Commissioners and/or County Administration, personally liable for the performance of this agreement, and the COUNTY shall be released from any further liability to SUBRECIPIENT under the terms of this agreement. GROWTH MANAGEMENT IMPACT: There is no Growth Management impact associated with this item.
